REPORT TO THE COUNCIL MEETING OF MAY 14 1984
SUBJECT: MEETING OF THE GENERAL PURPOSE AND ADMINISTRATION
COMMITTEE HELD ON MAY 7 1984
RECOMMENDATIONS:
1.
Rezoning - Part Lot 34, Cone. 2 Darlington (Moase)
THAT the by-law attached to Report PD-87-84, being a by-law
to amend Zoning By-law 2111, as amended, in respect of Part
of Lot 34, Concession 2, former Township of Darlington, be
approved. (See By-l aw 84-62)
2. Extension of Draft Plan Approval
Courtice Heights Development 18T-76048 and l8T-76027
THAT Council adopt the following resolution:
"THAT the correspondence from the Ontario Municipal
Board, dated April 11, 1984, be received and the
Ontario Municipal Board be advised that the Corporation
of the Town of Newcastle has no objections to the
extensions to draft plan approval of Plans l8T-76048
and 18T-76027 to June 12, 1985": and
THAT the request above be forwarded to the Ontario
Municipal Board and that Courtice Heights Developments
Ltd., be so advised.
3.
Plan of Subdivision 18T-81034 - Gatehouse Holdings
THAT the Region of Durham be advised that the Town of Newcastle
has no objections to the approval of revised Plan of Subdivision
18T-8l034, dated February 10, 1984, subject to the inclusion of
a "daylight triangle" and 9.3 metre reserve (Blocks 207 and 208
respectively) as noted on the previOUSly draft approved plan.

Monthly Building Report - March 1984
THAT Item 28 of the Monthly Building Report for March 1984
be referred for a written report from the Treasurer and the
balance of the report be received for information.
5. THAT the Summary of Committee of Adjustment Applications
for the meeting of April 4, 1984, be re ceived for information.
6. Rezoning - Part Lot 27, Cone. 5 Clarke - Lomax
THAT the application submitted by M. Lomax to rezone a 3.56
hectare parcel of land in Part of Lot 27, Concession 5, former
Township of Clarke to "Agricul tural" be referred to staff for
processing and a subsequent report and public hearing.
Rezoning - Part Lot 34, Cone. 2 Darlington
Schleiss and Holland
7.

THAT the application submitted on behalf of Schleiss and Holland
(Kilimanjaro and Newgor Land Group) by the Proctor and Redfern
Group, to amend By-law 2111, as amended, through By-law 84-5,
in respect of Part Lot 34, Concession 2, former Townshipof Darlington
be referred to staff for processing and a subsequent report and
public meeting; and
THAT the rezoning application processing fee and sign requirement
be wai ved.
8.
Automotive Cycling Yards
THAT the Canadian Automotive Recyclers Association Inc. be
provided with a copy of the Property Standards By-law and
appropriate zoning by-law provisions relating to "Automotive
Recyclers and Dismantlers" for their information and records; and
THAT they be advised that the Town will only investigate
written complaints in respect of specific properties.
9.
Ridge Pine Park - Sales Office Agreement
THAT pursuant to the provisions of the Agreement between
the Town of Newcastle and Ridge Pine Park Inc. dated May 24,
1983, registered August 15, 1983, Instrument No. 1365, an
extension to the time period of five (5) years, thereby
expiring on May 24, 1990 be approved; and Ridge Pine Park
Inc. be so notified of the extension and date thereof.

10. Comprehensive Zoning By-law
1. That Report PD-105-84 be received;
2. THAT the Comprehensive Zoning By-law for the Town of
Newcastle, included as Attachment 1 to Report PD-105-84 be
forwarded to Council for first reading; and
3. THAT planning staff proceed with;
(i) publication of the Comprehensive Zoning By-law
as a supplement to local newspapers;
(ii) NOTICE OF PUBLIC INFORMATION Sessions;
(iii) Notice of public meeting.
(iv) a special meeting with Council to discuss this draft
prior to the end of May
4. THAT Planning staff prepare a further report in respect
of the public input received during the public information
sessions and public meetings for consideration by Council
concurrent with consideration of the second and third
readings of the Comprehensive Zoning By-law.

