REPORT # 1

REPORT TO THE COUNCIL MEETING OF APRIL 25 1983
Mayor Rickard and Members of Council :-
The following recommendations to Council were made at a meeting of the
General Purpose and Administration Committee held on April 18 1983:
1.
Access - Elliott Street Burketon
THAT Report WD-41-83 be received and Mr. Skinner be advised that his application
for property access will require installation of an entrance comple~with a
fifteen inch (15") diameter culvert at a cost to him of $460.00 less applica~ion
fees of $55.00, already paid; and Mr. Skinner be so advised by copy of this report.
2. Conditions of Sale - Golf Course Road
(a) THAT the Town engage an appraiser to determine the fair market
value of lands on the west side of Golf Course Road in Lot 21
of Concession 2, former Township of Clarke; and
.
(b) That a copy of said appraisal be provided to William and Lois
Adams and their solicitor with the advice that the Town will
rely upon such an appraisal if an agreement cannot be reached
and expropriation becomes necessary: and
(c) That if an agreement of purchase and sale is reached as a result
of the appraisal, the Town shall pay all reasonable legal fees
of the vendors in accordance with the Durham Law Association
recommended tariff;
(d) That Mr. J. D. MacGregor be so advised.
3. Speed Limit - Maple Grove Road
THAT Report WD-43-83 be received and a copy be forwarded to the Durham
Regional Police Force and Mr. W. Hockett, for information.
4.
Storm and Sanitary Sewer Cross- Connections
Beau Valley Estates Subdivision - Bowmanville
1. That, in view of the supplementary information contained in this
report, the recommendations presented in Report WD-40-83 be adopted;
namely;

(a) That the Region of Durham be advised that the Town
of Newcastle is willing to pay its share of the cost
of eliminating storm sewer house connections to the
sanitary sewers in the Beau Valley Estates Subdivision
in Bowmanville; and
(b) That the Region be further advised that the Town will
only participate in costs at those houses where there
is, in fact, a connection of the storm to the sanitary
sewer found, rather than on a blanket SO/SO bas is; and
(c) That the Region be further advised that the Town will
pay fifty percent (SO%) of the investigative work
leading to the program of eliminating the cross-
connecting; and
(d) That funds to cover the Town's share of the cost of
correcting the cross-connections (about $10,000) and
for the eleven connections involved, be derived from
the lot levy reserve account.

5. Policy for Unmaintained Road Construction
That Report WD-4S-83 be received and Council adopt the following resolution:
"THAT the Town of Newcastle will not undertake the construction
of any unmaintained road until June, 1985, and will not, within
that pertod, assume for maintenance purposes any additional roads,
save and except those which are constructed by others, at no cost
to the Town, under a Subdivision Agreement, the Local Improvement
Act or private enterprise. Roads so constructed must meet the
design criteria and construction standards required by the Town of
Newcastle, and all applications for implementation of this policy
must be approved by the Director of Public Works for the Town of
Newcastle, and be in accordance with the provisions of the
appropriate Zoning By-law and Official Plan".
6. THAT Report WD-46-83 MECHANIC VACANCY FLEET SECTION PUBLIC WORKS
be received for information.

