The following is a, report of the meeting of the General Purpose and Administration
Committee held on February 7 1983. It was recommended to Council THAT
1. Encroachment - Nelson Street Bowmanville
1. Report WD-9-83 be received.
2, In accordance with Town Po 1 i cy, By-l aw 81-50, a by-l aw be prepared
in respect of the encroachment of a frame garage onto Nelson Street
Bowmanville, defined as Part 2, Plan 10R-1576; (See By-law 83-25)
3. The provisions of Section 210: para. 101, of the Municipal Act,
R.S.O. 1980, be applied as follows:
(a) that the encroachment be granted for the life of the
building subject to
(b) the understanding that the by-law may be rescinded at any
time in the event that the land in question is required for
Municipal purposes; and
4. Mr. Al Strike's delegation to the meeting be acknowledged and
he be advised of the action taken.

2. Trees - Ki rby School house
1. Report WD-10-83 be received.
2. A copy of this report be forwarded to the Board of Clarke Museum
and Archives in response to their enquiry on the matter of tree
trimming and removal at the Kirby School.
3. The Board consider having private individuals remove the trees
for the wood.

Entrance Permit Refund - Pollet
1. Report WD-11-83 be received and Mr. Pollet's delegation be
acknowledged and a refund of $128.40, being the cost of the culvert
be granted to Mr. & Mrs. Pollet.

Subdivision lBT-B1013, 1927 Investments
Report PD-17-B3 be received.
The Region of Durham be advised that the Town of Newcastle
recommends that the subdivision application lBT-B1013 submitted
by 1927 Investments Limited be denied without prejudice at this time.
A copy of staff report PD-17-B3 be forwarded to the Region of Durham.
Building Permit
Report PD-23-B3 be received.
Council is satisfied that, based upon the evidence attached to
the Report the building on the south half of Lot 21, Concession 1,
Darlington (Foley) has been sited in accordance with the building
permit and restricted area by-law.
Rezoning Z-A-3-l3-12 - Bondhead Professional Building
1. Ms MacArthur's delegation be acknowledged and Report PD-24-B3
be received.
2. Application for rezoning Z-A-3-l3-l2, in respect of Plan C.G.Hanning,
Part of Block "A" on the north-east corner of King Street and North
Street be approved and the attached by-law to amend Restricted Area
(Zoning) by-law 79-44, as amended, be forwarded to Council for approval.

Approval of Plans by Ministry
Newcastle hereby requests the Ministry of Municipal Affairs
to approve the Newcastle Village Urban Area Plan and the
Urban Area Plan, forthwith. (see attached resolution)
Draft Plan of Subdivision - Penwest Developments Ltd.
Mr. Stephen Pustil's delegation on behalf of Penwest Development Ltd.
be acknowledged and Report PD-26-B3 be received for information.
Armstrong Stores

1. Report PD-27-B3 be received;
2. The proposed revision to the conceptual design of the proposed
retail plaza be approved provided the architectural treatment is
continued along the rear of the building.

1. Report PD-28-83 be received.
2. The Region of Durham be so advised that the Town of Newcastle
recommends approval of revised plan l8T-82030, dated December
4,1981, subject to the conditions contained in Attachment 1
to this report, as amended as follows:

A copy of Staff Report PD-28-83 be forwarded to the Region of Durham.
Proposed Amendment to Regional Official Plan
Report PD-20-83 be received.
The Region of Durham be advised that the Town of Newcastle
recommends that the proposed general amendment to the Region
of Durham Official Plan to permit limited industrial and
commercial uses in existing structures used previously for
similar uses be denied as proposed: and
The attached proposed modified amendment be forwarded to the
Region for their consideration; and
A copy of Staff report PD-20-83 be forwarded to the Region of
Durham for thei r i nformat ion.
13. Progam Refund Policy - Community Services
1. Report CS-01-83 be received.
2. Any applicant to a Community Services Program wishing to cancel
registration in a program shall be charged a cancellation fee of
ten dollars ($10.00). If the cancellation is for medical reasons,
then a cancellation fee of five dollars ($5.00) shall apply.

THAT Report FD-1-83, Monthly Fire Report for December 1982, be received
for information.

