REZONING APPLICATION - WILLIAM & KATHERINE ROWLAND That Report PD-90-86 be received; and That the application submitted by William & Katherine Rowland, to rezone a 3.8 hectare parcel in Part Lot 31, Concession 1, former Township of Clarke, to permit a Rural Cluster be referred to staff for processing and a subsequent report and public hearing. 3. REZONING APPLICATION - GEORGE ELLIOTT That Report PD-91-86 be received; and That the application submitted by George Elliott, to rezone a 4.19 hectare parcel in Part Lot 4, Concession 2, former Township of Clarke to permit the creation of 3 additional residential building lots be referred to staff for processing and a subsequent report and public hearing. OBJECTION TO BY-LAW 86-29, PART LOT 34, CONC. 3, DARLINGTON (SCHLEISS AND HOLLAND) That Report PD-92-86 be received; and That the following resolution be adopted by Council and forwarded to the Ontario Municipal Board together with a copy of By-law 86-29: WHEREAS the Council of the Town of Newcastle has approved By-law 86-29, to amend By-law 84-63, as amended, being the Town's Comprehensive Zoning By-law as a result of their consideration of an application for such an amendment submitted by the property owner; AND WHEREAS the effective By-law 86-29 was to change the zone designation of the land subject to By-law 86-29 from "Environmental Protection (EP)" to "Urban Residential Type One Density (Rl)" zone to permit the development of ten (lO) residential lots for single family dwellings; AND WHEREAS By-law 86-29, has been approved in conformity with the applicable policies of the Durham Regional Official Plan and the Courtice Urban Area Official Plan; . AND BE IT NOW THEREFORE RESOLVED THAT the Town of Newcastle hereby requests the Ontario Municipal Board to convene any required hearings in respect of By-law 86-29 at the earliest possible opportunity; and Furthermore hereby authorizes Town staff and/or the Town Solicitor to represent the municipality at any hearing that may be convened. 5. REZONING APPLICATION - PAUL LANGLEY That Report PD-93-86 be received; and That the application submitted by Mr. Paul Langley, to rezone a parcel of land located in Part of Lot 17, Concession 10, former Township of Darlington, to permit the construction of a single family dwelling be approved, and the by-law attached hereto be forwarded to Council for approval. (By-law 86-51). . G. P .A. REPORT - 3 - APRIL 28TH, 1986 6. REZONING APPLICATION - LLOYD A~GAR . That Report PD-94-86 be received; and That the application, submitted by Mr. Lloyd Algar, to rezone a parcel of land located in Part ~ot 34, Concession 4, former Township of Darlington, to permit the development of a sales outlet for nursery stock grown on the farm be approved, and the by-law attached hereto be forwarded to Council for approval at such time that the applicant ~as satisfied the requirements of the Town of Newcastle Works Department with respect to the required road widening. 1. PROPOSED AMENDMENT CITY OF OSHAWAZONING BY-LAW That Report PD-95-86 be received; and That the City of Oshawa be advised that the Town of Newcastle has no objection to the proposed amendment to the City of Oshawa Zoning By-law 3415, with respect to that area known as the Beaton Farm Property. 8. REZONING APPLICATION - 434361 ONTARIO LTD. That Report PD-96-86 be received, and referred back to staff for further review and dialogue with the applicant. . 9. REZONlNG APPLICATION -FLOYDNICHO~SON CONSTRUCTION LTD. That Report PD-91-86 be received; and That the application submitted by Floyd NiCholson Construction Limited, to rezone a 1.104 hectare parcel of land in Part Lot 28, Concession 5, former Township of Clarke (Orono), to permit the creation of a total of three (3) residential lots on private wells, be referred to staff for processing and a subsequent report and public hearing. 10. REZONING APPLICATION - ABRAHAM SOL That Report PD-98-86 be received; and That the application submitted by Mr. Abraham Sol, to rezone a parcel of land located in Part Lot 21, Concession 2, former Township of Darlington, to permit the development of a Node/Cluster be received and referred to staff for processing and a subsequent report and public hearing. . . G.P.A. REPORT - 4 - APRIL 28TH, 1986 11. RURAL RESIDENTIAL NODES AND CLUSTERS . That Report PD-99-86 be received; and That the Regional Municipality of Durham be advised that the Town of Newcastle recommends adoption of an amendment to the Durham Regional Official Plan in respect of Nodes and Clusters which incorporates the revisions suggested by staff Report PD-99-86; and That a copy of staff Report PD-99-86 be forwarded to the Regional Municipality of Durham for their consideration. 12. REZONING APPLICATION - LEONORA NICHOLLS That Report PD-IOO-86 be received; and That the application submitted by Ms. Leonora Nicholls to rezone a parcel of land located in Part Lot 25, Concession 1, former Township of Darlington, to permit the development of a group home be approved, and the by-law attached hereto be forwarded to Council for approval. (By-law 86-52). 