SUBJECT: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF OCTOBER 21, 1985. RECOMMENDATIONS: 1. RECEIVE FOR INFORMATION (a) REPORT PD-142-85 - Minutes of the Committee of Adjustment Meeting, of September 4, 1985. REPORT PD-145-85 - Monthly Building Report for September REPORT PD-147-85 - Summary of land Division Applications for the month of September, 1985. PROPOSED PLAN OF SUBDIVISION - lOT 15, CONC. 3, DARLINGTON 542985 ONTARIO lIMITED That Report PD-141-85 be received; and That the Region of Durham be advised that the Town of Newcastle recommends approval of Plan of Subdivision 18T-85020 dated July 5, 1985, as revised in red, subject to the conditions contained in Attachment No.1 to Report PD-141-85; and That application for rezoning in respect of Part of lot 15 Concession 3, former Township of Darlington be approved and that By-law 122-85 to amend By-law 84-63 be approved by Council; and That By-law 123-85 autho~izing execution of a Subdivision Agreement between 542985 Ontario Limited and the Corporation of the Town of Newcastle be approved; and That the Mayor and Clerk be authorized to execute the Subdivision Agreement between 542985 Ontario limited and the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning; and That a copy of Staff Report PD-141-85 be forwarded to the Region of Durham. . . . REZONING - LINCHRIS HOMES, PART LOT 35, CONC. 2, DARLINGTON That Report PD-143-85 be received; and That an application, submitted by linchris Homes limited, to rezone a parcel of land in Part of lot 35, Concession 2, being Block 85 on Plan 764 to permit the development of a commercial plaza, be approved; and That By-law 124-85 be approved by Council. 4. REZONING - GEORGE HAEMMERLE, PART LOT 28, B.F.C., DARLINGTON That Report PD-146-85 be received for information; and That any submissions received during the required public meeting be referred to Staff for review and comment. 5. TEMPORARY USE OF KENNEL, SOL AND JOAN FAlCHUK, PART LOT 20, CONC. 10, PART 1 ON PLAN 10R-549, DARLINGTON That Report PD-148-85 be received; and That Staff's actions in requesting a modification to the Town's Official Plan be endorsed; and That the application submitted by Sol and Joan Fa1chuk to allow a temporary use of land for a kennel on a 2.03 hectare (5.04 acre) parcel of land in Part of lot 20, Concession 10, Part 1 on Plan 10R-549, former Township of Darlington, be received and referred to Staff for processing and a subsequent repor't and pub1 ic hearing. 6. REZONING - WALTER REBOT, PART LOT 31 CONC. 5, DARLINGTON That Report PD-149-85 be received; and That application for rezoning in respect of Part of lot 31, Concession 5, former Township of Darlington to permit the establishment of a Farm Implement Dealership be approved and that By-law 125-85 to amend By-law 84-63 be approved. 7. REZONING - JEAN MARC BEAULIEU, PART lOT 15 CONC. 3, DARLI NGTON That Report PD-150-85 be received; and That application for rezoning in respect of Part Lot 15 Concession 3 former Township of Darlington, submitted by Mr. Jean Marc Beaulieu to permit the development of an additional residential lot be approved; and That By-law 126-85 to amend By-law 84-63 be approved; and That upon receipt of the land Division application for severance, Staff request the land Division Committee to include as a condition of consent the architectural and floor area provisiOn as required in Plan M-755. . . . PROPOSED REDLINE REVISION TO DRAFT APPROVED PLAN OF SUBDIVISION 18T-19720 FOSTER CREEK DEVELOPMENTS That Report PD-151-85 be received; and That the proposed revision to draft approved Plan of Subdivision 18T-19720, be approved and the Regional Municipality of Durham and the Ministry of Housing be so advised; and That Staff prepare any necessary amendments to the Subdivision Agreement in respect of Plan 18T-19720 to give effect to the proposed revisions; and That the Mayor and Clerk be authorized to execute on behalf of the Town, said amendment pursuant to By-law 85-26, being a by-law to authorize execution of an agreement between Foster Creek Developments and the Town of Newcastle. 9. SITE PLAN AGREEMENT, PSORAS & TSICHLAS That Report PD-153-85 be received; and That the request of Macaulay, lipson, Joseph and O'Donoghue, Barristers & Solicitors, submitted on behalf of 605284 Ontario limited for a release from a Development Agreement registered on March 9, 1984 as Instrument No. 116222 be approved; and That the law firm of Macaulay, lipson, Joseph and O'Donoghue be requested to prepare and submit to the Town for execution, the necessary release documents. 10. OFFICIAL PLAN AMENDMENTS, TOWN OF NEWCASTLE That Report PD-152-85 be received; and That Recommendation #2 of Report PD-152-85 be tabled pending further dialogue with the Region of Durham Planning Department, Town of Newcastle Planning Department and the General Purpose and Administration Committee. That Regional Planning Committee be requested to consider a further modification to the proposed Amendment No. 22 to the Darlington Official Plan to add thereto a new Section 2.1.3 as follows: "Council may, by by-law passed pursuant to Section 34 of the Planning Act, 1983, authorize the temporary use of land, building or structures for any purpose otherwise prohibited by this Plan or by by-law, provided that Council is satisfied that such temporary use is compatible with the surrounding uses and is not located on highly productive agricultural lands. A by-law authorizing a temporary use shall define the area to which it applies and specify the time period for which the authorization shall be in effect. Said time period not to exceed three (3) years from the date of passing of such a by-law." 11. O.M.B. HEARING, COMMITTEE OF ADJUSTMENT, VICTOR AND ANN WHITE That Report PD-155-85 be received; and That Staff be directed to attend the Ontario Municipal Board Hearing with respect to Committee of Adjustment Application A 35/85 on November 4, 1985. That Administrator's Report ADMIN. 65-85 be received; and That the necessary by-law be passed authorizing the Mayor and Clerk to sign a rental agreement with Orono Showcase Co-operative; and That the Orono Showcase Co-operative be advised of Council's actions. 13. EXMlINATION OF MUSEUM SERVICES, N.C.S.P.B. REPORT OF JULY 22,1985 That Report TR-65-85 be received and referred to both Museum Boards for perusal and comments to Council. 14. TENDER NO. T85-18 TREE MAINTENANCE PROGRAM That Report TR-67-85 be received; and That Cross Bros. Tree Service, Whitby, Ontario, with a bid of $17,610.00 being the lowest responsible bidder meeting all terms, conditions, and specifications of Tender T85-18 be awarded the contract for Tree Maintenance as required by the Department of Public Works; and That the funds be drawn from the 1985 approved Public Works Road Maintenance Budget. 15. FIRE DEPT. TRAINING COURSE . That Report FD-23-85 be received for information; and That a letter of congratulations be sent from the Mayor's office on behalf of Council to those names listed in Report FD-23-85. 16. PROPOSED CLOSURE AND CONVEYANCE OF PARTS OF REHDER AND EDSALL AVE., BOWMANVILLE. That Report WD-71-85 be tabled pending receipt of an opinion from the Town's Solicitor for Council. 17. DELEGATIONS That the delegations of Walter Rebot, Frank Winters, John Beaulieu and A1 Strike be acknowledged and they be advised of Council's actions. That the petition of Mr.H. E. Mi11son be referred to Staff for review and report prior to the 1986 Budget and that Mr. Mi11son be advised of Council's actions. 18. PARKING BY-LAW That consideration be given to repealing the 3 hour Parking by-law; and . That a more comprehensive and appropriate by-law be enacted.
