Councillor Foster indicated that he would be stating a pecuniary interest with respect to
Report PSD-020-06. Councillor Foster advised his wife works at the church.

Leslie Benson, Manager of Transportation & Design, Engineering Services, introduced
Bruno Bianco, Design Engineer, Engineering Services. Mr. Bianco commenced his
employment with the Municipality of Clarington on January 31, 2006.
PRESENTATION
PC Todd Petzold, Durham Regional Police Services addressed Council in regards to
the sale and possession of "replica and imitation firearms". PC Petzold is a youth liaison
representative for the Durham Regional Police Services. PC Petzold related past
events in 2005 and 2006, involving replica and imitation firearms, which have initiated
the need for creating a by-law for the enforcement of the sale and possession of replica
and imitation firearms. Durham Regional Police Services is encouraging all
Municipalities in the Region of Durham to adopt the same by-law as was passed by The
Township of Scugog to regulate the sale and possession of replica and imitation
firearms. PC Petzold advised that Municipal Law Enforcement Officers will not be
required to enforce the by-law.
Mayor Mutton welcomed Inspector Bill Temple and Pat Sayer, Durham Regional Police
Services.
Sergeant Steve Jones, Gang Enforcement Unit, Durham Regional Police Services,
presented a slide show to Council in regards to Street Gangs. Detective Jones advised
that the Gang Enforcement Unit was formed in January, 2005 and is comprised of 1
Detective Sergeant, 2 Detectives, and 10 Detective Constables to address the increase
in the number of street gangs throughout the Region of Durham. Detective Jones
addressed the following criteria: .
- the Mandate of Gang Enforcement Unit;
- the definition of a "Street Gang" under the Criminal Code and a Gang
Member/Affiliate;
- Gang Member Criteria;
How to Identify What is a Gang Related Crime/Incident;
- Gang Locations in Durham Region;
- Gang Structure: Scavenger, Territorial, and Organized;
Identifier Markings: graffiti, hand signs, tattoos, and colours/clothing; and
Motivation Factors: media, pop culture, identity, competence, protection, peer
pressure, and generational.
In closing, Detective Jones stated the Gang Enforcement Unit will continue to focus on
educating and working with the youth through the schools in the Region of Durham.
Mayor Mutton reported that on Friday, February 17, 2006 the GTA Mayors collectively
endorsed the regulating of replica and imitation firearms and encouraged all
municipalities in the Province to adopt a similar by-law. Sergeant Steve Jones and the
Durham Regional Police Services were congratulated on their work and programs
concerning replica and imitation firearms.

Sheila Hall, Clarington Board of Trade, advised prior to the meeting she would not be in
attendance. Ms. Hall will be included as a delegation at the March 6, 2006 General
Purpose and Administration meeting.

Application to Amend the Clarington Official Plan and Zoning

The Municipality of Clarington
PSD-019-06
Carlos Salazar, Manager Community Planning & Development, Planning Services,
provided a verbal report and a slide presentation pertaining to Report PSD-019-06.
Kevin Tunney, Planning and Land Management Consultant, Tunney Planning Inc.,
addressed Council in regards to Report PSD-019-06. Mr. Tunney's stated a concern
with regards to the allowed permitted space of 600 m2 as outlined in the By-law
attached to Report PSD-019-06. In closing, Mr. Tunney is requesting that Council
increase the permitted floor print size to 1200 m2.
Shirley Crago, spoke in opposition to Report PSD-019-06. Mrs. Crago stated that she
and her husband would not consider selling their property for development unless all the
land is sold as a unit. Her house is a certified first class heritage property and she does
not want to see it destroyed. Mrs. Crago requested a private meeting with staff and
Council representation to discuss this matter further.
No one spoke in support of Report PSD-019-06.