13. DARLINGTON AUTO SALES RE SIGN BY-LAW . That Report PD-I04-86 be tabled because this item is before the Courts. 14. L.A.C.A.C. DESIGNATION: ORONO TOWN HALL, III QUEEN ST. BOWMANVILLE, 9-11 DUKE ST. BOWMANVILLE, JOHN STALKER HOUSE CLARKE That report PD-I05-86 be received; and That the request of the Town of Newcastle Local Architectural Conservation Advisory Committee to designate as historical sites the Orono Town Hall, the residences at III Queen Street, Bowmanville and 9 - 11 Duke Street, Bowmanville, and the residence known as the John Stalker House in Part Lot 30, Concession 6, former Township of Clarke be approved; and That the Clerk prepare, send and publish the required notices of intent pursuant to Section 29 of the Heritage Act and to report back to Council following the prescribed notification period. 15. TENDERING OF CONTRACTS DURING AUGUST BREAK That Administrator's Report Admin 28-86 be received; . That the Mayor and Clerk be authorized to accept the lowest tender meeting all terms and conditions and specifications of the Tender for tenders opened during the August Break; G.P.A. REPORT - 5 - APRIL 28TH, 1986 . That the Mayor and Clerk's authorization be subject to a memo of acceptance from the Treasurer and, where appropriate, affected department heads; and That an information report be presented at the first regularly scheduled Council meeting in September summarizing the tenders that have been awarded. 16. BOWMANVILLE CREEK FISH SPAWNING PROBLEM That Administrator's Report Admin 29-86 be received for information; That the Ministry of Natural Resources be formally advised that the Town's actions with respect to problems experienced with the fish spawning at Bowmanville Creek should be regarded as an interim measure and that the Town formally requests the Ministry of Natural Resources whose mandate it is to manage the fisheries resources of the Province to examine the problem in conjunction with their master plan efforts and advise Council of their plans to resolve the problem prior to December of 1986; . That appropriate staff be directed to attend the public meetings in the general area sponsored by the Ministry of Natural Resources concerning the master plan to reinforce the position of the Town of Newcastle with respect to this problem. 11. RISK MANAGEMENT COMMITTEE That Administrator's Report Admin 31-86 be received; That the Department Heads be established as the Risk Management Committee for the Town of Newcastle; That the Risk Management Committee report to Council semi- annually on matters that should be addressed with respect to minimizing the Town's liability situations - Once in June prior to the renewal of insurance, and a second report as background for the budget discussions; That the Newcastle Community Services Planning Board be requested to host a seminar on Insurance and Risk Management for all hall boards and community groups that have a stewardship with town properties and that our insurance carriers be requested to provide technical back-up for such a seminar. That the Risk Management Committee investigate and report on the HELP Program, introduced at the 1986 Good Roads Conference. . G.P.A. REPORT - 6 - APRIL 28TH, 1986 18. CASH ACTIVITY REPORT FOR MARCH 1986 . That Report TR-23-86 be received; and That,in accordance with provision of Chapter 302, Section 81(1) of the Municipal Act, R.S.O. 1980, the Treasurer reports to Committee that the cash position of the Town of Newcastle for the month ended March is as shown on the attached schedule; and That the expenditures for the month of March 1986 be confirmed. 19. TENDER T86-4 - EMULSIFIED PATCHING MATERIAL (COLD MIX) That Report TR-24-86 be received; and That Bennett Paving & Materials Ltd., Oshawa, Ontario"with a total bid in the amount of $81,100.00, being the lowest responsible bidder, meeting all terms, conditions and specifications of Tender T86-4, be awarded the contract to supply Emulsified Asphalt Patching Material on an "as required" basis to the Town of Newcastle; and That the funds expended be provided from the approved 1986 Public Works Roads Material Maintenance Budget. 20. TENDER T86-5 - CORRUGATED STEEL CULVERT . That Report TR-25-86 be received; and That Corrugated Pipe Company Ltd., Stratford, Ontario, with a total bid of $28,814.34, being the lowest responsible bidder, meeting all terms, conditions and specifications of Tender T86-5, be awarded the contract for the supply and delivery of Corrugated Steel Pipe Culvert as required for 1986 by the Department of Public Works; and That the funds be drawn from the approved 1986 Culvert Maintenance Construction Budget. 21. SELF INSURED LOSSES That Report TR-26-86 be received; and That the General Purpose and Administration Committee recommend to Council the replacement of the spring riding horse which disappeared from the playgrounds at Burketon Park. The replacement cost as quoted from Henderson Recreation Equipment, Norwich, Ontario, is approximately $308.00, and should be funded from this Self-Insured Losses Reserve. . G.P.A. REPORT - 1 - APRIL 28TH, 1986 STATUS OF EMPLOYEE/EMPLOYER RELATIONSHIP VOLUNTEER FIRE DEPARTMENT ANSWERING SERVICE . 