15.
Petition for Subsidy
The Treasurer be authorized to petition the Ministry of
Transportation and Communications for Final Subsidy on
expenditures in the Public Works Department from January 1 to
December 31, 1982.
16.
Petition for Supplementary Subsidy
The Treasurer be authorized to petition the Ministry of
Transportation and Communications for Final Supplementary
Subsidy on expenditures in the Public Works Department from
January 1 to December 31, 1982.
17. Report TR-83-6. COUNCILLORS' REMUNERATION AND EXPENSES FOR 1982
be received for information.
18. Solina Athletic Field By-law
1. Report CD-10-82 be received.
2. The attached by-law be approved by Council. (See by-law 83-28)
3. When the by-law has been approved by Council, a copy be forwarded
to the Minister of Tourism and Recreation, the Honourable Reuben
C. Baetz.
19. Council approve the APPLICATION FOR A RAFFLE LOTTERY LICENCE FOR THE
ORONO FISH AND HUNT CLUB.
20. Policy re Granting Permission to sell Raffle Tickets
in the Town of Newcastle
1. Report CD-12-83 be received.
2. The following resolution be adopted as Town Policy:
"WHEREAS Council deems it appropriate that applications received from non-
resident organizations seeking permission to sell lottery tickets in the
Town of Newcastle through local affiliates, should be considered without
delay;
AND WHEREAS Council deems it expedient to establish a policy with respect
to the manner in which such applications are to be processed;
NOW THEREFORE be it resolved that for the purpose of processing such
applications, the Clerk is hereby appointed as Council's designate and
shall review, in accordance with existing provincial legislation, and
where appropriate, approve applications submitted by non-resident

organizations who are seeking permission to sell raffle lottery
tickets in the Town of Newcastle through local affiliates; and
FURTHER that this policy shall remain in effect until amended, or
repealed by Council.
21. Report CD-14-83 PARKING REPORT FOR JANUARY 1983 be received for information,
22. Town Owned Lot Caroline Street, Newcastle Village
1. Report Admin 11-83 be received;
2. Council adopt the following resolution:
"The Town of Newcastle hereby authorizes the prepayment of its
share of the servicing cost estimates for the construction of
sewer and watermains on Caroline Street and hereby requests
the Region of Durham to budget for its share of the costs in 1983
and to schedule the work as soon as possible".
23.
Report Admin 12-83 INDUSTRIAL DIRECTORY be received for information.
24. Supplementary Agreement #9 - Ontario Hydro
1. Report Admin 14-83 be received.
2. The attached Supplementary Agreement Number 9 be approved by
Council, as amended as follows:
Item 2,"$10,000. for Clarke Museum" be substituted for
"$ 5,000. for each of the Orono and Cl ark Museums".
3. The attached by-law be adopted authorizing execution of the
Agreement (See by-law 83-29)
4. The Clerk forward copies of the Agreement to the Region of Durham
for execution after execution by the Town.
25. The correspondence from the MINISTRY OF MUNICIPAL AFFAIRS AND HOUSING
re INFLATION RESTRAINT PROGRAM be received for information.

Leasing/Rental of Town Buildings
Report Admin 13-83 be received.
Council adopt the following resolution:
"Council hereby authorizes the leasing of the unused portions
of the Orono Armouries Building to the Board of Management
according to the terms and conditions, as amended, set out in
Administrator's Report Admin 13-83, and further;
Council hereby authorizes the leasing of the office area
portion of the Orono Armouries Building to Matthews and Hill
Insurance Ltd. according to the terms and conditions set out
in Administrator's Report Admin 13-83, and further;
Council hereby authorizes increasing the rent of the Newcastle
Fire Hall apartment according to the terms and conditions set
out in Administrator's Report Admin 13-83".
The Glen - Part Lot 27, B.F.Con.
1. Report Admin 10-83 be received.
2. The following resolution be adopted by Council:
"WHEREAS the Town of Newcastle wishes to acquire ownership of
"The Glen", part of Lot 27, B.F. Concession, part 4, Plan 10R-1427; and
WHEREAS it appears that the said lands have escheated to the Province
of Ontario;
BE IT NOW RESOLVED that the Town of Newcastle hereby requests the
Province of Ontario to convey said lands at a nominal cost to the
Town of Newcastle for park purposes; and further
Mr. S. Cureatz, M.P.P. is hereby requested to attend to this matter".
Union Salaries
Report Admin 15-83 be received and, in accordance with the Provincial Wage
Constraint Program, a 5% increase for union staff be awarded, with a minimum
of $750.00.
