Gutteridge Resolution No. P-11 -7 Moved by Dr. Rowsell, seconded by Mr. D. Moffatt, That the minutes of the meeting on July 14, 19759 be adopted subject to resolution No. P-108-75 being revised as follows, "That the Planning Staff meet with the Operators, and/or their agents, of existing salvage yards to consider more flexibility in the by-law with regards to those_salvage_yarde_already_in operation." "CARRIED" 1 (2) DELEGATIONS (i) Mr. Glen Elliott appeared before the Committee relative to the sale of property from Trull and Westbury, Lot 26, B.F.Concession, Darlington. Mr. Elliott requested approval of several matters relating to conditions of severance in order that the purchaser, Westbury Investments may proceed with improvements to the access road. Belson, seconded by Dr. Roweell, That Mr. Elliott be advised to deal directly with Council in respect of the foregoing matters. "CARRIED" (3) BUSINESS BWUGHT FORWARD (i) Stream Diversion, Lot 30, Concession 5., Clarke. Reference. resolution P-69-75, Application brought forward to consider further comments from the Ganaraska Conservation Authority together with Director's Report No. 149• Resolution No. P-115-15 Moved by Councillor Allin, seconded by Mr. R. Hetherington, That Director's report No. 125 be lifted from the table and approved. "CARRIED" (4) DEW BUSIIUESS (i) Director's report No. 150 was reviewed and the following comment noted. "In conclusion, Council should be advised that a Hamlet Plan for Solina would be premature until the location and function of the Parkway Belt in this area has been finalized". Resolution No. P-116-15 by Mayor Rickard, seconded by Councillor Cowman, That Mr. Ashton be thanked for his suggestions and that the same be forwarded to the Regional Planning and Development Commission for their consideration. cvCABRIEDev Planning Advisory Committee, August 11, 1975, continued- Page 3 It was suggested that Mr. Ashton submit his suggestions and proposals to Underwood McLellan & Associates, which firm has been retained by the Region of Durham to undertake a Hamlet Servicing Study, Resolutior_ No. P-11775 Moved by Councillor Cowman, seconded by Mr. D. Moffatt, That the Planning Director submit a report to this Committee on all Staff Meetings pertaining to the proposed Parkway Belt and the route of the proposed highway 407. uCA1MI u (ii) Rezoning Application by Pandel Holdings Limited. Village of Newcastle. Application is made to rezone a 199491 square foot parcel of land to permit the construction of seven townhouse units. The subject land comprises parts of lots 6, 7 & 8, Block C, Hanning's Plan in the Village of Newcastle and is situate on the north-west corner of the intersection of Manvers Road and George Street. Mr. Victor Plummer, owner and agent of Pandel Holdings appeared in support of this application, Director's Report No. 151 contained the following recommendation, "It is recommended that the application for rezoning be approved in principle, subject to the attached zone provisions, but that the applicant be advised that development of townhouses be considered premature until we. are advised that sufficient water supply is available". Cowman, That this Committee concur with the Director's recommendation and further that this Committee consider the proposed development to be premature until such time as the secondary plans for the development of the Village of Newcastle, as produced by Murray V. Cowman, seconded by Councillor D. Allin, That this Committee recommend to Council that the lands, subject of the aforenoted application, be rezoned to an 11041 category. Motion defeated. (iii) lldzonina Application; Salco Sand and Gravel Limited. Application is made to amend the Clarke zoning by-law to change the status of an existing legal non --conforming use in order to permit the erection of a building for the storage of equipment. The subject lands comprises 83.4 acres of land, situate in the north half of lot 32, Concession 89 Clarks. Director's report No. 152 set forth the recommendation as follows, " It is therefore recommended that the subject site be rezoned "Extractive Ineustrial" subject to conformity with the zone provisions and subject to the following conditions.* 1. That the applicant reconstruct to the satisfaction of the Town of Newcastle that portion of the road allowance between lots 32 and 33 which extends from the northern limits of the present maintained road to the 9th Concession Road. 2. that the applicant dedicate to the Town a one foot reserve abutting the forced road. 3. that the applicant enter into a Development Agreement with the Town based on the Butch Sand and Gravel Agreement. Resolution No. P�120 Moved by Dr. Rowsell, seconded by Mr. R. Hetherington, That this Committee concur with the Director's recommendation as set forth in report No. 152. �m� Planning Advisory Committee, August 11, 19759 continued- Page 5 (iv) Closing of Streets in Burketon Mr. D. J. Plitz, Agent for Jack Jacobsen Construction Limited, the purchasers of the former school site in Burketon, requested the closure and conveyance of two streets and a lane abutting the school site. Director's report No. 153 contained the comments as follows - "This request was referred to