Wight, Chief Building Officer Resolution #PD -457-78 Moved by Con. Taylor, seconded by Con. Allin Adoption THAT the minutes of the meeting of September 5, 1978 be of Minutes adopted as read. "CARRIED" Resolution #PD -458-78 Moved by Con. Holliday, seconded by Con. Gray R.Spencer THAT Mr. R. Spencer be heard at this time. "CARRIED" Mr. Spencer spoke to Report P-71-78, rezoning of Property S -A-1-11-1 and answered questions from Members of the Committee. Durham Region There was no one present representing the Durham Region Development Development Foundation. Foundation Resolution #PD -459-78 Moved by Con. Holliday, seconded by Con. Taylor O.M.B. THAT the matter of the O.M.B. Hearing regarding Oshawa Hearing re Official Plan, Townline Centre, be discussed in camera Oshawa at the end of the meeting. Townline Centre "CARRIED" Planning & Development Committee - 2 - September 18, 1978 Resolution YIPD-460-78 Moved by Con. Holliday, seconded by Mayor Rickard Comprehensive THAT the Committee concur and support the intent of Report Development No. 9 on the Council Agenda of September 11, 1978, by the Agreement Director of Planning and Development and that the drafting Policy of a Comprehensive Development Agreement commence immediately. Allin THAT Report #9 be referred to the Director of Planning and Development for further investigation and a report back. "MOTION LOST" Resolution #PD -462-78 Moved by Con. Woodyard Newtonville THAT the minutes of the Public Meeting held in Newtonville District on September 7, 1978, regarding the Proposed Newtonville Plan District Plan be received for information. "CARRIED" Resolution #PD -464-78 Moved by Con. Taylor, seconded by Con. Allin P-69-78 THAT the following recommendation contained in Report P-69-78 Durcourt dated September 12 regarding letter from McPherson, Walker, Developments Wright Associates re Durcourt Subdivision, be endorsed: Subdivision "That Mr. Shiomi be advised that the preparation of staff comments on the proposed Plan would be premature pending completion of the Courtice Secondary Plan". 1 "CARRIED" Planning & Development Committee - 3 - September 18, 1978 Resolution #PD -465-78 Moved by Con. Allin, seconded by Con. Taylor THAT the following recommendation contained in Report P-70-78 dated September 13, 1978 be endorsed: Lot 24 "That this Committee recommend that Council reaffirm the recommendation B.F. Conc. contained in Resolution PD -202-78 regarding Lot 24 and the objectors Darlington be informed of this decision, and furthermore that a public meeting (Schlacht) be held before any expansion of the area designated "industrial" in the Region of Durham Official Plan beyond the limits of the lands so designated in the Darlington Official Plan is contemplated." Gray THAT the following recommendation contained in Report P-71-78, dated September 13, 1978, regarding Plan of Subdivision Number S -A-1-11-1, Part Lot 8, Conc. 6, R.Spencer, be endorsed: Plan of "That the Town of Newcastle advise the Minister of Housing that it Subdivision approves of the revised plan showing 10 residential lots and dated S -A-1-11-1 August 28, 1978, subject to the following conditions: Part Lot 8, Conc. 6, 1. That the owner pay to the Town of Newcastle money in an R.Spencer amount equal to 5% of the value of the land included in the plan in lieu of parkland in satisfaction of the requirements of Sections 33(5) (a) and 33(8) of The Planning Act. 2. That the owner enter into a subdivision agreement with the Town of Newcastle to include, in addition to the usual requirements, provision for architectural controls to ensure that new housing is compatible with the present character of the Hamlet. 3. Ontario Municipal Board approval of the necessary Zoning By -Law amendment. and that no more than five building permits per year be issued with respect to the lots created by this plan of subdivision. Woodyard Maintenance THAT the Town Manager and appropriate Staff draft a Maintenance and and Occupancy by-law for the Town of Newcastle that; Occupancy By -Law 1) recognizes the unique rural urban mix of the Town 2) addresses itself to the needs of the developing major urban areas, industrial, commercial areas and hamlets yet does not adversely affect the rural lifestyle. 3) addresses itself to controlling and eliminating unsafe and hazardous conditions in all areas. and report back to this Committee. Taylor Chief THAT the Chief Building Officer's report, dated September 14, Building 1978, be received for information and referred to Staff for Officer's input into the report regarding a maintenance and occupancy Report by-law. "CARRIED" Resolution #PD -470-78 Moved by Con. Holliday, seconded by Con. Gray Dom's THAT the Committee accept the verbal report of the Director Auto of Planning and Development and proceed with rezoning and Site Parts Plan Agreement proposal, of Dom's Auto Parts to provide more Rezoning control and improve the general appearance and acceptability to the area and a public meeting be held in this regard to obtain their input. Gray Study THAT Special Study Area 13 be included in the Bowmanville Area 13 District Plan for study purposes. "CARRIED" Resolution #PD -475-78 Moved by Mayor Rickard, seconded by Con. Holliday Amendment THAT the Town of Newcastle Planning and Development to Committee approve an amendment to Recommendation (6) in Regional Regional Report 78-232-P, dated September 12, 1978 Report regarding Study Area 13, to add the words "in accordance 78-232-P with proposed Town Policy" after 'satisfactory agreement' (Study in the second line. The amended Section to read: Area 13) ' 6. THAT, the Town of Newcastle commence negotiations with the developers immediately to arrive at a satisfactory agreement, in accordance with Town Policy, regarding the development of industrial land, the staging of residential and industrial development, and the attainment of high performance criteria as outlined in the "New Darlington Mills" report, and that no local planning controls be amended until such an agreement is finalized.' THAT Mr. David Greenspan, Solicitor be instructed to Hearing continue to represent the Town at the Ontario Municipal re Oshawa Board Hearing on October 13, 1978 in the matter of a Townline reference to the Board by the Minister of Housing of Centre that part of the Official Plan for the Oshawa Planning Area as it applies to certain lands designated as "Planned Commercial Centres" south of Harmony Creek, north of King Street and west of Townline Road commonly known as the Townline Centre.
