Gray Director of Public Works W. A. Evans Acting Director of Community Services, J. Caruana Fire Chief, J. Aldridge Deputy Clerk, R. Rutledge Councillor Hubbard chaired this portion of the meeting. Councillor Hubbard introduced Walter Evans, the Town's new Director of Public Works. Public Hearings Proposed Zoning By-law Amendment, Part Lot 11, Concession Broken Front, former Town of Bowmanville, Olive Vaughan The Chairman announced the purpose of the public meeting. As required under the new Planning Act (Section 34(12), Council is holding a public meeting prior to either adopting or rejecting the proposed zoning by-law amendment for Part Lot 11, Concession B.F., former Town of Bowmanville. The Chairman asked if there were any persons present wishing to speak to this matter. Several persons indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Clerk to advise on the manner of notice. The Clerk advised that: a) Public notice was mailed to property owners within 120m of the subject property on October 29, 1987; b) Notice of the public meeting was posted on the property by November 6, 1987; . . . . The Chairman announced that any person wishing further notice of the passage of the by-law, if passed, to please leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning to briefly describe the purpose and effect of the by-law, and how the by-law accomplishes the stated purpose. The proposed zoning by-law amendment would change the zone category of a 0.14 ha parcel of land in Part of Lot 11, Concession B.F., former Town of Bowmanville, from "Residential Shoreline (RS)" to an appropriate zone to permit the development of a second dwelling. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-law, and that all questions must be asked through the Chair. No questions were asked. The Chairman announced that Committee would now hear from objectors, first explaining that Council wishes input prior to a final decision. Mr. Gordon White, P.O. Box 100, Bowmanville, L1C 3K8, on behalf of himself, his wife June and his uncle John Fox, objected to the proposal to rezone the subject lands to permit the development of a second dwelling. During his presentation Mr. White displayed placards outlining the development of the area from 1916 to present day. When the land was sold by his grandfather, one of the clauses stated that the purChaser would not erect or permit to be erected more than one cottage to each deed. If allowed this non-conforming use would be condoned. Douglas Lomas, Box 39, R.R. 2, Bowmanville, L1C K2, submitted a written objection opposing the 2nd dwelling. He believes it will open the way to other similar proposals. A letter was received from Robert Carr, 116 Cove Road, R.R. 2, Bowmanville, L1C 3L1, His father was aware that an over- concentration of units would occur, that was the reason for the clause in the deeds. This proposal is a breach of trust of the sale. He is concerned with the large concentration of sewage on a small piece of land. The Chairman announced that Committee would now hear from the supporters. Mrs. Olive Vaughan, 29 Woodlawn Ave. E., Toronto, asked~that Committee consider allowing the building to remain. The main cottage is not winterized, because it would be too expensive to do so. This building was erected and winterized for the families use only in the winter. Both units would not be used at the same time. A petition signed by area residents G.P.A. Minutes . Public Hearings - 3 - December 7, 1987 stating they have no objection to this proposal was submitted. Mrs. Vaughan is willing to sign any paper that would allow her to retain the building as a storage area. The building replaces a previous building. The Chairman concluded the public meeting. ***************************************** . Proposed Zoning By-law Amendment, Part Lot 28, Concession 5, former Township of Clarke, Hartwig, Henderson & Spracklin The Chairman announced the purpose of the public meeting. No questions were asked. The Chairman announced that Committee would now hear from objectors, first explaining that Council wishes input prior to a final decision. Mr. Leonard Guy, 5909 Main Street, R.R. 2, Orono, LOB 1MO, read from his prepared statement opposing this proposal. Mr. Guy outlined the inconveniences caused him and his family as a result of the heavy vehicles being parked on the subject lands and the noise and vibrations when they are started. He outlined his attempt to have the present zoning by-law enforced. In conclusion Mr. Guy asked that this proposal be denied. Horace Best, 5800 Main Street, R.R. 2, Orono, LOB 1MO, read from his prepared statement opposing this proposal. To achieve protection to landowners, Official Plan and Zoning By-laws are put in place. Allowing this proposed land use fails to give this protection. The applicants were aware of the zoning when they purchased the lands. If this type of application is approved, then the residential only use of land would undergo a drastic