BE: ZONING BY LAW AMENDMENT
RESTRICTED INDUSTRIAL USE
1. TERMS OF REFERENCE
July 27, 1973.

In accordance with the instructions received from Mr. Best on
July 13, 1973, we have prepared the attached Zoning By-law Amend-
ment.
THE PROPOSAL
The proposal is to have a site on the westerly side of County
Road No. 8, between the Canadian Pacific Railway and the Canadian
National Railways, zoned as Special Industrial, "M1-1", which would
permit the use of the site for an industrial building, subject to
restrictions concerning water intake and discharge.
3. THE PRESENT OFFICIAL PLAN AND ZONING BY-LAW DESIGNATIONS
The Official Plan presently designates the site "Rural". Should
the proposed By-law Amendment be passed, the Special Industrial Zone
would not conform to the Official Plan as it exists. Therefore, we
recommend changing the Official Plan, to designate the site "Indus-
trial". Since the Official Plan has not yet been approved, this
can be done without going through the formal process of an amendment.
The Zoning By-law presently zones the site "Agricultural (A)
Zone".
4. DISCUSSION
The attached draft Restricted Area (Zoning) By-law Amendment
zones the subject lands in a special Industrial category, 1IM-111.
This category allows an industrial building on the site, subject to
provisions restricting water intake and discharge. With the site
not being serviced, it was considered necessary to place a limit on

the quantity of water to be taken from any lake, stream, well or
reservoir. Furthermore, the By-law prohibits the discharge of
water used in manufacturing or effluent from any sewage disposal
system, outside the property boundaries, either above or below
ground level. The number of persons to be employed on the site
is limited to 2 persons per acre, and a total figure should be
put in the by-law when the acreage has been ascertained (see
Section 80)(a)(iv)).
The procedure to be followed in processing the By-law is
as laid down by the Ontario Municipal Board's Revised Rules of
Procedure, April, 1970. A draft notice and explanatory note are
attached to the draft of the By-law, but are not part of it.

TOWNSHIP OF CLARKE
AN EXPLANATORY NOTE
TO BY-LAW NUMBER
The following is a summary and explanation of By-law Number
which amends By --law Number 1653, a compre-
hensive-Restricted
ompre-
hensive estr cted Area (Zoning) By-law affecting land in the Town-
ship of Clarke.
This By-law changes the zoning of a site
on the westerly side of County Road No. 8 (be-
tween the Canadian Pacific Railway and the Can-
adian National Railways) to a special Industrial
category. This category allows an industrial
building on the site, subject to provisions re-
stricting water intake and discharge, and limiting
the number of persons employed on the site.
The above is an explanation of the provisions of the amendment
to the Zoning By-law. For accurate reference, the amendment and
the original By-law Number 1653 should be consulted at the Township
of Clarke Municipal Office during regular business hours.
NOTICE OF APPLICATION to The Ontario Municipal Board
by the Corporation of the Township of Clarke for ap-
proval of a By-law to regulate land use passed pursuant
to Section 35 of The Planning Act.
TAKE NOTICE that the Council of the Corporation of the Township
of Clarke intends to apply to the Ontario Municipal Board pursuant
to the provisions of Section 35 of The Planning Act for approval of
By-law passed on the day of , 197 .
A copy of the pose and effect of the By-law and stating the lands
affected thereby is also furnished herewith.
ANY PERSON INTERESTED MAY, within fourteen (14) days after the
date of this Notice, send by registered mail or deliver to the Clerk
of the Township of Clarke, notice of his objection to approval of
the said by-law, together with a statement of the grounds of such
objection.
ANY PERSON wishing to support the application for approval of
the By-law may, within fourteen (14) days after the date of this
Notice, send by registered mail or deliver to the Clerk of the Town-
ship of Clarke, notice of his support of approval of the said by-law
together with a request for notice of any hearing that may be held
giving also the name and address to which such notice should be given.
THE ONTARIO MUNICIPAL BOARD may approve of the said by-law, but
before doing so, it may appoint a time and place when any objection
to the By-law will be considered. Notice of any hearing that may be
held will be given only to persons who have filed an objection or
notice of support and who have left with or delivered to the Clerk
undersigned, the address to which notice of hearing is to be sent.

THE CORPORATION OF THE TOWNSHIP OF CLARKS
BY-LAW NUMBER
A By-law to amend By-law Number 1653
WHEREAS the Municipal Council of the Corporation of the Township
of Clarke deems it advisable to amend By-law Number 1653, as amended.
NOW THEREFORE the Municipal Council of the Corporation of the
Township of Clarke ENACTS as follows:
1. That Map 2 of Schedule "A" to By-law Number 1653 be amended
by changing to "M1-1" the zone symbol of lands so desig-
nated on Schedule "Y" attached hereto.
2, That Section 8 of By-law Number 1653 be amended by adding
thereto the following subsection 3:
"8(3) SPECIAL PROVISIONS
(a) County Road No. 8 Ml -1
Notwithstanding any other provisions of By-law
No. 1653 to the contrary, lands zoned "M1-1"
on Map 2 of Schedule "A" and shown on Schedule
"Y" attached hereto, shall be used for no other
purpose than an industrial building, subject
to the following provisions:
(i) That no more than 10,000 gallons of water
per day shall be taken from any lake,
stream, well or reservoir;
(ii) That no water taken from any lake, stream,
well or reservoir and utilized in any way
in the manufacturing process, shall be dis-
charged in such manner that it flows outside
the boundary of the said lands, either above
or below Around level:
(1)
(iii) That any privately -owned sewage disposal
system does not discharge effluent in such
manner that it flows outside the boundary
of the said lands, either above or below
ground level;
(iv) That no more than persons shall be
employed on the said lands.
3. This By-law shall become effective on the date hereof subject
to receiving the approval of the Ontario Municipal Board.
