Council Minutes Roll Call Council Minutes TOWN OF NEWCASTLE April 23rd, 1979 Minutes of a regular meeting of Council held on April 23rd, 1979 at 7:00 p.m. in the Bowmanville Council Chambers. Present were: Mayor Garnet B. Rickard Councillor Keith Barr Councillor William Clarke Councillor Ann Cowman Councillor Ivan M. Hobbs Councillor Jasper W. Smith, Director of Planning Resolution #C-435-79 Moved by Councillor Barr, seconded by Councillor Clarke. THAT the Minutes of the Council Meeting held on April 9th, 1979 be adopted as read. "CARRIED AS AMENDED" Resolution #C-436-79 Moved by Councillor Holliday, seconded by Councillor Cowman. THAT the Notice of Motions Numbered 1, 2, 3, 4, 5 and 6 on the Agenda, be included in the foregoing Minutes. Resolution #C-437-79 Moved by Councillor Holliday, seconded by Councillor Prout. THAT the foregoing Resolution be amended to provide that Notice of Motion Number 6 not be included. Mayor Rickard ruled that the foregoing Resolutions were not in order. Resolution #C-438-79 Moved by Councillor Cowman, seconded by Councillor Holliday. THAT the Ruling of the Chair be challenged. "CARRIED" On being put to a vote Resolution #C-436-79 was carried as amended. . . . Council Minutes S.E.A.P. Darlington re Ontario Hydro Agreement SPLASH re Proposed Swimming Pool Canadian Order of Foresters Ridge Pine Park Limited Recess - 2 - April 23rd, 1979 Mrs. Dorothy Boden appeared before Council regarding the Town's agreement with Ontario Hydro regarding the Nuclear Generating Station. Mrs. Boden presented a brief and answered questions and suggested that the Town enter into a further agreement with Ontario Hydro to cover certain points which appeare to be omitted. Mr. A. Strike appeared before Council regarding the proposed swimming pool at Bowmanville High School. Mr. Strike addressed Council and also answered questions. Resolution #C-439-79 Moved by Councillor Prout, seconded by Councillor Holliday. THAT the Rules of Procedure be suspended so that six persons from the SPLASH delegation could be heard. "MOTION LOST" Mrs. Williams also addressed Council on the same matter and answered various questions. Mr. Milt Daking and Mr. Yourth addressed Council on behalf of the Canadian Order of Foresters relative to their proposed Senior Citizens Apartments project. They asked Council to pass a Resolution that they are in favour of the Project and if a meeting is arranged with the land owners, Geodyear and the Region of Durham that the Director of Planning be asked to be present at the meeting. Mr. D. Rice appeared before Council to advise them that Ontario Hydro had purchased all the holdings of the Company, but they had taken an Option to Purchase back land not used by the Hydro Corridor at the same price, if the Plan is approved for development He also requested that Council request the Region to modify the Official Plan when the matter is discussed at the Ontario Municipal Board proceedings in three weeks. THAT Resolution #C-453-79 be amended to provide that the Town of Newcastle present to Councillor Hobbs the Chain of Office which he wore for twelve years as a gift of appreciation, together with the suggestion that he comply with the request of the Museum Board to present the Chain of Office to the Museum as a permanent loan and that a suitable plaque to commemorate the occasion. THAT the letter dated April 14th, 1979 from the Bowmanville Museum regarding the opening for the 1979 Season on May 18th, 1979 be received for information; AND THAT May 18th, 1979 be declared "Bowmanville Museum Day" and a Notice be published in the Canadian Statesman to this effect. THAT the Council of the Town of Newcastle endorse the Resolution of the City of Nepean relative to the present danger of gas and oil spills which can gain entry into the sewer systems. THAT this Council authorizes the publication of a Public Notice regarding the destruction of weeds under the provision of the Weed Control Act of the Province of Ontario and directs the Regional Weed Inspectors to cause noxious weeds or weed seeds to be destroyed in such a manner as they may deem proper and that the expenses incurred by the said Weed Inspector in the discharge of their duties shall be placed on the Collector's Roll of this municipality against the respective parcels concerned and that such amounts shall be collected in the same manner as taxes under The Municipal Act. THAT the Parking Lot on the East side of Mill Street North, Newcastle Village, Ontario, be proceeded with as soon as weather condition permits. The work to be done by the private independent Contractor, Mr. Robert Stephenson, as set forth in his recent specifications dated March, 1979 and in accordance with the Director of Public Works recommendations following his meeting of ~mrch/79 on site with Mr. Robert Stephenson, which developed the new specifications. The entire project including lighting and sign posting to be supervised by the Town of Newcastle Public Works Department. The lighting to be done by Newcastle P.U.C. and sign(s) by Town of Newcastle Public Works Department. The total cost of the entire project including lighting and sign(s) to be paid for in full out of the Town of Newcastle Parking Lot Reserve Fund. Council Minutes Meeting re Canadian Order of Foresters Project Mileage Expenses CanDu Nuclear Power Stations re Evacuation Plan Ridge Pine Park Limited - 16 - April 23rd, 1979 Notice of Motion Moved by Councillor Holliday, seconded by Councillor Hobbs. BE IT RESOLVED THAT the Town of Newcastle send the Director of Planning as the Town representative to the meeting of the Canadian Order of Foresters and the Region of Durham, and the Solicitor for Goodyear, to help to resolve the difficulties associated with Senior Citizens housing in Bowmanville. WHEREAS the Province has provided for additional compensation for expenses as amended in Section 389 of the Municipal Act, Bill 80; AND WHEREAS the associated remuneration is considered to be inadequate to compensate for incidental travelling expense associated with Council, and Committee, and other meetings required by Council; THEREFORE be it resolved that Council approve the authorization of payment of expenses for automobile mileage for Council Members (by By-Law) and in conformity with present Town Policy for Mileage Expense. Council Minutes By-Law No. 79-40 - 17 - April 23rd, 1979 Resolution #C-S04-79 Moved by Councillor Holliday, seconded by Councillor Clarke. WHEREAS Pine Ridge Park Limited have resolved their expropriations by Ontario Hydro and the settlement issues between them; AND WHEREAS the previous Councils of the Town of Newcastle have supported the consent for a modification to the Regional Official Plan to accommodate this development; AND WHEREAS the time constraints regarding Ontario Municipal Board hearings are of the essence; THEREFORE BE IT RESOLVED that this Council reconfirms its approval for a retirement mobile home on as much of the lands controlled by Pine Ridge Park Limited as is surplus to Ontario Hydro's actual right-of-way requirement and again request the Region to consent to a modification to their Plan accordingly. Mayor Rickard ruled that the foregoing Resolution was out of order, but was challenged by Councillor Holliday and the Mayor's ruling was not upheld by Council. His Worship called for a~ call vote but this was challenged by Councillor Hobbs and upheld by Council. On being put to a vote Resolution #C-S04-79 was carried.
