Res. # By -Law # MEETINGGENERAL PURPOSE AND ADMINISTRATION COMMITTEE DATE: DECEMBER 7TH, 1987 REPORT #MYOR's #5-87 FILE #: SUBJECT REMARKETING POLICY FOR SUBDIVISIONS RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That this report be received; and 2. That the attached report be referred to the Director of Planning for the purpose of implementing a subdivision pre -marketing policy for the Town of Newcastle. BACKGROUND AND COMMENT: Over the past year, it has come to my attention that a common complaint by delegations to Public Planning meetings was the issue of inadequate signage around proposed subdivisions. I had occasion to speak with Mayor William McLean of Ajax about this subject and he indicated that the Town of Ajax too had experienced similar problems until it endorsed a subdivision pre -marketing policy, a copy of which is attached. I believe that there is merit in our staff reviewing same and implementing a similar policy for the Town. Apparently, this policy has been well received by not only the public, but also by the developers. submitted, Mayor 7 Cay CORPORATION OF THE TOWN OF AJAX - POLICY MANUAL ADMINISTRATION SECTION POLICY NUMBER: ADMIN S -7-A SUBJECT: SUBDIVISION PRE -MARKETING SOURCE/AUTHORITY: COUNCIL MEETING OF FEBRUARY 2, 1987 "That subject to approval by the Executive and Development Committee. for each builder, the Town of Ajax may permit the marketing of homes after the approval of a draft plan of subdivision provided that: (a) Such marketing must not commence until the Town Engineer is satisfied that: (1) there are no servicing constraints which affect the subdivision and which may unduly delay development. (2) And further that only when the developer has been notified in writing by the Town Engineer with all members of Council being copied. (b) The conditions of draft plan approval do not reveal a condition that may unduly delay development, and if such conditions exist, they have been overcome to the satisfaction of the Town Engineer. (c) The developer and each builder agree to comply with the Town's Architectural Control Policy. (d) The developer, each builder and the sales representatives for the development attend an E & D Committee meeting to present: (i) proposed display boards indicating both existing and proposed surrounding land uses; (ii) any specifics unique to the subdivision; (iii) marketing plans for the development. (e) A disclosure statement, as developed by the Urban Development Institute, or as may be developed by the Province of Ontario, is included in each Agreement of Purchase and Sale. -z - And further, in the future, following approval subdivision, and if prior to the execution of the developer, the developer advise in writing the above included in a subdivision agreement, included in a subdivision agreement.