BACKGROUND
At the regular meeting held on October 17, 2005, Committee considered Planning
Report PSD-122-05 for a rezoning of land located at 114 Liberty Street South in
Bowmanville. The property is owned by Shell Canada and operated as a Beaver gas
station. It is Shell Canada's intention to clear and rebuild the existing site and operate
on a 24 hour basis. AUhe meeting staff were directed to "examine the feasibility of
hours of operations."
A Community Meeting was subsequently called by the Planning Department to
address neighbourhood concerns over the rezoning application. During the
Community Meeting there was much discussion concerning the possible 24 hour
operation of the new gas station, Shell Canada's representatives were clear that the
company's intention is to move all their facilities to 24 hour operation.
ANALYSIS
There are 24 gas stations currently operating in Clarington. Of these, 12 stations are
located adjacent to residential areas and 10 of the 24 are operating on a 24-hour basis.
Like the Beaver gas station, 5 of these 24-hour stations are located directly adjacent to
residential areas. A sixth station, currently under reconstruction at the comer of
Highway 2 and Darlington Boulevard, is believed to be preparing to operate on a 24
hour basis but that has not been confirmed.
For Council's reference, a table showing the location and hours of operation of the
currently operating stations has been attached hereto.
OPTIONS
The Municipal Act allows the local municipality to control hours of operation in two ways.
Section 148 states,
"A local municipality may require that retail business establishments be closed to
the public on all or any days of the week during any time between 6 p.m. of any
day and 5 a.m. of the next day. n
Staff have conferred with the solicitor and he has confirmed that there is no provision in
_ this section to allow any business within the class to begrandfathered or excluded from
the regulation of the hours of operation. If it is Council's wish to restrict the hours of
operation, the by-law would impact all the current 24 hour operations within the
Municipality, with the only possible exception being the Esso station because it is
located on Highway 401.

The second option to control or regulate hours of operation is through section 150 of the
Municipal Act. This is the trade licencing section of the Act which states that a local
municipality may,
"license, regulate and govern any business wholly or partly carried on within the
municipality even if the business is being carried on from a location'outside the
municipality. <<
The licencing power is limited; the municipality must justify its reasons for.licencing a
particular class or group of businesses. The only criteria to be considered are:
1. Health and safety.
2. Nuisance control.
3. Consumer protection.
If the reason for licencing a group of class of business does not fall into one of these
three categories, the by-law INould be illegal.
There are no issues of health and safety involved in this matter, nor do staff
contemplate a need for inspections related to health and safety at this time. There are
no consumer protection issues that licencing would be able to address. This leaves
only the category of nuisance control.
Although there were a number of concerns raised over noise and nuisance at the
community meeting, there is no proof of an existing problem for staff to rely on in
making a determination to licence under this category.
In the last fifteen years staff have received only four nuisance related calls involving gas
stations. These were for a misdirected flood light in the yard, a watchdog barking in the
rear of a closed station and two for the delivery of fuel overnight (both of these involved
facilities which were closed at the time of delivery). Shell Canada has indicated that
they will restrict the hours of fuel delivery to daytime hours only.
CONCLUSION
In researching this subject staff were able to find other municipalities which had
regulated gas station hours of operation under the preceeding Municipal Act, before the
requirement existed for justification of the by-law. These by-laws would have expired
shortly after the current Municipal Act came into force. We have been unable to find
any municipalities who have continued to regulate gas station hours of operation since
the current Act came into effect in 2001.

The Municipal Solicitor has confirmed that the Municipality cannot impose .licencing
. criteria on the basis of a potential or perceived problem. If the station does rebuild and
open as a 24-hour operation, staff will monitor the situation. If a significant problem
develops that can be attributed to the extended hours of operation, then the Municipality
may move to impose a licencing program to address those issues. This would require
licencing of all gas stations within Clarington.

