REPORT TO THE COUNCIL MEETING OF SEPTEMBER 23, 1985
REPORT NO.: MAYOR'S REPORT No. 19-85
SUBJECT: TOWN OF NEWCASTLE FLAG
RECOMMENDATION:
It is respectfully recommended to Council the following:
1. That Report PD -133-85 be received; and
* 2. That the attached by-law to adopt an official flag
of the Town of Newcastle be approved.
BACKGROUND AND COMMENTS:
On September 9, 1985 a meeting of the Flag Committee was convened
to consider final modifications to the Town of Newcastle Flag.
At that time a concensus of the members present was obtained,
favouring adoption of a Town Flag in the form identified on the
* attached by-law. It is the recommendation of the Flag Committee
that this flag be adopted and the appropriate municipal by-law
passed.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 85 -
being a By-law to adopt an official flag of the Town of
Newcastle.
WHEREAS after eleven (11) years of existence, a desire has been
expressed for the formal adoption and use of a flag as a physical
emblem of the Town of Newcastle; and
WHEREAS such a flag has been designed based upon the crest of the
! Town of Newcastle and incorporating the official flower of the. Town
of Newcastle being the apple blossom;
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
enacts as follows:
1. Flag Adopted
That the Town Flag be adopted as the official flag of the Town of
Newcastle, which flag shall be of the design, appearance, content
and colour as generally set forth and specified in Schedules "A"
and "B" hereto.
2. Control of the Use of the Town Flag
a) The Town Flag may be used by Members of the Town Council,
employees of the municipal corporation and residents of the
municipality, in circumstances which properly respect the
position, image and integrity of the Town as a unit of
government in this Province of. Ontario.
b) Other persons desiring to use the Town Flag shall apply to
the Municipal Clerk for permission so to do, which permission
the Municipal Clerk shall grant or refuse with or without
conditions in accordance with instructions from time to time
established by the Council of the Town of Newcastle.
3. Manufacture and Distribution of the Town Flag
The Mayor of the Corporation of the Town of Newcastle is hereby
authorized to make all appropriate arrangements by contract or
otherwise, for the manufacture, distribution and sale or other
issue of the said Town Flag on such terms as to material, size,
cost and otherwise as the Mayor shall deem appropriate.
4. Protection
!, The Town Solicitor shall forthwith apply to register and protect
the Town Flag as a "government symbol" pursuant to Section 9 of
the Trademarks Act, Canada.
5. Effective Date
This By-law shall come into force and take effect immediately
upon its final passing.
