RECOMMENDATIONS:
1. RECEIVE FOR INFORMATION
(a) PD-189-88 - summary of Committee of Adjustment Applications for
Meetings of June 9, June 23, July 7, August 4,
August 18 and September 1, 1988
(b) PD-181-88 - Rezoning Application - W.E. Roth Construction - part
LOt 34, Concession 2, Former Township of Darlington -
File: DEV 88-27
(c) CD-44-88 - Animal COntrol Report for the Month of August 1988
2. BUS STOP SHELTERS - INTERSECTION OF KING AND DIVISION STREETS AND
KING STREET OPPOSITE ROENIGK DRIVE, BOWMANVILLE
THAT Report WD-62-88 be received; and
THAT the bus shelter at the corner of King and Division street be removed
by TOwn Forces; and
THAT the bus shelter located at King and Division be relocated to King
Street west, opposite Roenigk Drive; and
THAT all associated costs be charged to public Works Handi Transit account;
and
THAT Mr. Garth Gilpin, secretary/Treasurer and General Manager, Bowmanville
Business Centre, P.O. BoX 365, Bowmanville, Ontario, L1C 3Ll, be advised of
council's decision.
3. EXEMPTION FROM PARr LOT CONTROL - SUBDIVISION 18T-85035 - WAVERLEY
HEIGHTS SUBDIVISION - PART LOT 13, CONCESSION 1, BOWMANVILLE
THAT Report PD-169-88 be received; and
THAT the request submitted by Mr. Michael zygocki on behalf of Waverly
Heights Subdivision for removal of part lot control on LOts 1 to 37
inclusive, plan lOM-813, be approved; and
THAT By-law 88-137 be approved and forwarded to the Regional Municipality
of Durham pursuant to Section 49, Subsection (7) of the planning Act; and
THAT Mr. Michael zygocki be so advised.

PROPOSED HERITAGE DESIGNATIONS - ONTARIO HERITAGE ACT -
FILE: PLN 19.1
THAT Report PD-183-88 be received; and
THAT the request of the Town of Newcastle LOcal Architectural Conservation
Advisory Committee to designate as Historical structures/Sites, those
properties listed on Attachment No. 1 to Report PD-183-88 be approved; and
THAT the Clerk prepare, send and publish the required notices of intent
pursuant to the provisions of the Ontario Heritage Act and report back to
Council following the prescribed notification period; and
THAT the Town of Newcastle LOcal Architectural COnservation Advisory
COmmittee be advised of Council's decision.
5.
OFFICIAL PLAN AMENDMENT, REZONING AND SITE PLAN APPLICATION -
ROMAN LANGERBERGER - PARr LOT 9, CONCESSION 2, FORMER TOWN OF
BOWMANVILLE - FILES: OPA 88-59/N AND DEV 88-58
THAT Report PD-185-88 be received; and
THAT the applications to amend the Town of Newcastle Official plan and
the Town of Newcastle Comprehensive zoning By-law 84-63, as amended,
submitted by Tunney Planning on behalf of Roman Langerberger to create a
2,420 sq.m., LOcal Central Area in Part of LOt 9, Concession 2, former Town
of Bowmanville be referred back to Staff for a subsequent report pending
Staff's receipt of a Retail Market Analysis Site Servicing Report and upon
receipt of all comments from outside agencies; and
THAT the applicant and applicant's agent be so advised.
6.
OFFICIAL PLAN AMENDMENT AND REZONING APPLICATION - BADJA HOLDINGS
INC. - PART LOTS 23/24, CONCESSION 1, FORMER TOWNSHIP OF DARLINGTON
FILES: OPA 88-47/D AND DEV 88-64
THAT Report PD-186-88 be received; and
THAT the Official plan Amendment and Rezoning applications submitted by
Joseph victor, Q.C. on behalf of Badja Holdings Inc. to permit the
construction of an industrial condominium be referred back to Staff for a
subsequent report pending Staff's receipt of the outstanding comments from
the departments/agencies; and
THAT staff schedule a community meeting with the residents of the area to
discuss the long-term plans of the entire area; and
THAT the applicant and the applicant's agent be so advised.