the Wori:s Committee and the Planning Advisory Committee. The Works Committee have already advised Council not to close the two streets indicated and Council have approved in principle the closure of the lane. We concur with the decision not to close the two streets as it would be premature to close any existing street in the hamlet until such time as a detailed plan for the whole hamlet is completed. We also concur with the decision to close up the lane which traverses the property. I would recommend that this Committee concur in the decision of the Works Committee and Council on this matter". Resolution No. P-121-75 by Mr. D. Moffatt, seconded by Mr. R. Muir, That this Committee concur with the Director's recommendation. (v) Land Division Committee Decision, re- George West and Prestonvale Road. Mr. West has applied to the Land Division Committee to sever a parcel of land in lot 33, Concession 2, Darlington and on the west side of the travelled part of Prestonvale Road. During consideration of his application it was established that the original road allowance for Prestonvale Road extends into the front yard of all the houses on the west side of the road. Mr. West stated that his deed includes the subject portion of the road allowance. The Town has no record of the road allowance being closed or conveyed to abutting owners. Mr. West appeared before the Committee with a request for assistance in obtaining clarification of title to the untravelled portion of the road allowance. i Planning Advisory Committee, August 11, 1975, continued- Page 6 Report No. 154 as prepared by the Director was reviewed and the contents noted. Resolution No. P-122-75 Moved by Mr. D. Moffatt, seconded by Councillor A. Cowman, It is hereby recommended to Council that those parts of the untravelled, original allowance for road between lots 32 and 33, Concession 2, Darlington,(Prestonvale Road) extending from No. 2 Highway southerly approximately 1700 feet(Improved section as shown in Key Map 21 of By-law No. 2111) be closed by By-law and that those parte so closed up be conveyed to abutting property owners, and further that it be the intentions of this resolution to close up those portions of the original road allowance which are re - described in deeds prepared ir_ 1943 provided that a width of 66' is retained for the travelled portion of Prestonvale Road, "CARRIED" Resolution No. P-123-75 Moved by Councillor A. Cowman, seconded by Mr. D. Moffatt, That by the action of Council in closing up and conveying those parts of the original allowance for road as referred to in resolution No. P-122-75, it will be deemed that the conditions of severance have been complied with. "CARRIED" (vi) IInimuroved Roads Studv Director's Report No. 155 included the following recommendation, "In conclusion, I would recommend that Council adopt the following minimum criteria for the designation of improved roads in the new Zoning By-law. Criteria for Desianation of an Improved Road. 1. Title to Road Allowance: Clear and undisputed title must be vested in the Province of Ontario, the Region of Durham, Town of Newcastle, or the Town of Newcastle and an adjacent municipality in the case of a boundary road. 2. Maintenance. The road must be actually maintained and kept open on a year round basis by the road authority having jurisdiction. Planning Advisory Committee, August 11, 1975, continued - Page 7 3. Standards. The road must meet or exceed the following minimum standards for the average annual daily traffic being carried according to the latest Road Needs Study. The road allowance must have a minimum widths of6 feetwexcept where the section of road is already built up on more than 12 -its frontage or is already carrying an annual average daily traffic of more than 200 vehicles, in which case the road must still meet all the above criteria. 5. Actual Condition. The road must be generally passable to normal vehicular traffic at all times of the year. Resolution No. P-1211-75 Moved by Dr. Rowsell, seconded by Mr. R. Balson, That this Committee concur with the Director's recommendation. "CARRIND" X �� (i) Circulation of Agendas Resolution No. 11-125-75 Moved by Councillor A. Cowman, seconded by Mr. D. Moffatt, That the Agendas be distributed to Planning Advisory Committee members not later than Wednesday of the week preceeding the day of the meeting. Cowman, That each Director's report be aceomnanied by maps to indicate the Geographic location of the property subject of the report. (6) "CARRUD" (ii) Concept Plano Courtice and Bowmanville Mr. Moffatt requested a progress report by the Mayor and Chairman regarding the Courtice and Bowmenville Concept Plane. In response to same it was stated that the Town were prepared to agree in principle, to approve the construction of 5000 dwelling units in the Town of Newcastle during the period 6f 1975 to 1978. Approval in principle was considered necessary in order that the Region could proceed with the necessary steps to provide the required services. (iii) Regional Official Plan. Mayor Rickard stated that the Region had tentatively scheduled a meeting in September in the Town of Newcastle to present their Official Plan. Resolution No. P-127!-75 Moved by Mr. D.