11. Rezoning - Pollard
1. THAT Report PD-106-84 be received and Council authorize
staff to proceed with the preparation of a Neighbourhood
Development Plan for Neighbourhood 3B of Courice; and
2. THAT staff be authorized to schedule a public meeting in
respect of said development plan, to be held in the Courtice
Area in approzimately two weeks; and
3. THAT the subject application for rezoning - File DEV 83-21,
be tabled until after the aforementioned public meeting has
been held; and
4. THAT Staff be authorized to immediately circulate notice of
Council's intent to consider approval of the revised
application for rezoning of Sections A, Band D of the Site
Plan and a deferral of Section C at the Committee Meeting
of June 18th, 1984, and that the said notice be provided in
accordance with the applicable Provincial regulations; and
5. THAT, following the public meeting, referred to in No.2
above, that staff prepare a draft development agreement
and draft zoning by-law for the Committee's consideration
on June 18th, 1984; and
.
6. THAT staff explore the options with the applicant with
respect to Mr. Pollard's request for reduction or elimination
of development charges.

THAT Council not support a reduction or elimination
of development charges but would support staging of
payment.
12. Proposed Subdivision Agreement
Blackcreek Developments
1. THAT the by-law attached to Report PD-108"84, authorizing
execution of a subdivision agreement between Blackcreek
Developments and the Corporation of the Town of Newcastle
be approved. (See By-law 84-64)
2. THAT the Mayor and Clerk be authorized to execute a sub-
division agreement between Blackcreek developments and the
Town of Newcastle at such time as an agreement has been
finalized to the satisfaction of the Director of Public
Works and the Director of Planning.
13. Application for Subdivision Approval - Zakarow
1. THAT Report PD-86-84 be received;
2. THAT Council approve Alternative #2 in the Report;

3. THAT the Region of Durham be advised that the Town of
Newcastle has no objection to draft approval of proposal
plan l8T-82037, subject to the conditions contained in
Attachment 3 and the necessary revisions to reflect the road
pattern identified by Attachment No.2.
14.
Rezoning - Lots 31 and 32, B.F. Cone. Darlington (Amyotte)
WHEREAS an application for rezoning was submitted by Mr. R. Amyotte
in respect of Part of Lots 31 & 32, B.F. Cone. geographic Township
of Darlington, now in the Town of Newoastle (on August 15, 1979);
AND WHEREAS on April 21, 1981, Council of the Town of Newcastle resolved
to approve said application for rezoning conditional upon execution of
a subdivision Agreement in respect of said lands;
AND WHEREAS since the date of receipt of the said application for rezoning
Council of the Town of Newcastle has, through approval of subdivision
agreements in respect of other plans of industrial subdivision, resolved
not to require a contribution for future road improvements;
AND WHEREAS the Council of the Town of Newcastle wishes to extend the
same consideration to the subject application;

NOW THEREFORE BE IT RESOLVED that the developer's required contribution
for capital improvements to roads external to the subject development
are hereby waived, provided that development or building on the lands
has taken place before August 1, 1985.
15.
HERITAGE DESIGNATIONS
.
THAT the following by-laws be approved by Council:

AND FURTHER that the Clerk be authorized to carry out all of the
actions necessary to complete the process of property designation
pursuant to The Ontario Heritage Act 1984, and detailed within the
reports.
16.
THAT the ANIMAL CONTROL MONTHLY REPORT FOR MARCH 1984
be received for information.
17.
Request to Occupy Existing Dwelling (Gibson)
THAT the application of Mr. & Mrs. Gibson to occupy an existing dwelling
during the construction of a new dwelling, be approved subject to the
applicant meeting all of the Town of Newcastle's requirements with
respect to building permits and clearances; and
THAT the Mayor and Clerk be authorized to execute the standard
agreement to permit the occupying of the existing residential
dwelling during the construction of the new home, for a periOd not
exceeding six months.
18.
Easement or Quit Claim Bowmanville Harbour Public Works Canada
.
THAT the Town's Solicitor be authorized to prepare the necessary Quit
Claim Deed to remove the cloud on title to part 1 Plan 10R-1484;
THAT the Mayor and Clerk be authorized to execute the Quit Claim deed; and
THAT the Clerk prepare the necessary by-law to authorize execution of
the Quit Claim Deed.

