REPORT # 1 CORPORATION OF THE TOWN OF NEWCASTLE OFFICE OF THE TOWN CLERK TELEPHONE 623-3379 40 TEMPERANCE STREET BOWMANVILLE, ONTARIO L1C3A6 REPORT TO THE COUNCIL MEETING OF MARCH 26 1984 SUBJECT: GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF MARCH 19 1984. RECOMMENDATIONS: 1. Rezoning - Port Darlington Marina Hotel THAT the by-law attached to Report PD-67-84, to amend Zoning by-law 1587, as amended, be forwarded to Council at such time as Official Plan Amendment No. 84-33/D has been approved by the Ministry of Municipal Affairs and Housing, and the existing Site Plan Agreement has been amended to reflect the development as proposed, to the satisfaction of the Town of Newcastle; and THAT the Region of Durham be advised at such time that Recommendation No.2 has been satisfied, that the Town of Newcastle has no objections to the approval of Plan of Condominium l8CDM-83-0D2. 2. Rezoning - B. Moase THAT the application submitted by Mr. Bruce Moase to rezone a 1030m2 triangular parcel of land in Part of Lot 34, Concession 2, former Township of Darl ington, from "R2 c- Second Density Residential" to Special Purpose Commercial (incorporated with Special Purpose Commercial By-law 81-123) be received and referred to staff for processing and a subsequent report and public hearing. 3. Plan of Subdivision - Zurba THAT the Region of Durham be so advised that the Town of Newcastle has no objections to the amending of Draft Condition #2 whereby the wording "this shall include Block I" is deleted and furthermore that draft Condition #7 is deleted in its entirety; and THAT a copy of Staff Report PD-70-84 be forwarded to the Region of Durham. REPORT # 1 - 2 - . 4. Amendment to Sign By-law THAT the by-law attached to Report PD-7l-84, being a by-law to amend By-law 76-25, as amended, be approved. (See by-law 84-39) 5. Roadside Ditching - Witzke The matter of the Roadside Drainage Problem on Pebblestone Road was referred to Council for resolution, after the Road has been inspected during the Annual Road Tour. 6. Permission to Occupy Existing Dwelling (Risorto) THAT the request for an extension of the agreement granting Mr. and Mrs. Salvatore Risorto the right to occupy the existing residence during the completion of their new residence until June 30th, 1984, be approved; and THAT the Town be demolished by June 30th, of Newcastle reaffirm its requirement that the old residence as soon as the new dwelling is occupied by the Risorto's or 1984, whichever occurs first. 7. Permission to Occupy Existing Dwelling - (Hamilton) . THAT the application be approved, subject to the applicants meeting all of the Town of Newcastle's requirements with respect to building permits and clearances; and THAT the Mayor and Clerk be authorized to execute the standard agreement authorizing the use of a mobile home as a temporary residence on site, for a period not exceeding six months. 8. THAT the by-law of Schedule "C" Schedule "C" be By-law 78-38 - Places of Amusement attached to Report CD-21-84, authorizing the deletion to By-law 78-38 and the substitution of the revised approved. (See by-law 84-40). 9. Receive for Information (a) Parking Enforcement Report for the month of February 1984. (b) Animal Control Report for February 1984. (c) Investigation of Problem Relating to the Municipality's Emergency Telephone Numbers. . REPORT # 1 - 3 - . 10. Procedure for Property Disposal THAT the Policy Statement attached to Report ADmin 32-84, be adopted as the Town of Newcastl e' s procedure for property disposal. 11. Calcium Chloride Requirements - 1984 THAT Miller Paving Ltd., Unionville, Ontario, with unit prices of $.1167 per litre and $189.18 per tonne for 35 percent Liquid Calcium Chloride Solution and bulk calcium chloride respectively being the lowest responsible bidder meeting all terms and specifications of the Region of Durham Tender No. WD-9-84 be awarded the contract to supply and apply calcium chloride, as required by the Town of Newcastle Public Works Department; and THAT the funds expended be drawn from the 1984 Budget Allocation for Public Works Road Maintenance. 12. Acti vi ty Report . THAT Report TR-17-84, Activity Report for February 1984 be endorsed and the expenditures for the month of February 1984 be approved. 13. Monthly Fi re Report THAT Monthly Fire Report for February 1984, be received for information. 