BACKGROUND
At the meeting held on February 20, 2006, the General Purpose and Administration Committee
received a presentation from PC Todd Petzold of the Durham Regional Police Services
wherein he requested that Council pass a by-law to regulate the sale and possession of replica
and imitation firearms in the Municipality. In response to several incidents in 2005 and 2006,
the Township of Scugog has recently passed such a by-law, and it is Durham Regional
Police's wish that all area municipalities pass the same by-law.
The suggested by-law will regulate the sale, purchase and possession and use of replica and
imitation firearms. It will make it unlawful to:
. Sell a replica firearm or imitation firearm to any person who is less than 18 years old.
. Purchase a replica firearm or imitation firearm if you are younger than 18 years old
. . Possess a replica firearm or imitation firearm while on public property or on private
property to which the public has general access, if you are less than 18 years old
. Use a replica firearm or imitation firearm in a manner that is reasonably likely to cause
harm or damage to another person or property
. Use a replica firearm or imitation fire.arm in a manner that is reasonably likely to instill
fear in or intimidate any other person
Following the General Purpose and Administration Committee meeting, staff met with PC
Petzold to discuss the enforcement of the by-law. The by-law, as suggested, states that
Municipal Law Enforcement Officers shall be responsible for the administration of the by-law
and the "Officer" will be responsible for the enforcement of the by-law. "Officer" is defined as a
Police Officerand/or a Municipal Law Enforcement Officer. It is the intent that Municipal Law
Enforcement Officers will enforce the selling portion of the by-law, ie, attend at various stores
within the Municipality and speak to the manager who is selling the replicalimitation firearms,
but will not approach an individual who may be in possession of the replicalimitation firearm.
CONCLUSION
In order to assist the Durham Regional Police Services in their efforts to control the escalating
concerns with replicalimitation handguns, it is respecfully recommended that the by-law
attached hereto, which mirrors the by-law of the Township of Scugog, be passed.

BY.LAW NUMBER 2006-
Being a by-law to regulate the sale and Possession of
Replica Firearms and Imitation Firearms in the
Municipality of Clarington
WHEREAS Section 130 of the Municipal Act, 2001, S.O. 2001, c.25, as
amended, permits municipalnies to pass by-laws related to the health, safety and
well-being of the Inhabitants of the municipality;
AND WHEREAS the Corporation of the Municipality of Clarington has
determined that the purchase, sale, possession and use of Replicas of Firearms
are activities having the potential to negatively affect the health safety and well-
being of the inhabitants of the Municipality;
AND WHEREAS the Corporation of the Municipality of Clarington has
determined that the regulation of the purchase, sale, possession and use of
Replicas of Firearms is related to the health, safety and well-being of the
inhabitants of the Municipality of Clarington;
NOW THEREFORE the Council of the Corporation ofthe Municipality of
Clarington enacts as follows:
SECTION ONE - DEFINITIONS
1.1 In this by-law:
(a) "Criminal Record" means any conviction under the Criminal Code
and includes any amendments thereto; .
(b) "Firearm" means any barrelled weapon from which a shot, bullet or
other projectile can be discharged by means of rimfire or centrefire
ammunition.
(c) 'Identification" means a valid drivers license issued by the Province
lif Ontario or any other Ontario Govemment issued photo
identification.
(d) "Imnation Firearm' means any device that is designed or intended to
resemble a Firearm or Replica Firearm or may be reasonably
mistal<en as a Firearm or Replica Firearm and shall include a device
that, with limned modification, may be reasonably mistal<en as a
Firearm or Replica Firearm. .
(e) "Municipal Law Enforcement Officer" means a Municlpal Law
Enforcement Officer appointed to enforce the By-laws of the
Municipality of Clarington.
(f) "Officer" means a Police Officer andlor a Municipal Law Enforcement
Officer.
(g) "Person" includes a Person as defined in accordance with the
Interpretation Act, R.S.O. 1990, c. 1.11, as amended.
(h) "Police Officer" means a Police Constable swom in and for the
Province of Ontario and shall include a Constable of the Royal
Canadian Mounted Police.

