Forrest Resolution CPPD -199-78 Moved by Con. Taylor, seconded by Con. Allin Adoption THAT the minutes of the meeting of April 17, 1978 be adopted of Minutes as read. "CARRIED" Evert Vierhout Mr. Evert Vierhout and Mr. John DeJong presented to the Committee & J. DeJong a Draft Plan of Subdivision on part lot 27, Conc. 2, former Draft Plan Village of Newcastle. This Plan had prior draft approval of of Subdivision the Ministry of Housing which, through an oversight of 2 days 18T-14755 had lapsed on December 20, 1977. The owners were asking that Council request the Minister to reinstate the Plan which had been given the File # 18T-14755. Resolution /tPD-200-78 Moved by Con. Gray, seconded by Mayor Rickard THAT Council request the Minister of Housing to reinstate Draft Plan of Subdivision, 18T-14755, part lot 27, Conc. 2 former Village of Newcastle with a full explanation of the delay. Planning & Development Committee - 2 - May 1, 1978 Resolution 11PD-201•-78 Moved by Con. Taylor, seconded by Con. Holliday Circulation THAT the Plan be turned over to Staff for detailed of Plan circulation and a report and the Minister of Housing be so advised. "CARRIED" Mr. & Mrs. Mr. and Mrs. Schlacht addressed the Committee relative Schlacht to their property in lots 23 and 24, B.F. Conc. former Lts 23 and 24 Township of Darlington which had been zoned Industrial B.F. Conc. and Agricultural in the Darlington Official Plan but Darlington which was zoned Open Space in the Durham Regional Official Plan. Resolution #PD -202-78 Moved by Mayor Rickard, seconded by Con. Gray r THAT Council request the Region to redesignate this land Industrial in the Regional Official Plan (Lot 24 between 401 Highway and the Baseline Road, bounded by Solina Road on the West) and in the application, address themselves to other concerns in that area. "CARRIED" Resoluti n #PD -203-78 Moved by Con. Taylor, seconded by Con. Woodyard THAT Mr. Hugh Laing be heard. "CARRIED" Mr. Hugh Laing Mr. Hugh Laing spoke relative to his letter of objection to By -Law 78-23 (N. Coffey) and stated that he would not withdraw his objection. Resolution #PD -204-78 Moved by Con. Allin, seconded by Con. Woodyard Mr. Gutteridge THAT Mr. Gutteridge be heard. "CARRIED" Planning & Development Committee - 3 - May ]., 1978 Extension Mr. Gutteridge, the Principal of the new Separate School of Rhonda being constructed on Rhonda Boulevard in the Waverley Boulevard Road Area relative to an extension to Rhonda Boulevard to allow busses to exit onto Waverley Road. Allin, seconded by Con, Woodyard THAT this matter be referred to the Planning Committee and the Public Works Committee for reconsideration to see if some conclusion can be reached with the developer of the property at the to the North. "CARRIED" Resolution #PD -206-78 Res. #PD Moved by Con. Allin, seconded by Con. Holliday -152,153-78 Large THAT Committee concur with the recommendation contained in Scale Town Manager's Report TM -32-78 that the matter of the re - Zoning Maps printing of large scale zoning maps be deferred until such time as the review of the Zoning By-law is completed and all errors on the existing maps identified. "CARRIED" "CARRIED" Meeting The Town Manager was advised of the subject matter which St. Mary's Council wished to discuss with St. Mary's Cement at the Cement meeting which he was asked to arrange. W-158-78 THAT Resolution #W-158-78 regarding designation of part of Designation Scugog Road, be referred to Planning Staff to bring back of part of a report. Scugog Road "CARRIED" Resolution #PD -208-78 Moved by Con. Holliday, seconded by Mayor Rickard Plan of THAT the revised plan of subdivision in Solina, presented Subdivision by W. and V. Ashton be referred to Planning Staff for a Solina report and that the matter be put on the Agenda for the VAshton next meeting of the Committee. "CARRIED" Planning & Development Committee - 4 - May 1, 1978 Resolution #PD -209-78 Moved by Con. Taylor, seconded by Con. Cray Chas. Ewert THAT in response to a letter from Charles Ewert, Barrister re Jukic and Solicitor, re Jukic application for rezoning, dated April 12, 1978, the Town's Solicitor be asked for an interpretation