7.
"No Bicycle Riding" Signs
(a) Report WD-47-83 be received.
(b) The Public Works Department install "No Bicycle Riding on
Sidewalks" signs as requested by the Bowmanville Business
Centre; and
(c) The installation costs be charged to Public Works, Street
Signs - Bowmanville, Account Number 7211-x-00422-x; and
(d) The installation be in accordance with Schedule 'A' of
By-law 80-36; and
(e) The Bowmanville Business Centre be so advised.
8. Rezoning - Plan of Subdivision 18T-82034
VanAndel and Gust
.
(a) Report PD-62-83 be received.
(b) The Region of Durham be advised that the Town of Newcastle
recommends approval of plan 18T-82034, dated September 19
1982, subject to the amended conditions contained in Attachment
No.1 to this report;
*Amendment - Condition 14 amended to read:
14. That the owner agrees to negotiate the purchase of
Block 27 with the appropriate authority for erosion
protection, flood control and conservation purposes.
(c) Application for rezoning in respect of Part of Lot 15,
Concession 3, Township of Darlington, be approved and
the attached by-law to amend by-law 2111, as amended, be
forwarded to Council for approval: See By-law 83-65
(d) A copy of Staff Report PD-62-83 be forwarded to the Region
of Durham.
9. Application for Rezoning DEV 82-33 (Bolahood)
Report PD-63-83 be received, application for rezoning DEV 82-33 be
approved and the attached by-law be forwarded to Council upon the
dedication of a 3.048 metre road widening and a 0.3 metre reserve,
and payment of the Town's lot development charge.

10.
Objection to By-law 82-181 (Davis)
Report PD-64-83 be received and the following resolution be adopted
by Council and forwarded to the Ontario Municipal Board together with
By-l aw 82-181 :
"WHEREAS the Council of the Town of Newcastle has approved by-law 82-181
to amend Restricted Area Zoning By-law 2111, as amended, as a result of
their consideration of an application for such an amendment submitted
by the property owner; and
WHEREAS the effect of By-law 82-181 will be to change the zone
designation of the lands subject to By-law 82-181 from "D-Development"
to "Special Provision By-law 82-181" to permit the development of two
(2) single family residential losts created by Land Division consent;
AND WHEREAS By-law 82-181 has been approved in conformity with the
applicable policies of the Durham Regional Official Plan;
AND WHEREAS the request for the development of the land subject to
By-law 82-181 for residential purposes is in compliance with
Amendment #1 of the Solina Hamlet Plan;

BE IT NOW THEREFORE RESOLVED THAT the Town of Newcastle hereby requests
the Ontario Municipal Board to approve By-law 82-181, notwithstanding the
objection received, and further requests the Ontario Municipal Board
to convene any required public hearing in respect of By-law 82-181 at
the earliest possible opportunity; and
FURTHER hereby authorizes Town Staff and/or the Town Solicitor to
represent the Municipality at any such hearing that may be convened"
11. Official Plan for the Township of Hope Planning Area
(a) Report PD-65-83 be received; and
(b) The Ministry of Municipal Affairs and Housing be advised that
th,e Town of Newcastle has no objection to the proposed Official
Plan for the Township of Hope Planning Area; and
(c) A copy of Staff Report PD-65-83 and Council's Resolution
be forwarded to the Ministry of Municipal Affairs and Housing
and the Corporation of the Township of Hope.

12. Newtonville Water Supply
The delegation from the Durham Health Unit and the Ministry of the
Environment be acknowledged; and
The Town of Newcastle request the Ministry of the Environment, in
communication with the Region of Durham and the Durham Health Unit
to proceed immediately with a hydrological study of the Newtonville
Water Supply and sanitary disposal, with the understanding that the
costs for the study wi 11 be borne by the Province; and
A copy of the resolution be sent to the Region of Durham for their
informati on.
13. Se If Insured Losses Reserve
(a) That $770.00 be taken from the Self-Insured Losses Reserve
in favour of the Darlington Sports Centre to cover damage and
loss of supplies.
(b) That $389.S8 be taken from the Self-Insured Losses Reserve in
favour of the Newcastle Fitness Centre to cover damage and loss
of supplies.

14.
Activity Report
That, in accordance with provision of Chapter 302, Section 81(1} of the
Municipal Act, R.S.O. 1980, "The Treasurer reports to Committee that
the cash position of the Town for the month ended March 31, 1983, is
as shown on the schedule attached to Report TR-83-21" the expenditures
for the month of March 31 1983 be approved.
lS. Transfer of Record-Keeping to Various Boards
(a) Report TR-83-20 be received.
(b) The recordkeeping and associated banking functions for the
general operations of the Bowmanville Museum Board, Clarke
Museum Board, Bowmanville Business Improvement Area and the
Newcastle Business Improvement Area be transferrred to the Treasurer
of the individual Board at a mutually agreed upon date, on or before
June 1, 1983; and
(c) A meeting be convened with the Town of Newcastle Library Board to
discuss the assessing of a charge to cover the processing of the
1 ibrary' s bi -weekly payroll and the associated administration costs
related to that payroll activity.

