Removal of (H) Holding Symbol - Kingsberry Properties
Part Lot 35, Concession 2, former Township of Darlington
The Chairman announced the purpose of the public meeting.
TAKE NOTICE THAT the Council of the Corporation of the Town of
Necastle intends to pass an amending by-law under Section 35
of the Planning Act to remove the holding provision from
lands within Part of Lot 35, Concession 2, former Township
of Dalrington, from "Holding - Urban Residential Type One
((H)Rl)" to "Urban Residential Type One (Rl)."
The "(H)Rl" Zone permits existing Residential and
Conservation, Forestry and Farm uses exclusive of livestock
operation uses. Removing the holding symbol from the
"(H)R1) Zone would permit the development of thirty-four
(34) urban residential lots.
The Council of the Corporation of the Town fa Newcastle will
consider the proposed amending by-law not earlier than at its
General Purpose and Admi ni strati on Commi ttee MeEting of
Tuesday, September 8. 1987, and consider passing a by-law
not earlier than Mcnday, September 14, 1987.
The Chairman asked three times if there were any persons
present wishing to speak to this matter. No r,erson indicated
a desire to speak.
The Chairman concluded this portion of the Public Meeting for

Removal of (H) Holding Symbol - F. W. Jose,
Part Lot 26, Concession 1, former Village of Newcastle

The Chairman announced the purpose of the Public Meeting.
TAKE ~OTICE THAT the Council of the Corporation of the Town of
Newcastle intends to pass an amending by-law under Section 35
of the Planning Act to remove the holding provision from
lands within Part of Lot 26, Concession 1, former Village of
Newcastle from "f-:olding - Urban Residential Type One ((H)R1)"
to "Urban Residential Type One (R1)."
The "(H)R1" Zone permits existing Residential and Conservation,
Forestry and Farm uses exclusive of livestock operation uses.
Removing the holding symbol from the "(H)R1" Zone would permit
the severance of an existing dwelling from an active farm
operation.
The Council of the Corporation of the Town of Newcastle will
consider the proposed amending by-law not earlier than at
its General Pur~ose and Administration Committee of Tuesday,
September 8, 1987, and consider passing a by-law not earlier
than Monday, September 14, 1987.
The Chairman asked three times if there were any persons
present wishing to speak to this matter. One person indicated
a desire to speak.
Francis Jose, R.R. '3, Newcastle, LOA 1HO, spoke on behalf of
his brother Douglas Jose. Douglas Jose has submitted an
application for a land severance. Removal of the Holding
Symbol is necessary to allow the severance.
The Chairman concluded this portion of the public meeting
for removal of the (H) Holding Symbol.

Proposed Hamlet Development Plan Amendment and a Proposed
Rezoning - Part Lot 20, Concession 8, former Township of
Darlington - Linda Sweet
The Chairman announced the purpose of the Public Meeting.
As required under the new Planning Act (Section 34(12),
Council is holding a public meeting prior to either adopting
or rejecting the proposed zoning by-law amendment for Part
of Lot 20, Concession 8, former Township of Darlington.
The Chairman asked if there were any persons present wishing
to speak to this matter. Two persons indicated a desire to
speak to this amendmeat:-

Clerk to advise on the manner of notice.

The Clerk advised that:

a) Public notice was mailed to property owners within 120m of
the subject property on August 4, 1987;
b) Notice of the public meeting was posted on the property
by August 7, 1987;
c) The Notice complies with the regualtions under the
Planning Act.
The Chairman announced that any person wishing further notice
of the passage of the by-law, if passed, to please leave their
name, address and telephone number with the Deputy Clerk
before they leave.
The Chairman called on the Director of Planning to briefly
describe the purpose and effect of the by-law, and how the
by-law accomplishes the stated purpose.
The proposed Hamlet Development Plan Amendment would amend the
Enniskillen Hamlet Development Plan by increasing the maxiumum
number of lots permitted on an 8.44 ha parcel of land in Part
Lot 20, Concession 8, former Town~hip of Darlington (Enniskillen)
from "two (2) lots" to "three (3) lots."
The proposed zoning by-law amendment would change the zone
category of the subject lands from "Agricultural (A)" and
"Environmental Protection (EP)" to an appropriate zone to
permit the development of the proposed three (3) new
residential lots.
The Chairman announced that questions may be asked concerning
the manner of notice or the purpose and effect of the by-law,
and that all questions must be asked through the Chair. No
questions were asked.

The Chairman announced that Committee would now hear" from
objectors, first explaining that Council wishes input prior
to a final decision.
Carl Ferguson, R. R. 1, Enniskillen, did not object to the
proposal, however, he irjquired about the access. Access is
proposed from Regional Road 3.

Steve Nimigon, R. R. 1, Enniskillen, voiced his concerns
relative to the area water supply and the Health Unit's comments.
Mr. Nimigon heard that water testing was to take place.
The Health Unit recommends that the applicant submit a
detailed development proposal with cross sectional diagrams.
The Chairman announced that Committee would now hear from
the supporters.
The applicant was present to answer questions. No questions
were asked.
The Chairman concluded the Public Meeting.

