Campbell, Resolution #GPA-155-82 Moved by Councillor Prout, seconded by Councillor Hamre THAT the minutes of the meeting of February 8, 1982 be approved as read. "CARRIED" Mr. McCowan, representing Mr. D. J. Plitz, told the Committee that his principles supported the recommendation in Report PD-29-82, relative to the Newcastle Shoreline Subdivision Agreement Mr. J. Bolahood spoke to the Committee regarding a 6 acre parcel of land on Mearns Avenue. He was not in agreement with the recommendation in Report PD-25-82 that application for a site plan approval be denied. He stated that he had been unable to have the property zoned for 3 2-acre estate lots and was now applying for a site plan approval for light industrial. He asked what his position was with regard to obtaining a permit for one house on the property. Mr. Cowell was not present. Mr. Bagnell made a further submission to Committee regarding the updating of sewers and the road surface on Scugog Street from King Street to the C.P.R. tracks. He spoke of the markings on Scugog at King which he felt were inadequate to release the west bound flow of traffic and the above grade condition of the railway crossing. He urged the Town to undertake the reconstruction of the road, this year. G.P.A. Minutes . John Wi nters Rezoning . Executive Secretary to Mayor re Job Description Recess . Purchasing & Supply Agent - Treasury Department - 2 - February 22, 1982 Mr. John Winters spoke to report PD-26-82, which recommended the denial of application for rezoning Z-A-2-13-5. He felt that the present road was of adequate width and well maintained, and one additional house would not overload it. He had worked with the Mini stry of Natural Resources and C.L.O.C.A., regarding erosion prevention, and was prepared to maintain what had been done. He felt the comments of the Ministry were based on a general study of the lakeshore and were based on a projection over 100 years, and the fact that there was no protection. He has installed protection and feels the situation should be reassessed. He believes erosion is not a problem and, denying one house will not solve the problem. . He stated that: 1. His application is in conformity with the Official Plan. 2. He is not setting a precedent which will result in more new construction. 3. Additional assessment will mean more revenues for the Town to help maintain the road and; 4. New building will add to the rejuvenation of the lake front. He had taken his own public opinion poll and had obtained 65 names on a petition in favour of his rezoning. Resolution #GPA-156-82 Moved by Councillor Hamre, seconded by Councillor Taylor THAT the recommendations in Admin 82-13 be endorsed, and 1. Report Admin 82-13 be received; and 2. Committee approve the attached description for the position of "Executive Secretary to the Mayor"; and 3. Committee forward the attached by-laws to Council for approval, giving effect to (2) above and confirming Mrs. M. Reid in the position of "Executive Secretary to the Mayor." Report PD-26-82 be received; and 2. That application for rezoning Z-A-2-13-5 affecting Part of Lot 8, B.F. Concession, Bowmanville, be denied due to non-conformity with the provisions of the Durham Regional Official Plan and due to the site's location within the 100 year erosion limit of Lake Ontario and the severe erosion problem which presently exists along this section of shoreline. . . . That the attached by-law authorizing the execution of an agreement between Newcastle Shoreline Properties Limited and The Corporation of the Town of Newcastle be passed; and 4. That the Town CLerk and Mayor be authorized to execute the subject Subdivision Agreement upon payment of all monies due under the terms of the Subdivision Agreement and upon final O.M.B. approval of the implementing zoning by-law number 81-66. That Report PD-30-82 be received; and 2. That staff be authorized to advertise the proposed modification to the Official Plan for the Bowmanville Urban Area as identified on Attachment 1 to staff Report PD-30-82; and 3. That Council approves the proposal to extend the watermain on Boulton Street in the Village of Newcastle and the Regional Municipality of Durham be advised of the Town's interest in the provision of water to service the Municipally owned lot; and 2. That provision to cover the total estimated cost of the extension to the water service, in the amount of $5,055.95 (Five thousand and fifty-five dollars and ninety-five cents), be made in the 1982 budget. "CARRIED" Resolution #GPA-176-82 Moved by Councillor Hubbard, seconded by Councillor Prout THAT the recommendations in WD-12-82 be endorsed; and the following resolution be forwarded to Council for approval: "THAT WHEREAS the Ministry of Transportation & Communications has identified numerous sources, within the Town of Newcastle, from which aggregates may be drawn during the performance of the contract to reconstruct certain sections of Highway 401 and Highway 35/115; and WHEREAS the transportation of aggregates may incur an impact on Municipal Roads and the environment; and WHEREAS the Ministry of Transportation & Communications has indicated that any roads which suffer a detrimental impact as a result of being used as haul routes shall be maintained in, and restored to, a condition satisfactory to the Municipality; BE IT RESOLVED THAT the Town of Newcastle approves the proposal of the Ministry of Transportation & Communications relative to the sources and transportation of aggregates to be utilized in highway reconstruction during 1982, subject to there being no financial or environmental impact on the Municipality either during, or at the completion of, the contract; and BE IT FURTHER RESOLVED THAT, upon the determination of the specific sources of aggregates to be used, and the establish- ment of the haul routes therefrom, the Town of Newcastle and representatives from the Ministry of Transportations & Communications and the Ministry of Natural Resources, meet to assess the original condition of those Municipal roads involved and, further, that the Town of Newcastle monitor and report on the impact thereon during the performance of the contract." That the Town of Newcastle submit an application to the Canadian TRansport Commission for the installation of automatic protection devices at the C.P. Rail Crossing located in Lots 22 & 23, Broken Front Concession, former Township of Clarke; and 2. That the Town's portion of the costs be included in the 1983 Capital Forecast; and 3. That staff be authorized to install advance warning signs on all three approaches to the crossing as an interim safety measure. That in accordance with provision of Section 220(i) of the Municipal Act R.S.O. 1970 as restated, in part, below: "The Treasurer shall receive and safely keep all money of the Corporation and shall payout same to such persons and in such manner as the laws of Ontario and the By-laws or Resolutions of the Council direct." The Treasurer reports to Committee that the cash position of the Town of Newcastle for the month ended January 1982 is as shown on the attached schedule; and 2.
