THAT the minutes of the meeting held on March 8, 1982,
be approved as read.

Delegations
Mr. Robert Hewines, the Plantario Group, representing
Danarus Management spoke to the Committee in support of
the recommendation in Report P-167-81, and asked the
Committee to approve the Newcastle Urban Area Plan and
forward it to the Region of Durham so that Subdivision
18T-81008 could proceed.

Mr. Murray Paterson representing the Newcastle B.I.A.,
and Chamber of Commerce, asked the Committee not to
approve the recommendation in Planner's Report P-195-81,
and the Village of Newcastle Urban Area Plan be amended
to include access from the south west quadrant into the
core of the Village. He stated that the Ganaraska
Conservation Authority had no objection to a connection
by means of a culvert. He asked that all sections be
tied into the main core.
H. Abernethy
Mr. H. Abernethy presented Committee with information
relative to an application which he had made for an F/M
Radio Station in Cobourg, which would include the Town
of Newcastle in its coverage. He said that he would
appreciate the support of Council in this matter.

Mr. Robert Gordon presented a petition from
residents in the area of the Dominion Store Plaza.
They were objecting to an application to the
Committee of Adjustment for a Minor Variance, which
would allow an extension of 4 additional stores with
apartments above. He spoke of the present problems,
too little parking, insufficient sideyards, limited
access for delivery trucks, litter and lack of
maintenance of the present property.
Mr. Jasper Holliday, spoke for Frank and Alice
Hayward in support of restricted area by-law 81-124,
Special Purpose Commercial nodes, Courtice. He
stated that 7 out of 9 owners support the by-law,
particularly the matter of land consolidation. He
commended staff and Council for addressing the
concerns of the residents.
Mr. Devon Biddle, spoke on behalf of Mr. Paul Gearing,
relative to report PD-43-82, proposed Official Plan
Amendment for part of Lots 32 & 33, Concession 3,
Darlington. He disagreed with the recommendation that
only that portion of his land east of Tooley's Road be
designated. He felt that his total proposal should be
included. He advised that the land was not high quality
agricultural land because of its stony nature. He asked
Committee to refer the matter back to staff for
consideration before it is sent to Council for approval.

financing of the Baseball Program. (The application
for a grant was submitted in November).

Affairs and Housing for approval as soon as possible; and
4. That Report P-166-81 which relates to a Subdivision
proposal by Danarus Management Ltd., and Report P-167-81
which relates to a subdivision proposal by Wilswar Enterprises
Ltd., be lifted from the table and dealt with at this time.

THAT Report PD-32-82 be endorsed; and
1. That Report PD-32-82 be received; and
2. That the draft amending by-law attached to this
report be forwarded to Council for approval; and
3. The following resolution be forwarded to Town Council
for adoption and for submission to the Ontario Municipal
Board along with by-laws 81-123, 81-124, and 81-125, and
the amendments thereto.
"WHEREAS the Council of the Corporation of the Town of
Newcastle has approved by-law 81-123, 81-124, 81-125, in
order to provide zone provisions consistent with the
Special Purpose Commercial Node designation delineated by
Amendment 12 to the Darlington Official Plan.
AND WHEREAS the Town is satisfied that the amending
by-laws, attached to this report, will bring by-laws
81-123, 81-124, 81-125, into conformity with the
applicable policies of the Durham Regional Official Plan;
AND WHEREAS the aforesaid by-laws amending by-laws
81-123, 81-124, 81-125, have been approved by Council
of the Town of Newcastle.
BE IT NOW THEREFORE RESOLVED that the Corporation of the
Town of Newcastle hereby requests the Ontario Municipal
Board to provide direction to the Town of Newcastle in
respect of the circulation of the subject amendments to
by-laws 81-123, 81-124, 81-125; and, if favourably
disposed, to dispense with the circulation requirements
for said amending by-laws due to the Special
circumstances involved. Furthermore, the Corporation of
the Town of Newcastle requests the Ontario Municipal
Board to approve by-laws 81-123, 81-124, 81-125, as
amended, notwithstanding the outstanding objections to
said by-laws, and to convene one public hearing in
respect of by-law 81-123, 81-124, 81-125, and the
respective amendments thereto, at their earliest possible
opportunity; and further, hereby authorize Town staff
and/or the Town Solicitor to represent the Municipality
at any such hearing that may be convened.

amended to include an extension of the Collector
Road in the southwest quadrant of the urban area,
across the Foster Creek to a suitable point on
Baldwin Street.

THAT the recommendations in Report PD-40-82 be
endorsed, and
1. Report PD-40-82 be received; and
2. That the by-law be approved authorizing the Town
Clerk or Solicitor to submit applications to
the proper Registrar for registration of the lands
described in Schedule "A" to the by-law pursuant
to Section 31 of the Land Titles Act, R.S.O. 1980
for confirmation of boundaries pursuant to Section
3 of the Boundaries Act, R.S.O. 1980; and
3. That an application be submitted to the
Director of Titles pursuant to Section 59(2) of
the Land Titles Act, R.S.O. 1980 for financial
assistance in respect of the costs of the
survey for of the area to be registered
pursuant to Section 31 referred to in 2 above; and
4. That the Town Treasurer review the costs to be
borne by the municipality as a result of the
subject application, less any subsidy approved
in respect of same, and report back to Council
on the appropriateness of a special levy being

access across Town lands, to Scugog Street in
lieu of access to Ormiston or Temperance Streets.

1. Report Admin 82-19 be received and discussed "in camera".
2. The Town offer to purchase the Registry Office property from
the Region of Durham at a maximum of $l16,000,00;

3. On completion of the conveyance to the Town, the Town proceed
to re-zone the property to allow a maximum of 55 senior citizens
units (at a maximum building height of 35 feet);
4. The Town advise the Canadian Order of Foresters that a site
plan aqreement with the Municipality will be required and that
an application for such an agreement should be made as soon as
possible;
.
5. The Town investigate with the Canadian Order of Foresters and the
Provincial Ministries of Culture and Recreation and Community and
Social Services, the possibility of obtaining financial assistance
under the Community Centres Act and/or the Elderly Persons Act by
including senior citizens facilities within the design of the
buildi ng;
6. Council authorize the Chief Administrative Officer and the Town
Solicitor to complete the conveyance as soon as possible;
7. On completion of the conveyance that the Province be requested to
immediately re-locate the Land Registry Offices within the main
central area of Bowmanville.
