MEETING OF JULY 26TH, 1982

RECOMMENDATION:
1. That this report be received for information.

There have been recent discussions with relation to the problems
of the present Bicycle By-law No. 80-36. On Friday, July 2nd, 1982, I met
with Don Smith, Administrator, the Clerk, David Oakes, and Sgt. John Bird
of the Durham Regional Police.
A copy of the by-law was forwarded to the solicitor for
his comments.
I am now enclosing herewith a copy of Sgt. Bird's report of
our meeting and further, a copy of Mr. Sims' letter dated July 5th, 1982.
You will note that Sgt. Bird suggests that I write to the
Chief of Police and request that the Communit Services Offi r ;n nrgorate
--some—t*Lpe- f_educational program on the bicycle by-law in his own program
when he visits the schools.
If this meets with approval of Council, I will carry out
this suggestion.
Any other suggestions with respect to this by-law would be
appreciated.

Thank you for your letter of June 29th,
1982. While the By-law does not specifically set out
who is to enforce the by-law, I am of the opinion
that it may be enforced either by members of the Durham
Regional Police Force or by the Town of Newcastle By -
Law Enforcement Officer. '
Section 55 of The Police Act provides
that members of the police force are charged with the
duty of preserving the peace, preventing robbery and
other crimes and offences including offences against
the by-laws of the Municipality .. . Section 68 of
The Police Act provides that the Council of any
Municipality may appoint one or more Municipal law
enforcement officers who shall be peace officers for
the purpose of enforcing the by-laws of the municipality.
I suggest that there be a meeting between
representatives of the Town of Newcastle and the Durham
Regional Police to discuss the enforcement of this
by-law. I am sure that you will find that the Durham
Regional Police force will be as cooperative as they
can be but in the overall scheme of their duties and
responsibilities the enforcement of this by-law will
be of very low priority. However, as you are aware,

the police conduct an educational programme to inform
school children of various safety matters and, from
time to time, run clinics on bicycles. Perhaps this
would be an appropriate method by which the young people
could be advised of the existence of the by-law and
the possibility that they might be prosecuted for its
contravention.
It might also be appropriate for the
Municipality to seek some coverage in the local media
drawing the public's attention to the existence of the
problems and the by-law.