EXEMPTION FROM PART LOT CONTROL - SUBDIVISION 18T-85013 - ABEK REAL
ESTATE CORPORATION (ORCHARD PARK ESTATE SUBDIVISION) - PARr LOT 27,
CONCESSION 2, BOWMANVILLE
THAT Report PD-187-88 be received; and
THAT the request submitted by Mr. P. Kumar on behalf of Orchard Park
Estates Subdivision for removal of part lot control on LOts I to 17
inclusive, Plan 10M-812, be approved; and
THAT By-law 88-138 be approved and forwarded to the Regional Municipality
of Durham pursuant to Section 49, Subsection (7) of the Planning Act; and
THAT Mr. P. Kumar be so advised.
8.
REZONING AND SITE PLAN APPLICATION ARNOLD KERRY - PART LOT 34,
CONCESSION 6, FORMER TOWNSHIP OF CLARKE - FILE: DEV 88-52
THAT Report PD-188-88 be received; and
THAT the rezoning and site plan application submitted by Doug Coggan,
Ontario Land Surveyor on behalf of Arnold Kerry to rezone a one (1)
hectare parcel to permit the construction of a farm implement dealership,
be approved and the necessary by-law forwarded to Council at such time as
a Site plan Agreement has been executed; and
THAT the applicant and applicant's agent be so advised.
9. REZONING AND SITE PLAN APPLICATION - DON & SON BUILDING SUPPLY &
LUNARO CONSTRUCTION LIMITED - PART LOT 19, CONCESSION 2, FORMER
TOWNSHIP OF DARLINGTON - FILE: DEV 88-62
THAT Report PD-191-88 be received; and
THAT the rezoning and site plan application DEV 88-62 submitted by Don &
Son Building Supply Limited and Lunaro COnstruction Limited be denied
without prejudice until after the Development plan has been prepared and
approved for Maple Grove; and
THAT the applicant be advised of COuncil's decision.
10. REZONING APPLICATION - MACOURrICE DEVELOPMENT INCORPORATED -
PARr LOT 28, CONCESSION 2, FORMER TOWNSHIP OF DARLINGTON -
FILE: DEV 88-65
THAT Report PD-192-88 be received; and
THAT the rezoning application submitted by Kevin Tunney of Tunney
Planning on behalf of Macourtice Developments Incorporated, to rezone
a 15.358 ha parcel in order to permit the development of 144 single
family dwellings in a Plan of SUbdivision, be denied as it is premature
because there are outstanding matters still to be resolved by the
applicant; and
THAT the applicant's agent be so advised.

11.
POLICY REGARDING REZONING AND OFFICIAL PLAN AMENDMENT APPLICATIONS
THAT the Planning Director review the present policy and procedures
with respect to Rezoning and Official Plan Amendment Applications,
for the purpose of streamlining the process whereby applications before
the Town must be supported by all necessary documentation.
12. SERVICING REQUIREMENTS - BASELINE ROAD
13.
THAT staff undertake a review of the servicing requirements along
Baseline Road; and
THAT a copy of this resolution be forwarded to the Hydro Liaison
Committee.
PROPERTY CLEAN UP/MASON, PART LOT 28, CONCESSION 6, DARLINGTON
THAT Report TR-71-88 be received; and
THAT an Order be served personally on the individual involved; and
THAT the Treasurer and By-law Enforcement Officer report back to the
General purpose and Administration Committee on further action required.
14. LEASE AGREEMENT - 247 KING STREET EAST, NEWCASTLE, ONTARIO
THAT Report TR-73-88 be received; and
THAT By-law 88-139 be passed, authorizing the Mayor and the Clerk to sign a
rental agreement with Claude Miller; and
THAT Claude Miller be advised of Council's actions.
15.
TENDER NO. T88-21, UNDERGROUND FUEL STORAGE TANKS
THAT Report TR-72-88 be received; and
THAT S. DeMelis Construction and General Contractors Ltd., Maple, Ontario,
with a total bid of $20,269.16, being the lowest responsible bidder,
meeting all terms, conditions and specifications of Tender No. T88-21, be
awarded the contract to supply, deliver and install one (1) only 2000
gallon and one (I) only 1000 gallon underground Fuel Storage Tanks,
associated piping, pump island and two (2) pumps as required by the
Department of Public Works; and
THAT the required funds be drawn from the 1988 Public Works Equipment
Reserve.
16. ASSESSMENT OFFICER
THAT the Treasurer contact other municipalities that employ or use the
services of an assessment officer to obtain information on the position and
the experience that the individuals possess; and
THAT a report be forwarded to the General Purpose and Administration
COmmittee at the meeting scheduled to be held on October 3, 1988.

18.
MONTHLY FIRE REPORT - JULY 1988
THAT Report FD-20-88 be received for information; and
THAT, in future, individual department inquiries be extracted from the
monthly Fire Report to more clearly reflect the activity of the Fire
Prevention Officer.
19. TYRONE COMMUNITY CENTRE - REQUEST FOR FINANCING
THAT Report CS-23-88 be received; and
THAT the request of the Tyrone community Centre Board be approved; and
THAT the Treasurer be authorized to pay the invoice to Byam Plumbing and
Heating Inc.; and
THAT the necessary funds be drawn from the Contingency Account
7007-00000- 0298; and
THAT the Tyrone Community Centre Board be advised of Council's decision;
and
THAT the Treasurer report on the financial status and holdings of the
Tyrone Community Centre Board.
