Mr. Joe Drew addressed the Committee relative to the
level of service being applied to roads in his area,
specifically Given Rd., between Concession 6 & 7,
(Darlington) and the entrance to his property at
Enfield.
Mr. Steve Pustil, representing Mr. Kaufman of Penwest
Development Ltd., reviewed Planning Report PD-26-83,
relative to a plan of subdivision. He requested a
reduction in the servicing requirements so that the
lots would be marketable.
Mr. Devon Biddle, D.G. Biddle & Assoc. Ltd., and Mr.
Paul Gearing spoke to Report PD-28-83, proposed plan of
subdivision 18T-82030and rezoning application Z-A-I-I0-3.
They agreed with the report in general but did not feel
that they should be responsible for the cost of reconstruction
of McLeans Road. They were not in agreement with condition
16, the dedication of blocks 27 & 28 to the proper authorities
as they felt these lands were not all in the flood plain
and had some value.
Mr. Al Strike told Committee that he was in agreement with
Report WD-9-83, Encroachment on Nelson Street,
Bowmanville.
M"s, Melanie MacArthur stated that Bondhead Professional
Building Ltd. was in agreement with Report PO-24-83,
Rezoning Z-A-3-13-2, in the Village of Newcastle.
Mr. Pollet appeared before the Committee requesting a
refund of the price of an entrance culvert, Lot 6,
Plan M-745. He stated that the culvert was installed
by the Town in October and removed in November as the
result of regrading.
Mr. Dave Lawson, Bowmanville Anglers, was not present.
Mr. Wm. Campbell, General Manager of C.L.O.C.A., gave a
slide presentation of the activities of the Authority,
including recreation, flood and erosion control,
development control, watershed inventory and environmental
sensitivity. C.L.O.C.A.'s jurisdiction extends over 6
municipalities, including 20 miles of Lake Ontario
Waterfont and 12 miles north to south. He asked for
Council input:where should the Authority place the
emphasis, buying lands, operating parks, etc.

of a frame garage onto Nelson Street, Bowmanville,
defined as Part 2, Plan 10R-1576; and
3. That the provisions of Section 210: para. 101, of
The Municipal Act, R.S.O. 1980, be applied as follows:
(a) that the encroachment be granted for the life
of the building; subject to,
(b) the understanding that the by-law may be
rescinded at any time in the event that the
land in question is required for Municipal
purposes; and
4. That the lawyer for the applicant be so advised.

"WHEREAS Council deems it appropriate that applications
received from non-resident organizations seeking permission
to sell lottery tickets in the Town of Newcastle through
local affiliates, should be considered without delay;
AND WHEREAS Council deems it expedient to establish a
policy with respect to the manner in which such applications
are to be processed;
NOW THEREFORE, be it resolved that for the purpose of
processing such applications, the Clerk is hereby appointed
as Council's designate and shall review and where
appropriate, approve applications submitted by non-resident
organizations who are seeking permission to sell raffle
lottery tickets in the Town of Newcastle through local
affiliates; and
FURTHER that this policy shall remain in effect until amended,
or repealed by Council."

RESOLUTI ON:
.
"WHEREAS the Council of the Town of Newcastle approved the
Official Plan for the Bowmanville Major Urban Area on July
13th, 1981, and the Official Plan for the Newcastle Village
Small Urban Area on March 29th, 1982;
AND WHEREAS the Council of the Regional Municipality of
Durham approved said Plans on July 7th, 1982, and September
29th, 1982, respectively;
AND WHEREAS the Official Plan for the Bowmanville Major
Urban Area and the Official Plan for the Newcastle Village
Small Urban Area were forwarded by the Clerk of the Regional
Municipality of Durham to the Minister of Municipal Affairs
and Housing for approval on July 9th, 1982, and October 4th,
1982, respectively;
AND WHEREAS the Offi ci al PI an for the Bowmanvi 11 e Major
Urban Area and the Official Plan for the Newcastle Village
Small Urban Area conform with the Official Plan of the
Regional Municipality of Durham, as required by Section
59(3) of the Regional Municipality of Durham Act;
AND WHEREAS, on December 14th, 1981, the Council of the Town
of Newcastle resolved to advise the Regional Municipality of
Durham that it had no objection to Official Plan Amendment
application Bl-31/NB submitted by Glenson Investment Company
Limited to amend the Official Plan for the Bowmanville Major
Urban Area;
AND WHEREAS, on Jul y 7th, 1982, the Counci 1 of the Regi ona 1
Municipality of Durham approved Official Plan lImendment
application 81-31/NB in the context of approving the
Offi ci al Pl an for the Bowmanvi lle Major Urban Area;
AND WHEREAS the property subject to Official Plan Amendment
application RI-31/NB cannot be developed until the Ministry
of Municipal Affairs and Housing approves the Official Plan
for the Bowmanville Major Urban Area;
AND WHEREAS, on February 14th, 1983, the Council of the Town
of Newcastle approved an application to amend Restricted
Area By-law 79-44 of the Town of Newcastle in order to
rezone a certain property within the Newcastle Village Small
Urban Area;

AND WHEREAS the Regional Municipality of Durham cannot issue
a Statement of Conformity for the said rezoning until the
Official Plan for the Newcastle Village Small Urban Area has
been approved by the Minister of Municipal Affairs and
Housing;
RESOLUTI ON:

BE IT NOW THEREFORE RESOLVED that the Council of the Town of
Newcastle hereby requests the Minister of Municipal Affairs
and Housing to forthwith approve the Official Plan for the
Bowmanville Major Urban Area, and the Official Plan for the
Newcastle Village Small Urban Area,"