19.
Staffing - Treasury Department
THAT staff be authorized to advertise a temporary position at
Category 6 level (Accounts Payable Clerk) with the terms of employment
not to exceed five months;
THAT the Deputy Treasurer be granted an additional $100 per week for the
time period which the Treasurer is away, as compensation for his added
responsibilities;
THAT Admin Report 34-84, which was tabled by Council, be lifted
from the table and referred back to staff;
THAT the Deputy Treasurer be advised of Council's action.
20.
Bicentennial Activities
.
THAT the Bicentennial Committee be authorized to expend funds for the
promotion of the Bicentennial without specific Council approval, provided
such costs do not exceed $500.;
THAT Council approve the publication of the calendar of Bicentennial
events in local newspapers having general circulation in the Town;
THAT the Chairman of the Bicentennial Committee be advised of Council's
actions.
21.
Hall Board Requests
THAT the requests from the various Hall Boards be referred to 1985
Budget discussions. the Boards be advised accordingly and that they
may make representation at that time.
22.
Tender T84-6 - Emulsified Asphalt Patching Material
THAT Bennett Paving & Materials Ltd. Oshawa, with a total bid
in the amount of $69,300. being the lowest responsible bidder meeting
all terms conditions and specifications of Tender T84-6, be awarded
the contract to supply Emulsified Asphalt Patching Material on an
"as required" basis to the Town 'of Newcastle: and
THAT the funds expended be provided from the approved Public Works
roads material maintenance budget.

23.
THAT Report TR-31-84, 1983 STATISTICAL ANALYSIS OF THE
PURCHASING FUNCTION, be received for information.
24.
Tender T-84-8 - Compact Type Tractor
THAT Queensway Ford Equipment Sales, Peterborough, Ontario
with a total bid of $15,493.60, being the lowest responsible
bidder, meeting all terms conditions and specifications of Tender T84-8
be awarded the contract to supply and deliver one only Ford Model 1910
Tractor and Loader to the Town of Newcastle as required by the
Department of Community Services; and
THAT the funds be drawn from the 1984 approved Community
Services Capital Budget of $15,500.00.
25.
Tender T84-5 - M.N.R. Ontario Basic Mapping Project
THAT McElhanney Mapping Services, Ottawa, Ontario, with a total bid
of $73,376.00 being the lowest responsible bidder meeting all terms
conditions and specifications of Tender T84-5 be appointed as prime
contractor to undertake the "Basic Mapping Project" as required
by the Town of Newcastle in conjunction with the Ministry of Natural
Resources; and
THAT staff further liaise with the Ministry of Natural Resources and
the prime contractor to prepare an agreement for the commencement of the
mapping project; and
THAT the agreement be presented to Council for approval, when
available from the Ministry of Natural Resources.
, 26. THAT Report TR-36-84, Senior Citizen Tax Rebate
be received for information.

27.
Information Bulletin
THAT the printers proof of the 1984 Information Bulletin -
Insert for 1984 Tax Bills, attached to Report TR-35-83, be approved
for printing.
28.
Tender T84-7- Prime and Surface Treatment
THAT Norjohn Contracting Ltd., Thorold, with a total bid in the amount of
$518,790.00 being the lowest responsible bidder meeting all terms conditions
and specifications of Tender T84-7 be awarded the contract to supply and
apply Prime and Surface Treatment to various roads as required by the
Town of Newcastle; and
THAT the funds expended be provided from the approved Public Works Roads
Material Budget.