(i) "Police Report" means a Criminallnfonnation Request received from
the Durham Regional Police Service, Ontario Provincial Police
Service and Royal Canadian Mounted Pollee Service and such
Police Report shall be current to within six (6) months.
0) "Purchaser" means the purchaser of a Replica Fireann or Imitation
Fireann and includes a Person.
(k) "Replica Fireann" means any barrelled weapon from which a shot,
bullet or other projectile can be discharged by means other than
rimfire or centrefire ammunition.
(I) "Municipality" means the Municipality of Clarington.
(m) "Vendor" means the seller of a Replica Fireann or Imitation Fireann
and includes a Person.
SECTION TWO - GENERAL REGULATION
2.1 No Person shall purchase, sell, possess or use a Replica Fireann or
Imitation Fireann in the Municipality except in accordance with this By-law.
SECTION THREE - REGULATION OF SALE
3.1 No Person shall sell a Replica Fireann or Imitation Fireann to any Person
who is less than 18 years old and continns, by way of identification, that
the Purchaser is not less than 18 years old.
SECTION FOUR - REGULATION OF PURCHASE
4.1 No person shall purchase a Replica Fireann or Imitation Fireann unless
that person confinns, by way of identification to the Vendor, to the
satisfadion of the Vendor, that the Purchaser is not less than 18 years old.
SECTION FIVE - REGULATION OF POSSESSION AND USE
5.1 No person who is less than 18 years old shall posseSs a Replica Fireann
or Imitation Fireann while on public property or on private property to
which the public has general access.
5.2 No Person shall use a Replica Fireann or Imitation Fireann in a manner
that is reasonably likely to cause hann or damage to another person or
property.
5.3 No Person shall use a Replica Fireann or Imitation Fireann in a manner
that is reasonably likely to instil fear in or intimidate any other person.
5.4 Any person who is found in contravention of Section 5 shall forthwith
surrender such Replica Fireann or Imitation Fireann to an OIlicer.

SECTION SIX - ADMINISTRATION AND ENFORCEMENT
6.1 The Municipal Law Enforcement Officer shall be responsible for the
Administration of this By-law.
6.2 The Officer will be responsible for the Enforcement of this By-Law.
SECTION SEVEN - OFFENCE
7.1 Every Person who contravenes any provision, section or paragraph of this
By-law is guilty of an offence and upon conviction is liable to a fine or
penalty for each offence, exclusive of costs, as prescribed by the
Provincial Offences Act, R.S.O. 1990, c. P.33, as amended.
SECTION EIGHT - SEVERABILITY
8.1 If a court of competent jurisdiction should declare any section of this By-
law, or part thereof, to be invalid, such section or part of a section shall not
be constructed as having persuaded or influenced Council to pass the
remainder of this By-law as having being invalid and is hereby declared
that the remainder l)f the By-law shall be valid and shall remain in force.
SECTION NINE - NON-APPLICATION
9.1 This By-law shall not apply to the possession or use of a Replica Fireann
or Imitation Fireann for, or in connection with, the lawful use thereof in
motion pictures, television and stage productions, the historical displays or
educational programs of a public museum or duly constituted sporting
events.
SECTION TEN - SHORT TITLE
10.1 The short title of this By-law shall be the 'Replica Fireann By-law'.
SECTION ELEVEN - DATE EFFECTIVE
11.1 This By-law shall come into effect on the day of its passing.
By-law read a first and second time this 20" day of March 2006.

RE: REALLOCATION OF FUND FOR PHYSICIAN RECRUITMENT
WHEREAS the Clarington Physician Recruitment Committee has put forth a
recommendation to Council to re-aIIocate $38,000. of the fund that was set aside for
Organization Consulting Ltd. to recruit physicians;
WHEREAS the Committee advised staff that the Consultant in unlikely to recruit the
expected number of physicians at the conclusion of the contract at year end;
WHEREAS the Committee requested the said fund to be used to hire a part-time
administrative person to assist in the recruiting process and that the said fund be
administered through the Clarington Board of Trade;
NOW THEREFORE, Council resolve that $38,000 of the remaining fund for the
physician recruitment consultant be re-aIIocated to the Clarington Board of Trade for the
purpose of assisting in the physician recruitment effort.