14. Surplus Fire Department Items THAT Council approve the sale of surplus Fire Department equipment to the Manvers Township Fire Department for a total amount of $350.00. 15. Lead Hand - Department of Community Services THAT the job description attached to Report CS-02-84, as amended, for Department of Community Sercies Lead Hand, be approved: *Responsibility #3 was amended to read: "to maintain, as required, proper cash control; process receipts; ice rental, pool rental received; while on duty at the various facilities and maintain cemetery records," THAT Staff be authorized to advertise for the position of Lead Hand, in a<;<;ordance wi th the Uni on Agreement. . REPQRT # 1 - 4 - . 16. Closure & ConveYqnce - Lambert St. THAT, as part of its contribution towards the expansion plans for Memorial Hospital - ~QWmanville, the Town of Newcastle suspend the requlrements of its road cl osi ng and conveyance policy, and take the necessary actions for the closure and conveyance of Lambert Street, between Queen and Prince Streets; and THAT the necessary funds for survey, legal, advertising, and administration costs associated with the closure and conveyance, be drawn from the Road Capital Reserve Fund, Account No. 1110-x-OD165-7; and THAT Memorial Hospital - Bowmanville, be responsible as part of their construction program, for removal and/or relocation of any utilities or services on Lambert Street; and THAT Me.mori.al Hospital - Bowmanvil1e, be so advised. 17. 1984 Road Needs Study Update THAT the Town's Road Needs Study be updated in 1984 in accordance with the guidelines set out by the Ministry of Transportation and Communications; and . THAT the Town utilize the servicing of the consulting firm of Totten Sims Hubicki Associates, Ltd., for the 1984 Road Needs Study Update, at an estimated cost of $5,000.00. 18. MTC Purchase of Lands - Highway 35/115 THAT approval be given to the Ministry of Transportation and Communications request for the acquisition of title to Part 10, Plan 10R-1697, and easement rights, in the name of the Kirby United Church, over Part II. Plan 10R-1697; and THAT the compensation by the Ministry of Transportation to the Town for said lands be $620.00; and THAT the Mayor and Clerk be authorized to execute the Property Purchase Agreement prior to June 28, 1984, as requested by the Mi ni stry. . REPORT # 1 - 5 - . 19. Class Environmental Assessment THAT the Minister of the Environment be advised, that the Town of Newcastle endorses the Municipal Engineers Association Working Group as its agent in the preparation and approval process for Class Environmental Assessments (E.A.'s) for Municipal Road Projects and Municipal Sewer and Water Projects; and . THAT the Minister of the Environment be advised that, in so doing, the Town of Newcastle supports the position taken by the Municipal Engineers Association (M.E.A.) relating to conflicts arising from the Government review of said documents, especially in the following areas which are considered fundamental principles: i) Th.e requirement for construction guidelines; ii) Timing of land acquisition; iii) Projects proceed before bump-up resolution; iv) Requirement for broader public notification; v) Buildings and sites of heritage importance. THAT the Minister of the Environment be advised that, if the said issues, and any others considered important by the Municipal Engineers Association Working Group, cannot be resolved, the Town of Newcastle will support the Working Group in a hearing before the Environmental Assessment Board; and THAT copies of this resolution and report be forwarded to the Minister of the Environment and the ~~unicipal Engineers Association. 20. Sidewalk - Townline Road - Kingsway Village Mall THAT the City of Oshawa be advised that the Town of Newcastle has no objection to the construction of a sidewalk on the west side of Townl i ne Road from the Kingsway Vill age Shoppi ng Mall to Ade 1 ai de Avenue East, subject to a clear understanding that the Town will not be required to contribute to the capital or maintenance cost of such sidewalk. 21. Release - Walter Schleiss Subdivision Agreement THAT the Town Solicitor prepare the necessary documentation for the execution and final release of the Subdivision Agreement between Walter Schleiss Construction and the Town of Bowmanville; and THAT the Mayor and Clerk be authorized to issue the Certificate of Release on behalf of the Town.