Plan Amendment - Part Lot 14, Concession 8, former

The Chairman announced announced the purpose of the
Public Meeting:
As required under the new Planning Act (Section 34(12),
Council is holding a public meeting prior to either adopting
or rejecting the proposed zoning by-law amendment for Part
of Lot 14, Concession 8, former Township of Darlington.
The Chairman asked if there were any persons present wishing
to speak to this matter. No person indicated a desire to
speak to this amendment.
Before proceeding with this matter, the Chairman asked the
Clerk to advise on the manner of notice.
The Clerk advised that:
a) Public Notice was mailed to property owners within 120m
of the subject property on August 4, 1987. A revised

c) The Notice complies with the regulations under the
Planning Act.
The Chairman announced that any person wishing further notice
of the passage of the by-law, if passed, to please leave

The Chairman called on the Director of Planning to briefly
describe the purpose and effect of the by-law, and how the
by-law accomplishes the stated purpose.
The proposed Hamlet Plan Amendment would extend the boundaries
of the Hamlet of Haydon to include a 2.72 hectare parcel of
land in Part of Lot 14, Concession 8, former Township of
Darlington to permit the development of 6 additional
residential lots.
The proposed zoning by-law amendment would rezone the
subject lands from "A-1 Agricultural" to an appropriate zone
to permit the development of the proposed lots.
The Chairman announced that questions may be asked concerning
the manner of notice or the purpose and effect of the by-law,
and that all questions must be asked through the Chair. No
questions were asked.

The Applicant, Doug Porter, R. R. 2, Bowmanville, presented
a board containing photos of the existing houses and the
vacant lot which he proposes to sever. Access can be obtained
from Rundle Road. The lot size is compatible with the
surrounding lots. The Planning Department does not
recommend approval because the porposal does not conform
with the policies of the Region of Durham Official Plan.
The Chairman concluded the public meeting.

The Chairman announced the purpose of the Public Meeting.
As required under the new Planning Act (Section 34(12), Council
is holding a public meeting prior to either adopting or
rejecting the proposed zoning by-law amendment for Part of
Lot 25, Concession 2, former Township of Darlington.
The Chairman asked if there were any persons present wishing
to speak to this matter. Several persons indicated a desire
to speak to this amendment.
Before proceeding with this matter, the Chairman asked the
Clek to advise on the manner of notice.
The Clerk advised that:
a) Public Notice was mailed to property owners within 120m
of the subject property on August 4, 1987;

The proposed zoning by-law amendment would change the zone
category of a 4.8 ha parcel of land in Part of Lot 25,
Concession 2, former Township of Darlington, from "Agricultural
(A)" to "Rural Cluster (RC)" to permit the development of one
additional residential lot.
The Chairman announced that questions may be asked concerning
the manner of notice or the purpose and effect of the by-law,
and that all questions must be asked through the Chair. No
questions were asked.
The Chairman announced that Committee would now hear from
objectors, first explaining that Council wishes input prior
to a final decision.

Frank Hill, Group 17, Box 5, R.R. 3, Bowmanville, L1C 3K4,
opposes the rezoning of the subject lands. He is concerned
the lands may be further subdivided. There is an active
chicken farm in close proximity.
Neil Tonkin, Nash Road, R. R. 3, Bowmanville, L1C 3K4,
is opposed to the rural cluster. His neighbour has been
without water. Additional homes may affect him similarly.
Paul Bellefontaine, Hamilton & Bellefontaine, 43 Ontario Street,
Bowmanville, on behalf of Mr. Austin, spoke in opposition to
this proposal. Mr. Austin has 15 chickens and would like to
expand his operation. He is afraid he won't be able to if
the severance is allowed. Water problems exist as well as
pothole problems. These are legitimate concerns to address.
The Chairman announced that Committee would now hear from
the supporters.

John Caruso, 525 Wilson Rd. S., Dshawa, spoke on behalf of
his father, Francisco Caruso. Mr. Caruso would like to build
a new house on the property. The existing house is presently
rented. The Caruso's and Spenas wish to divide the property
eventually. They have owned the lot for 4 years.

L1C 3K3, Re: Report PD-213-87. Mrs. Cowie requests that
Huntington Drive in the Whitecliffe Plan of Subdivision be
renamed "Robert Adams Drive." She is aware of the problems
concerning a road name change. However, three generations
farmed the subject lands.
Charles Campbell was not present.

John Nekkers, Group 12, Box 11, R.R. 3, Bowmanville, stated
that he was satisfied with Report PD-217-87.
Don Samis, 1794 Highway No.2, R.R. 6, Bowmanville, Re:
Report PD-194-87 voiced his objection to development east of
Courtice Road in the urban area. He bought his lands 18
years ago to be in a farming area. The area is environmentally
sensitive and prime farmland. Development needs to slow down.
Barbara Mansfield, 82 Varcoe Road, R.R. 3, Bowmanville, Re:
Report PD-217-87 voiced her concerns and opposition. The Report
and Notice of Meeting should be sent to a number of people.
Considering the water problems that have had to be dealt with
in Courtice lately, no increase in the population in the
Courtice area should be encouraged. The classrooms are full
to capacity. Mrs. Mansfield opposes land use Re: designations
and road patterns that change wood lots and opposes the
proposal to'change Varcoe Road and Tooley Road into Collector
roads.
Ken Smith, R.R. 5, Bowmanville, Re: Report PD-194-87 opposes the
redesignation of farmland for residential use. Farmers should
not be forced out of their business. Newcastle pays the
highest education taxes. Development must be put on hold
until the Town attracts more industrial development.
Kathy Harrison, Jones & Jones, 130 King S.t E., Oshawa, on
behalf of Jarigay Investments, did not make a presentation.
Mary McAlpine, R.R. 1, Hampton, Re: Report PD-205-87, asked
that her amendment be approved. Mrs. McAlpine wishes to give
her son a lot so he can be near to assist her. Her proposal
will not interfere with anyone. She is 60, widowed and lives
by herse I f.
