REPORT # 1 CORPORATION OF THE TOWN OF NEWCASTLE OFFICE OF THE TOWN CLERK 40 TEMPERANCE STREET BOWMANVILLE, ONTARIO L1C JA6 TELEPHONE 623-3379 REPORT TO TKE COUNCIL MEETING OF APRIl 22 1985 SUBJECT: GENERAL PURPOSE AND ADMINISTRATTON COMMITTEE MEETING OF APRIL 15 1985 RECOMMENDATIONS: 1. Amendment to By-law 84-63 (Interior Side Yards) THAT the bY-law amendment attached to PD-48-85, amending by-law 84-63, be approved. (See by-law 85-43) 2. Amendment to by-law 84-63 (Bed and Breakfast Establishments) THAT the by-law amendment, attached to Report PD-49-85, amending Zoning By-law 84-63, as amended, to permit "Bed and Breakfast Estab li shments" and "Vacation Farm Establ i shments" withi n the Agricultural (a) and Agricultural Exception (A-l) Zones, be approved. (See By-law 85-44) 3. Proposed Plan of Subdivision 18T-84045 (Frab) THAT the Region of Durham be advised that the Town of Newcastle has no objections to the approval of Plan l8T-84045, subject to the conditions contained in Attachment No. 1 to Report PD-54-85; THAT a copy of Staff Report PD-54-85 be forwarded to the Region of Durham; and THAT the by-law attached to Report PD-54-85, authorizing execution of a Subdivision Agreement between Frab Investments Limited and the Town of Newcastle be approved; and (See By-law 85-45) THAT the Mayor and Clerk be authorized to execute the Subdivision Agreement between Frab Investments Limited and the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. 4. Comprehensive Zoning By-law 84-36 THAT the following resolution be adopted; "WHEREAS Council deems it advisable to re-enact By-laws 84-150,84-151,84-152,84-153,84-154,84-155,84-157, and 84-158, and to modify By-laws 84-151 and 84-155; AND WHEREAS Section 34(16) of the Planning Act permits Council to dispense with any further notice in respect of said By-laws; , ~". q' i~ "..\ " c" 'Jot,' C' REPORT # 1 G.P.A. - 2 - April 15, 1985 . 4. Continued The Council of the Town of Newcastle hereby resolves that further prior notice of passing is not required"; and THAT the attached by-laws forming Attachments 1 to 8 inclusive, be approved. (See by-laws 85-46 through 85-53) 5. Subdivision Agreement - United Counties THAT the amendment, attached to Report PD-56~85, to United Counties Holdings Limited, Veltri and Son Limited, and Lesron Enterprises Limited and Susan Ann Swartz and the Corporation of the Town of Newcastle be approved; and THAT the by-law attached to Report PD-56-85, authorizing execution of an amending agreement between United Counties Holdings Limited, Veltri and Son Limited and Lesron Enterprises Umited and the Corporati on of the Town of Newcastl e, be approved: ( See by-law 85-54). THAT the subject amending agreement be executed upon submission of the appropriate fire protection charges pertaining to Phases One (1) and Two (rr) as shown on Plan M-753. . 6. Official Plan Amendment 542985 Ontario Limited THAT the Region of Durham be advised that the Town of Newcastle has no objection to the redesignation of the lands subject to Official Plan Amendment Application 85-4/D for a maximum of fourteen (14) Estate Residential Lots. 7. Rezoning - G. Gray Part Lot 6, Conc. 2 Clarke THAT the Rezoning Application submitted by Mr. G. Gray to permit the parking of two commercial motor vehicles on his lot in Part of Lot 6, Concession 2, be approved, andthe by-law amending Comprehensive Zoning By-law be approved. (See by-law 85-55) 8. Receive for Information (a) PD-59-85, Summary of Land Division Committee Applications for March 1985. (b) PD-62-85, Summary of Committee of Adjustment Applications for March 27 1985 (c) PD-65-85, Monthly Building Report for March 1985 (d) CD-16-85, Parking Enforcement Report for March 1985 (e) FD-9-85 , Monthly Fire Report for March 1985 . Rezoning - 464367 Ontari.o Limited THAT an application submitted by 464367 Ontario Limited to rezone a parcel of land in Part of Lot 15, Concession 2, former Township of Darlington to permit an Estate REsidential Development be received and referred to staff for processing and subsequent report and public hearing. 10. Plan of Subdivision 464367 Ontario Limited THAT the Region of Durham be so advised that the Town of Newcastle recommends approval of Plan l8T-85002 dated January 22, 1985, as revised in red and attached hereto and furthermore, subject to the conditions contained in Attachment No.1 to this report; and THAT a copy of Staff Report PD-6l-85 be forwarded to the Region of Durham; and . THAT the attached by-law authorizing execution of a Subdivision Agreement between 464367 Ontario Limited and the Corporation of the Town of Newcastle be approved; and (See by-law 85-56). THAT the Mayor and Clerk be authorized to execute the Subdivision Agreement between 464367 Ontario Limited and the Town of Newcastle at such time as an agreement has been finalized to the satisfaction of the Director of Public Works and the Director of Planning. 