Clarington Physician Recruitment Committee

Mayor Mutton and members of Council,
Physician shortages are a province wide epidemic and a challenge that will be solved by
individual communities with a proactive and visionary strategy in place. As Chair for the
Clarington Physician Recruitment Committee I applaud you for taking a proactive approach
and thank council for your support over the past year.
Our committee is a true testament to the value of partnership - we are led by a progressive
Council with equally enthusiastic participation from our local medical community, the
Municipal organization, the business community and our residents.
The task of recrniting doctors to our community is complex and competitive in nature, with
726 Family Physicians needed in Ontario, and 11 of those needed in Clarington. While it may
seem we are asking for a very small percentage of a large pie, the task is challenging and the
competition throughout Ontario is fierce. Therefore we have to ensure that we are ready with
all our wheels in motion for prospective doctors.
Since our committee's creation in February 2005, we have built partnerships with
organizations across Canada and in our own community that are assisting us. We have
developed a list of candidates from various medical learning facilities. Working with the
consulting firm Organizational Consulting Limited has heightened our awareness of national
and international markets that we would not have had the resources to explore.
Now, it is time for our committee and also the Municipality of Clarington to learn from our
experiences over the past year, and secure ownership of the process to ensure our ongoing
success - not only in recrnitment of family doctors, but also retention.
We have learned the most successful model for both attraction and retention is to "catch them
in the cradle and keep them to the grave." With the commitment from our hospital and
medical staff, to provide teaching and residency opportunities to students we have a natural
flow for our primary target market.
Our committee's successful recruitment of Dr. Lottering, who now has a full practice out of
the office of 222 King Street has been a great motivator for our efforts.
Statistics show:
. That in Ontario 13% of the current population is over 65. The elderly population is
expected to double by 2016, this will increase time per patient and, therefore
increasing our need for additional doctors.
. One in 5 doctors will retire in the next 5 years across Ontario, increasing our need for
retention in our community to avoid depletion in Clarington.
. The number of new doctors graduating will be less than the number of doctors retiring.
. Every doctor that comes to our community brings $500,000 to $1,000,000 of
economic activity to our community each year.
In addition, we now know:
. There are several job fairs and conferences that will connect us with the medical
students and residences across Ontario, and our committee must be in attendance
representing Clarington with a strong presence.
· That our best resource for referrals is through Lakeridge Health, our existing doctors
and their affiliation with the University of Toronto's teaching program
. Physician recruitment is truly a community initiative, and existing physicians are the
golden key to the continued success of physician recruitment in Clarington.
. It is a very labour intensive process to ensure that proactive and ongoing
communication with potential recruits is being maintained and that the coordination
of community and hospital visits continue to meet the needs of prospective doctors to
ensure we reach our primary goal.
. Although the combined efforts of the consulting firm, the Clarington Physician
Recruitment Committee and Lakeridge Health staff have moved us farther along in the
process, we are still lacking a cohesive system to ensure our success - a means by which
we can take a proactive and not a reactive approach to recruitment and retention.
In February 2005, council allocated $131,000.00 for the hiring of a consulting firm,
Organizational Consultants Limited to provide us with a strategic planning document and
bring doctors to Clarington - to-date 35% of these funds have been expended to OCL. The
balance of monies will be paid to the consultants based on their success in recruiting and
signing doctors to Clarington.
The Clarington Physician Recruitment Committee has evaluated our current position in our
recruitment strategy and puts forth a recommendation for Council to re-allocate $38,000.00
of the remaining funds to the Committee. These funds will be used to hire a dedicated part-
time community co-ordinator inclusive of expenses as noted in the budget attached - to
ensure we can continue our proactive recruitment tactics.
The Clarington Board of Trade will administer the reallocated funds and provide the
resources for a part-time person dedicated to assist in the recruiting process. This solution
will provide for ample funds for us to fulfill our remaining contractual obligations with
Organizational Consultant Limited, while providing the homegrown solution to put in place a
system to pull together our valuable resources without affecting the budget process for 2006.

In closing:
The shortage of doctors touches all people in Clarington, through office and hospital wait
times as well as the spin off economic factors that a physician effects in our community. With
the partnerships and knowledge we have developed over the past year, this committee and
community has the strength to encourage success in attracting doctors here for all residents.
Accepting our recommendation will take us one step closer to this goal.
As chair of this committee I am very proud of the dedication to our efforts by our community
and business representatives and would like to extend a special note of thanks to Dr. Tony
Stone, Dr. Debbie Jefferson and this council for your key roles in this essential project in