change and could start a precedent in other residential areas as well. Irwin Hamilton, Solicitor, Hamiton & Bellefontaine, 43 Ontario Street, Bowmanville, retained by the Guy's Sherwins and Quantrills, spoke on the planning issue. Mr. Hamilton supports the Planning Department's recommendations to deny. The trend to deregulate the trucking industry will result in a large number who will want to park their trucks at home. Residential and trucking industries are not a good mix. Can't find any zoning category in the by-law that would permit this development. Each applicant was aware of the residential zoning prior to purchasing the land. The zoning process has been used as a method of delaying the enforcement of the zoning by-law. The Town's enforcement poliCY has aggravated this situation. Mr. Hamilton asked the Committee that if they decide to table this application that enforcement of the by-law infraction be discussed. If no enforcement takes place until the zoning matter has been accomplished, several months could lapse. A letter of objection was received on behalf of the Board of Directors of the Orono Cemetery Board. The Chairman announced that Committee would now hear from the supporters. Peter McCullough, 5977 Main Street, Orono, supports this proposal. He has built a new home adjacent to Mr. Hartwig's lot and has not had any problems. He does not feel his property has been devalued. Noise from the trucks has not been heard by him. G.P.A. Minutes - 5 - December 7, 1987 . Public Hearings Bob Stevens, R.R. 3, Bowmanville, spoke on behalf of the Hartwigs. He described the Hartwigs as sound and law-abiding citizens. The home they have erected on their 2 acre parcel is beautiful and has bettered the area. The Hartwigs have always operated a small construction business. A petition from the area residents supporting this proposal was received. The Chairman concluded the public meeting. ******************************************* Delegations Resolution #GPA-916-87 . Moved by Councillor Wotten, seconded by Councillor McKnight THAT the following persons be added to the Agenda under delegations: D. G. Biddle; Darlene Cook; James Barr; Herman Kleinenhuis; Mr. Shaeffer. "CARRIED" Michael Armstrong, Solicitor, McGibbon, BAstedo, Armstrong & Armstrong, P.O. Box 2396, 32 Simcoe Street South, Oshawa, Ontario, L1H 7U6, Re: Planning Report PD-299-87 (DEV 87-86) asked that this not be deemed an extension of a previous plan. He supports the referral to staff for processing a public hearing. Michael Armstrong, also spoke on his request to Council on November 23, 1987, on behalf of 591415 Ontario Limited (Townline Estates). He was under the impression the proposal was to go before the next Council Meeting. A report is to be submitted to Council on Monday. . Arlene Bonsma, R.R. 2, Newcastle, presented another petition requesting the Town to petition the Ministry of the Environment to extend the Town Water Line to resolve their ongoing water problems. The extension. requested is on North Street, Village of Newcastle. The famILies affected cannot drink the water from their wells. They are getting water from Town, springs or purchasing it. D. G. Biddle, of D. G. Biddle & Associates Limited, 96 King St. E., Oshawa, L1H 1B6, on behalf of Townline Estates, requested permission to use the names "Prince Rupert Drive" and "Lord Duncan Court" as street names in their plan. The Town's Policy is to select names of local historical importance. This is difficult because most names have been used. The two names selected are of national historical importance. . . . . . G.P.A. Minutes - 6 - December 7, 1987 Delegations Darlene Cook, R.R. 1, Enniskillen, LOB 1HO, spoke in opposition to the proposed changes to the Noise By-law, imposing curfews for licenced kennels. Allowing dogs to bark until 11:00 P.M. and for an hour is excessive, when small children are involved. Her children require more than 8 hours of uninterrupted sleep. They are put to bed around 8:30. With this change,dogs could bark for an hour brought in for a few minutes - let out again to bark for another hour. Only the kennel operators gave input to the report. The general public was not invited to sit on the committee. Mrs. Cook asks that the By-law remain as is. James Barr, R. R. 1, Enniskillen, requests that any decision on the amendment to the Noise By-law, be deferred until the end of January, so everyone will have an opportunity for input. Mr. Barr does not feel it needs to be amended. Herman Kleinhienhuis, R. R. 1, Enniskillen, supports a deferral of the proposed amendment to the Noise By-law. Roger Wilson, Reeve, Hope Township, 72 Walton Street, Port Hope; presented a proposal to the Committee relating to an energy and waste proposal. With Mr. Wilson were Clerk, Fran Aird, Leila Unger and Robert Hryniak, President of Canada Capital Corporation Ltd. Hope Township would like to obtain a preliminary waste commitment letter from the Town of Newcastle.