11. Proposed Official Pl an Amendment -Sped al Pol i cy Areas for Floodplain Management THAT the Region of Durham be advised that the Town of Newcastle has no objection to the proposed amendment to the Durham Regional Official Plan to incorporate a policy with respect to the designation of "Special Policy Areas" or "Flood Damage Centres" in flood susceptible areas. 12. Rezoning - P. Pisani, Part Lots 31,32, Conc. 7 Clarke THAT an application submitted by Mr. P. Pisani to rezone a 1.17 ha parcel of land in Part of Lots 31 and 32, Concession 7, former Township of Clarke to permit the construction of a single family dwelling be received and referred to staff for processing and subsequent report and public hearing. . Repairs to Electrical System - Animal Control Facility THAT the electrical repairs to the Animal Control Facility in the amount of $1,595.00 be authorized; and THAT the quotation from George Moore Electric Limited in the amount of $1,595.00 be accepted; and THAT the expenditure be charged to the following accounts: Animal Control Account #7l05-0l72-x-2 $500.00 Contingency Account #7007-298-x-9 $1095.00. 14. Permission to OcCUpy Mobile Home - Gravlev THAT Report CD-15-85 be received: and THAT the application be approved; and THAT the Mayor and Clerk be authorized to execute the Standard Agreement permitting the use for a period not exceeding six months; and THAT Mr. Jan Gravlev, 424 Soudan Avenue, Toronto Ontario M4S lW9 be advised of Council's decision. . 15. Self-Insured Losses Reserve THAT Council break-in at be replaced approve that items lost in March 25th, 1985 the Darlington Sports Centre, totalling $797.31, from funds held in the Self-Insured Losses Reserve. 16. 1985 Five Year Capital Budget THAT the 1985 Five Year Capital Budget be approved as presented. 17. Tender T85-3 - Two Front Mount Riding Mowers THAT Turf Care, Markham Ontario, with a total bid of $24,845.40, being the lowest responsible bidder, meeting all terms, conditions and specifications of Tender T85-3, be awarded the contract to supply and deliver two only Front Mount Riding Mowers (Diesel- Water cooled), 1 only 62" Floating Cutting Unit to the Town of Newcastle as required by the Department of Community Services; and THAT the funds be drawn from the 1985 approved Community Services Capital Budget. . Calcium Chloride Requirements - 1985 THAT Miller Paving Ltd., Unionville, Ontario, with a unit price of .1217 per litre and $198.34 per tonne for 35 percent liquid calcium chloride solution and bulk calcium chloride respectively being the lowest responsible bidder meeting all terms and specifications of the Region of Durham Co-Op Tender No. WD6-85 be awarded the contract to supply and apply calcium chloride, as required by the Town of Newcastle Public Works Department; and THAT Canada Transport Limited, Belleville, Ontario, with a unit price of $278.59/tonne for bulk calcium chloride being the lowest responsible bidder, meeting all terms and specifications of the Region of Durham Co;Op Tender No. WD-6-85 be awarded the portion of the contract to supply and deliver approximately 5,000 tonnes to the Hampton and Orono Yards, as required by the Town of Newcastle Public Works DepartmeRt; THAT the funds expended be drawn from the 1985 budget allocation for Public Works Road Maintenance. 19. Tender T85-4 - Emulsified Patchin gMaterial . THAT Bennett Paving & Materials Ltd., Oshawa, Ontario, with a total bid in the amount of $71,600.00 being the lowest responsible bidder meeting all terms, conditions and specifications of Tender T85-4 be awarded the contract to supply Emulsified Asphalt Patching Material on an "as required" basis to theTown of Newcastle; and THAT the funds expended be provided from the approved 1985 Public Works Roads Material maintenance budget. 20. Tender T85-5 - Corrugated Steel Pipe THAT Holt Culvert & Metal Products Ltd. Peterborough, Ontario with a total bid in the amount of $25,716.92, being the lowest responsible bidder, meeting all terms, conditions and specifications of Tender T85-5, be awarded the contract for the supply and delivery of Corrugated Steel Pipe Culvert as required for 1985 by the Department of Public Works; and THAT the funds be drawn from the approved 1985 Culvert Maintenance Construction Budget. . March Break Bonanza THAT Report CS-08-85, March Break Bonanza, be received for information and the students, Debbie Thompson and Bob Hickey, be presented with pins from the Town and a letter of thanks. 22. Industri a 1 Tour THAT the Council of the Town of Newcastle have an Industrial Tour on Monday, April 29th, 1985. 23. Audit Corrunittee THAT a meeting of the Audit Committee be held as soon as possible. 24. Claim - Mr. Gordon Mills, Division St. Orono . THAT Report WD-27-85 be recei.ved for information in conjunction with the delegation of Mr. Gordon Mills pertaining to a claim for loss of wages due to restricted access during the construction of Division Street in Orono.