16.
Private Municipal Acts
(a) That Council adopt the resolution attached to Report CD-21-83; and
(b) A copy of the said resolution be forwarded to the Ministry of
Municipal Affairs and Housing, c/o Mr. Brtan Donaldson,

18. Ministry of Agriculture and Food - Grant
The correspondence from the Mini'stry of Agriculture and Food re
reconsideration of 1983 Grant Request, be received for information
and they be advised that the budget has been struck.
19.
Re-Enactment of 1858 Council
The Chamber of Commerce, 125th Anniversary Committee, be advised that
Counctl does not see fit to re-enact the first Council Meeting, due to
costs and time constraints, and further that Council has shown i'ts
support in a number of ways and will continue to do so.
20.
Brownsdale Hockey Team
Each girl on the Brownsdale Community Centre Girls' Hockey Team be
presented wtth an apple blossom.
21.
C.U.P.E Local 74
Council approve the following resolution:
"The Corporation of the Town of Newcastle agrees that no employee
subject to the Outside Collective Agreement with C:U.P.E. Local 74
shall be laid off from work during the period of time in which the
Town participates in the Canada Community Development Program or the
Canada/Ontario Employment Development Program."

22.
Promoti on Day
Councillor Hubbard be authorized to make luncheon arrangements
for Promotion Day at a cost of $7.S0 per guest for lSO guests.
23.
Mr. Obrist
Mr. Obrist's delegation be acknowledged and he be advised of the
Town's policy for unmaintained road construction.

24. Staff Training
(a) Report Admin 24-83 be received;
(b) Council authorize staff to attend a "Communications and Public
RelaUons Workshop" at the Durham College Conference Centre
during the week starting May 9 1983;
(c) Council authorize the submission of an application under the
Provi'ncial Training in Business and Industry Program (1. 1. B. 1.)
for sharing the cost of the "CommunicaUons and Publ ic Rel ations
Workshop" and
(d) All costs for the workshop be drawn from the "Staff Training Account"
7004-0233-x-4.

Staff Retirement Policy
The fOllowing policy for staff retirement be adopted:
(1 ) Any person retiring with 10 years service or less will receive a
"Retirement Certificate" from the Town and a letter from the Mayor
and Council, thanking them for their service;
(2}Any person retiring with 11 to 20 years of service will receive a
"Retirement Certificate" from the Town and a letter from the Mayor
and Council thanking them for their service. In addition, they will
receive a gift valued at not more than $SO.
(3}Any person retiring with more than 20 years of service will receive
a Retirement Certificate" from the Town and a letter from the Mayor and Council
thanking them for their service. In addition, they will receive a gift valued
at not more than $100.

In all cases the presentation should be made at a Council meeting by the Mayor.
For persons in Category (3) that have held senior positions in the Town
or former municipalities. above the rank of Works Foreman, then the Town
should convene a reception to a maxim~cost of $2S0.00. Length of service
should be interpreted to include employment with the former Municipalities
of Clarke, Darlington, Bowmanville and Newcastle.

2S.Staff Retirement Policy (Continued)
The certificate, letter, gift and possible reception should be
undertaken by the Town regardl ess of what gifts, 1 uncheons, etc.
might be organized by individual departments or volunteers.
Arrangements should be made through the Administrator's Office. All
monies would be drawn through Unclassified Administration Account
Number 7007-023S-X-S.
26.
Employees Leaving the Municipality
A Certificate of Appreciation be presented at the discretion of Council
to all employees leaving the Municipal ity.
