Present were: Mayor Garnet B. Rickard Councillor Keith Bapr Councillor Wm. Clarke Councillor Ivan M. Hobbs Councillor Jasper W. Holliday Councillor Maurice Prout Town Clerk J .M. McIlroy Absent: Councillor Ann Cowman - Due to Illness Also Present: A.C. Guiler, Town Manager D.N. Smith, Director of Planning T. Edwards, Planner David"Sims, Town Solicitor Resolution #C-5l8-79 Moved by Councillor Prout, seconded by Councillor Barr. THAT Council go into Connnittee of the Whole. "CARRIED" Resolution #C-5l9-79 Moved by Councillor Holliday, seconded by Councillor Prout. THAT the meeting be in camera with Staff present. "CARRIED" Resolution #C-520-79 Moved by Councillor Hobbs, seconded by Councillor Barr. THAT Report No. P-59-79 be received for information. "CARRIED" . . . Council Minutes Pits & Quarries R-l, R-lO Aggregate Producers Associates of Ontario Extension of Urban Boundaries (Newcastle Village) R-60, R-6l, R-62, R-63, R-64) - 2 - May 1st, 1979 Resolution #C-52l-79 Moved by Councillor Hobbs, seconded by Councillor HOlliday. THAT Council concur with Report P -60 -79 and that the Region of Durham be advised that the Town of Newcastle supports their position relative to referrals R-l and R-lO; and that Mr. D. Sims, Town SOlicitor, be advised that his presence is not required at the hearings dealing with this matter. "CARRIED" Resolution #C-522-79 Moved by Councillor Hobbs, seconded by Councillor Prout. THAT Council concur with Report P-57-79 and that the Region of Durham be advised of the Town's position relative to referrals R-60, R-63 and R-64, and that Mr. D. Sims, Town Solicitor, be advised that his presence is not required at those hearings dealing with the referrals noted above. "CARRIED" Resolution #C-523-79 Moved by Councillor Holliday, seconded by Councillor Hobbs. THAT Resolution #CW-474-76 be rescinded. "CARRIED UNANIMOUSLY" Resolution #CW-474-76 reads as follows: 'WHEREAS the construction of Highways Number 115 and 401 and the proposed Solandt Hydro Corridor and the widening of the C.N.R. main line and the construction of a service road have all seriously segmented this property; AND WHEREAS the applicant has a decision of the Supreme Court of Ontario registered on Title giving him legal access to the abutting Highway; AND WHEREAS the property concerned has been destroyed as a viable agricultural entity and its highest and best possible use would appear to be of a Highway Commercial nature; NOW THEREFORE this Council resolves that the Official Plan of the Region of Durham should be amended to authorize these lands to be developed for such uses as a tourist information centre, restaurant, museum, motel or hotel, sports complex or similar and associated uses and that this redesignation should be made forthwith to enable Council to properly zone and plan for a suitable land use." R-73, R-46, R-47, R-48, R-49 & R-SO . - 3 - May 1st, 1979 Resolution #C-S24-79 Moved by Councillor Hobbs, seconded by Councillor Holliday. THAT the designation requested in R-63 (i.e. Special Study Area) be endorsed. "CARRIED" Resolution #C-S2S-79 Moved by Councillor Hobbs, seconded by Councillor Holliday. THAT Council concur with Report P-S8-79 and that the Region of Durham be advised that the Town of Newcastle objects to the proposed amendment to the Durham Regional Official Plan and supports their position relative to referral R-62 presently before the Ontario Municipal Board, affecting Part of Lots 26, 27 and 28, Concession 2, former Township of Clarke; AND THAT the Draft Urban Area Plan for Newcastle Village be lifted from the table and referred back to staff for further review and/or revision, in light of Council's recent resolution supporting the Ridge Pine Park proposal (C-S04-79); AND THAT Mr. D. Sims, Town Solicitor, be requested to attend the hearings relative to this referral, on the Town's behalf; AND THAT Town Staff be authorized to attend those hearings as requested by the Town Solicitor, D. Sims. "CARRIED" Resolution #C-S26-79 Moved by Councillor Holliday, seconded by Councillor Prout. THAT Council concur with Report P-62-79 and that the Region of Durham be advised that the Town of Newcastle supports their position relative to referrals R-73, R-46, R-47, R-48, R-49 and R-SO; AND THAT the Region of Durham be advised that the Town of Newcastle supports their position relative to referral R-Sl, despite a previous Council Resolution #C-77-9l2 to the contrary; AND THAT Mr. D. Greenspan be directed to attend those hearings relative to the subject referrals; AND THAT the I.B.I. Group be authorized to represent the Town, relative to the Courtice Urban Area Plan, when and if so requested; AND THAT Town Staff be authorized to attend the subject hearing if so requested by Mr. Greenspan. "CARRIED" Resolution #C-77-9l2 reads as follows:- "THAT the Planning Advisory Committee Chairman's Report of meeting held on JlUle 13th, 1977 be adopted." Resolution #C-528-79 Moved by COlUlcillor Holliday, seconded by Councillor Barr. THAT the recommendation of the Town Solicitor as per his letter dated April 26th, 1979 be endorsed. "CARRIED" Resolution #C-529-79 Moved by COlUlcillor Holliday, seconded by Councillor Clarke. THAT By-Law No. 79-1 be defended by the Town Solicitor as per his letter dated April 18th, 1979. "CARRIED" Resolution #C-530-79 Moved by COlUlcillor Holliday, seconded by COlUlcillor Prout. THAT Mr. Walters of Ontario Hydro be advised that most of COlUlcil will be out of Town on May 4th, 1979 and it will not be possible to have a representative at the Street Lighting Seminar in Willowdale. "CARRIED" Resolution #C-533-79 Moved by COWlcillor Holliday, seconded by Councillor Barr. THAT the actions taken in camera be approved. "CARRIED" Resolution #C-534-79 Moved by Councillor Holliday, seconded by COWlcillor Hobbs. THAT the Town Clerk be requested to examine the Procedure By-law with regard to the calling of meetings and make recommendation to COWlcil as soon as possible.