29. By-law to Establish a Fire Department
THAT Council approve the bY-law, attached to Report FD-8-84,
being a by-law to establish a Fire Department for the Town of Newcastle
and rescind the following by-laws: (See by-law 84-68)
By-law 1528 of the Township of Clarke
By-law 71-21 of the Village of Newcastle
By-law 1999 of the Town of Bowmanville
By-law 71-22 of the Village of Newcastle.
30.
Residential Fire Inspection Program
THAT Council grant approval to the Fire Department to conduct
a voluntary Home Inspection Program thoughout the Town of Newcastle.
31 .
Decoration Day
THAT Decoration Day be held on Sunday, July 15th, 1984 at
Bowmanville and Bond Head Cemeteries.
32.
Witzke Drainage
THAT Council approve the ditching of the south side of Pebblestone
Road from the Witzke property to Farewell Creek.
Petition re Nash Road
THAT the petitioners be advised that warrants do exist for street light
installation on Nash Road between the Oshawa/Newcastle Townline and
Darlington Boulevard North;
THAT a copy of By-law 84-20, being a by-law identifying the Town's
policy for street lights, be forwarded to the petitioners for their
consideration and further action in accordance with said policy;
THAT a copy of this report be forwarded to the petitioners in response
to their other requested improvements and assistance in these matters be
provided by Town staff when required.
34.
Sidewalk - Oshawa Townline
THAT the City of Oshawa be advised that the Town of Newcastle
has no objection to the construction of a sidewalk on the west side
of Townline Road from Adelaide Avenue East to Kilmaurs Avenue, subject
to a clear undertainding that the Town will not be required to
contribute to the capital or maintenance cost of such sidewalk.

35.
One-Foot Reserves - Succee Subdivision
THAT a by-law be passed authorizing the Mayor and Clerk to execute on
behalf of the Town, quit claim deeds or any other documentation necessary
for the removal of the one foot reserves on Darlington Street and
Tanglewood Court in the Sucee Subdivision, as required for each lot leing
sold;
THAT Mr. Sucee and his lawyer be advised that in the offers of purchase
and sale for Lots 5, 6, 7, 8, 9, and 10, in the Sucee Subdivision
and subsequent finalization of the transactions, appropriate transfers
of the one-foot town-owned reserves should be prepared for execution
by the Town.
36.
Design Criteria and Standard Detail Drawings
THAT the Director of Works be authorized to issue updated metric
Design Cri.teria and Standard Detail Drawings for use by developers in
preparing engineering drawings for subdivisions; and
THAT such authorization be an interim measure until such time as the
finalized compilation of Design Criteria andStandard Detail Drawings are
submitted to Council for adoption.

37.
Rogers Cable T.V. Lot 21, Orono Estates
THAT a by-law be passed, authorizing the Mayor and Clerk to execute an
agreement in the form attached hereto, between the Town and Rogers Cable
T.V. for the installation, operation and maintenance of an underground
Television cable along the south side of Lot 21, Plan 693, Orono Estates.

38.
Dedication of Road Widenings Strathaven
THAT a by-law be passed by Council for the dedication of Part 6, Plan!
10R-1732, and Part 2 Plan R.D. 64, as public road allowances;
(see by-law 84-7gJ;
THAT the law firm of McMaster & Meighen be advised of Council's actions
in thi smatter.
39. THAT the correspondence from JED HELICOPTERS re temporary heliport
at Mosport, be received for information.
40.
Apple Blossom Week
.
THAT the week of Saturday, May 26th to Friday, June 1st 1984 be
proclaimed "APPLE BLOSSOM WEEK" in the Town of Newcastle, in
accordance with Town Policy.

A.M.O. Nominations
THAT Council support the nomination of Mayor Rickard and the Chief
Administrati ve Offi cer, D. Johnston, to thei r respecti ve Boards of
the Association of Municipalities of Ontario.
42.
User Fees - Libraries
THAT the correspondence from Royal and Norma Lee, relative to
User Fees at Local Libraries, be received and referred to the
Ad Hoc Committee for Library matters.
43.
Livestock Claim Appeal
THAT the Clerk be authorized to enter an appeal relative to
a Livestock Claim.
