REPORT ON SITE PLAN AGREEMENT
L.D.C.M. INVESTMENTS
The above agreement was tabled on the second reading of
By-law 76-20 pending a report from myself.
The agreement was drafted by myself and reviewed and re-
vised by the Town Solicitor, and therefore, I believe it
meets all the Town's requirements.
The agreement provides for the use of lot levies to re-
imburse the developer for oversized and external services
previously constructed. Some of these services are now under
Regional jurisdiction.
The Town's lot levies have been used to reimburse devel-
opers for Regional services in several other subdivision and
and this proposed agreement merely re -confirms the provisions
of the agreement governing the whole subdivision. I would
expect that where the Town has applied its lot levies in pay-
ment for Regional Services, the O.M.B. will give credit for
this in the apportionment of the Town's lot levy fund. The
Town should insist that they do.
The O.M.B. decision on apportionment of lot levies is
still many months, possibly years away. In the meantime I
think the Town must continue to act in good faith to carry out
the provisions of agreements entered into by the former Town
of Bowmanville.