of the present by-law and his legal opinion as to whether the Town should enter into a temporary Site Plan Agreement with Mr. Jukic at this time. "CARRIED" Resolution #PD -210-78 Moved by Con. Taylor, seconded by Con. Holliday Inducon THAT the letter from Inducon Consultants of Canada Limited Consultants dated April 19th, 1978 regarding By -Law 78-16 be referred of Canada to Staff for a report back to this Committee and the letter Limited re be forwarded to the Ontario Municipal Board with the comment By-law 78-16 that Council does not consider this an objection to by-law 78-16. "CARRIED" Resolution G6PD -211-78 Moved by Con. Taylor, seconded by Con, Holliday Public Meeting THAT the minutes of the Public Meeting regarding Oakland Enniskillen Developments Rezoning Application held in Enniskillen on re Oakland April 19, 1978 be received for information and Report Developments P-23-78 be now considered. "CARRIED" Resolution #PD -212-78 Moved by Con. Holliday, seconded by Con. Allin Report THAT the recommendations contained in Report P-23-78 P-23-78 be implemented. "CARRIED AS AMENDED" Resolution i6PD-213-78 Moved by Mayor Rickard, seconded by Con. Allin THAT the previous resolution be amended by adding 'taking into consideration the concerns raised by the citizens at the Public Meeting'. "CARRIED" Planning & Development Committee - 5 - May 1, 1978 Objections There was a discussion regarding the three objections to By -Law which had been received to By -Law 78-23 (N. Coffey). 78-23 It was indicated that Vanstone Flour and Feed Mill and (N. Coffey) Helen and Harold Hammond would withdraw their objections. Resolution #PD -214-78 Moved by Mayor Rickard, seconded by Con. Cray THAT any objections to By-law 78-23 outstanding as of May 3rd, 1978, the Staff be authorized to address itself to them and report to the next meeting of Council on a possible solution. "CARRIED" Resolution #PD -215-78 Moved by Con. Taylor, seconded by Con. Holliday THAT the Ontario Municipal Board be informed that the Town has duly considered the objection in the letter from Mr. Hugh Laing, to by-law 78-23, and feels that the Town has addressed itself to the concerns raised therein and does not agree with the objection. Gray, seconded by Con. Holliday P-36-78 THAT the following recommendation, contained in Report P-36-78 Zoning Amendment Z -A-3-3-3, Lot 29, Cone. 2, Clarke (J. Bennett and J. Frith) be endorsed: Z -A-3-3-3 "That Parts 1 and 2 of Plan 1OR-355 be rezoned to an appropriate Lot 29, Cone. 2 commercial category to recognize the existing use carried on, Clarke on the property, on July 14, 1976, and that for this purpose (Bennett & the applicant be requested to submit a sworn declaration Frith) setting out the exact uses of the property on that date." Holliday Report P-37-78 THAT the recommendation contained in Report P-37-78, dated No. S -A-1-15-7 April 26, 1978, re Application_ for Plan of Subdivision (final) part lot No. S -A-1-15-7 (Final) Part of Lot 19, Concession 8, Darlington 19, Conc. 8 (Joy Werry) be endorsed: Darlington The recommendation is as follows: Joy Werry That the Region of Durham and the Minister of Housing be advised that the Town of Newcastle approves of the proposed subdivision with the following conditions. 1) Conveyance to the Town of Newcastle of sufficient land to create a road allowance of 76 feet in width on Old Scugog Road where it: abuts the subject land. 2.) Payment to the Town of Newcastle of 5% of the value of the subject land as cash in lieu of park land in satisfaction of Section 33(5) of The Planning, Act. 3) Entry by the owner into a Subdivision Agreement with the Town of Newcastle to include in addition to the usual requirements, provisions for architectural controls to ensure that new housing is compatible with the historical character of the village.. Holliday Report THAT the recommendation contained in Report P-38-78, dated r-38-78 April 26, 1978, Pian. of Subdivision, Lot 30, Conc. 4, Darlington Lot 30, Conc.4 George Collin and James Macdonald, that the proposed plan of Darlington subdivision proceed to circulation and detailed evaluation in Collin and accordance with adopted procedures be endorsed.