22. That Report TR-27-86 be received; and That Report FD-1-86 be approved. 23. TENDER T86-3 - RECONSTRUCTION BASELINE ROAD-SPRY TO WAVERLY That Report TR-28-86 be received; and That Bennett Paving & Materials Ltd., Oshawa, Ontario, with a bid in the amount of $145,881.60 being the lowest responsible bidder, meeting all terms, conditions and specifications of Tender T86-3, be awarded the contract for the reconstruction of Baseline Road from Spry Avenue to Waverly Road, Bowmanville; and That the funds be drawn from the approved 1986 Public Works Capital Budget. 24. REVIEW OF TOWN'S INVESTMENT POLICY . That Report TR-29-86 be received; and That Council adopt the policy in Report TR-12-85, and rescind the policy adopted in Resolution #GPA-I023-84. That Recommendation #2 and #3 be discussed. 25. ENERGY AUDITOR'S SECOND QUARTERLY REPORT That Report CS-23-86 be received for information. That Report CS-23-86 be referred to the Treasurer and Director of Community Services for consideration in property preventative maintenance. 26. BOWMANVILLE MINOR HOCKEY ASSOCIATION HOUSE LEAGUE That Report CS-24-86 be received; and That Council Resolution #C-544-84 (agreement with the B.M.H.A. to assume Recreational Hockey) be repealed; and That staff be authorized to draft a new agreement for the assumption of Recreational Hockey by the current House League Committee in consultation with the B.M.H.A. Toros, the House League Committee and the N.C.S.P.B.; and That said draft be submitted to the General Purpose and Administration Committee for review within one month. . G.P.A. REPORT - 8 - APRIL 28TH, 1986 . 21. ALL ONTARIO MIDGET HOCKEY TEAM, NEWCASTLE That a letter of congratulations be sent from the Mayor and Members of Council to the Newcastle Midget Hockey Team, for presentation at the reception to be held on April 23, 1986. That on behalf of the Town, each member of the team be presented with a plaque. 28. POLICY OF ACHIEVEMENT That the Director of Community Services establish a policy of achievement. 29. ACCEPTANCE OF SOUTH SERVICE ROAD AT COURT AND SOUTH SERVICE ROAD AND WAVERLY That Report WD-34-86 be received; and That the Town of Newcastle accept back into its road system that portion of the south service road from Courtice Road, south easterly to Station 43+20, and that portion of South Service Road from the controlled access ramp at Waverley Road westerly to Station 13+50; and . That the Ministry of Transportation and Communications retain responsibility for all existing street lighting, illumination and traffic warning lights; and That the Ministry of Transportation and Communications District Engineer, Port Hope District, be so advised. 30. TRAFFIC CONTROL AT THE INTERSECTION OF HIGHWAY 35/115 AT KIRBY ROAD That Report WD-35-86 be received for information; and That a copy of this report be forwarded to the Region of Durham for their consideration in addressing the concerns of roadside parking and speeding on Regional Road 9. 31. 68 HIGH STREET, BOWMANVILLE (EDDIE COOK) That Report WD-31-86 be received; and That the Public Works Department give consideration to an application of surface treatment on High Street from Concession Street to the C.P.R.; and . That Eddie Cook be forwarded a copy of this report and invited to attend the Public Works Department during Public Works Week. G.P.A. REPORT 32. UNFINISHED BUSINESS - 9 - APRIL 28TH, 1986 . That the delegation of Roy Forrester, Orono; the delegation from the Durham Regional Police Force be acknowledged, and thanked for their presentation. 33. PLANNING AND DEVELOPMENT DEPARTMENT STAFFING That Report PD-I03-86 be received; and That the Director of Planning and Development be authorized to initiate the hiring procedure for a Deputy Director of Planning and Development in accordance with the intent of Schedule "D" to the Confidential Administrator's Report Admin 26-86; and That the Director of Planning and Development be authorized to hire a third inspector for the Building Division of the Planning and Development Department; and That Council re-assign the responsibility for enforcement and policing of the Town of Newcastle Sign By-law, Pool/Fence By-law and Property Standards By-law to the By-law Enforcement Officer and appropriate direction be provided to staff. 34. FIRE DEPARTMENT STAFFING . That Report FD-11-86 be received. That Report FD-11-86 be referred back to staff for further review and subsequent report. 35. OSHAWA & DISTRICT LABOUR COUNCIL That the communication dated April 14, 1986, from T. K. Simmons, Secretary-Treasurer, Oshawa and District Labour Council, P. O. Box 946, 115 Albert Street, Oshawa, LIH lNl, proposing to mark April 28th as a "Day of Mourni ng" for workers kill ed on the job be received; And that Mr. T. K. Simmons be advised that Council supports their intention to mark April 28th for the coming years as a "Day of Mourning" for workers killed on the job. .
