Minutes of a meeting of the General Purpose and Administration Committee held on Tuesday, April 5, 1983, at 9:30 a.m., in the Bell Building. Present Were: Councillor D. Hamre, Chairman Councillor K. Barr, Member Councillor A. Cowman, Member Councillor I. M. Hobbs, Member Mayor G. B. Rickard, Member Deputy Clerk, G. Gray Councillor M. Hubbard, at a Regional Meeting Councillor R. B. Edwards Absent: Resolution #GPA-284-83 Moved by Councillor Hobbs, seconded by Councillor Barr THAT the minutes of the meeting of March 21, 1983, be approved as read. "CARRIED" Mr. R. Cotterill (as one of the owners of the subject property) spoke to Report PD-56-83, Application Dev. 82-39, Part Lot 21, Concession 2, Darlington. Mr. Bruce Colwill, the tenant, also spoke. Both supported the recommendations in the report. Mr. Graham Bagg was present in support of the recommendations in Report PD-53-81, request for a Quit Claim Deed, for a one foot reserve imposed by Land Division Committee, Parts 2 & 3, Plan 10R-1411, Part 1, Plan 10R-1566, and parts 1 and 3 Plan 10R-1592. Mr. H. Bout was listed as the next delegation. As he had not previously seen a copy of Report PD-59-83, he asked for time to read the report. Mr. Bob Stevens, representing the Real Estate firm handling the sale of lots in Rills of Liberty North, spoke to the Committee relative to Report PD-59-83. He stated that 13 lots in the development had been sold and he asked the Town to appeal a decision of the Land Division Committee, allowing a severance on Lot 33. He felt that this was unfair to the Developer and would set a dangerous precedent. He stated that the water supply had been designed for 46 lots. G. P .A. Minutes . Special Spring Garbage Collection - Village of Newcastle . - 2 - Apri 1 5, 1983 Resolution #GPA-285-83 Moved by Councillor Hobbs, seconded by Mayor Rickard THAT Committee allow 15 minutes for Mr. Bout and Mr. I, Hamilton to read Report PD-59-83, while continuing with the items on the agenda. "CARRIED" Resolution #GPA-286-83 Moved by Councillor Cowman, seconded by Councillor Hobbs THAT the recommendations in Report WD-29-83 be endorsed; and 1. That the special springtime garbage collection, within the Municipal Area of the former Town of Bowmanville, be approved as follows: (a) Monday and Tuesday, May 2nd and 3rd, 1983, be designated as the days for the special collection in the area south of King Street; and (b) That Thursday and Friday, May 5th and 6th, 1983, be designated as the days for the special collection in the area north of King Street; and (c) That a notice be placed in the local newspaper to advise citizens of the Special Spring Garbage Collection for the Town of Bowmanville. Special Spring Garbage Collection - Village of Orono . . - 3 - April 5, 1983 Resolution #GPA-288-83 Moved by Councillor Hobbs, seconded by Councillor Cowman THAT the recommendations in Report WD-31-83 be endorsed; and 1. That a special springtime garbage collection, within the collection area of the former Village of Orono, be provided on Wednesday, May 4, 1983; and 2. That the contractor operating the regular garbage collection services in the area be notified of the date for the special spring service; and 3. That a notice be placed in the local newspaper to advise citizens of the special spring garbage collection for the Village of Orono. That conditional upon the Bowmanville Business Centre acquiring the necessary Road Occupancy Permits, in compliance with Town Policy and By-law 83-32, approval be given to the proposal to hold a sidewalk sale on May 25, 26 and 27, 1983; and 3. That Temperance Street, from King Street, south to the north side of St. John's Anglican Church Property, be closed to accommodate the event. "CARR! That the Ministry of Transportation and Communications be advised that the Town of Newcastle concurs with their proposal for reconstruction of Highway 2 from the C.P.R. Subway East of Newcastle Village to the East limit of Newtonville; and - G.P.A. Minutes . Request for Street Light - Holyome - Townline Road . By-law to Establish a Policy in Respect of Driveway Entrances Upon Highways under the Jurisdiction of the Town of Newcastle . - 4 - April 5, 1983 3. That the Ministry be requested to consider problems of snow buildup in Newtonville as part of their design for the urban section. "CARRIED" Resolution #GPA-291-83 Moved by Councillor Hobbs, seconded by Mayor Rickard THAT the recommendations in Report WD-34-83 be endorsed; and 1. That the request of Mr. Edward Holyome for placement of a street light adjacent to his property on the Oshawa/Newcastle Townline Road, approximately 0.5 miles south of Taunton Road, be denied; and 2. That a copy of this report detailing alternatives to the original request be forwarded to Mr. Holyome for his consideration. That a by-law be passed establishing Town Policy in respect of the regulation of entrance-ways onto roads under the jurisdiction of the Municipality; and ,3. That the costs a~soc;a.ted with the inst<111 ation of Entranceways, <1sdeta il ed in Sdledul e \ ,Po, of the Policy, be put into effect upon the paSSing of the by-law, and reviewed on an annual basis by the Director of Public Works. Surfacing of the Hope/Newcastle Town- line Road North of Durham Road 9 . - 5 - Apri 1 5, 1983 Resolution #GPA-294-83 Moved by Mayor Rickard, seconded by Councillor Barr THAT Report WD-37-83, By-law to Regulate the Construction of Driveway Entrances Upon Highways Under the Jurisdiction of the Corporation of the Town of Newcastle, be tabled until Committee has dealt with the previous Report (WD-36-83) . "CARRIED" Resolution #GPA-295-83 Moved by Councillor Cowman, seconded by Mayor Rickard THAT the recommendations in Report WD-35-83 be endorsed; and 1. That this report be received; and 2. That the attached by-law to regulate the temporary closure or occupancy of highways in the Town of Newcastle be forwarded to Council for adoption. "CARRIED" Resolution #GPA-296-83 Moved by Councillor Cowman, seconded by Mayor Rickard THAT the recommendations in Report WD-38-83 be endorsed; and 1. That the Township of Hope be advised to proceed with final surfacing of the Hope/Newcastle Townline and subsequently forward a bill for Newcastle's share of same, late in the 1983 budget year; and 2. That funds for the Town of Newcastle's share of said surfacing (approximately $14,000) be allocated from any savings realized in the 1983 road program; and 3. That failing the ability to pay the Town's share from 1983 savings, funds be allocated in the 1984 budget for the surfacing project; and 4. That the Township of Hope be advised of Council's decision. Bout, Rills of Liberth North Recess . - 6 - Apri 1 5, 1983 Resolution #GPA-297-83 Moved by Mayor Rickard, seconded by Councillor Hobbs THAT the recommendations in Report WD-40-83, Storm and Sanitary Sewer Cross-Connections in the Beau Valley Estates Subdivision in Bowmanville, be endorsed. Resolution #GPA-298-83 Moved by Councillor Hobbs, seconded by Mayor Rickard THAT the matter be tabled for further information. "CARRI ED" The Director of Public Works reported that there would be a meeting next week, in the evening, with the Newcastle B.I.A. and interested Council members to discuss the design concept for the reconstruction of Highway #2, through the Village of Newcastle Mr. Bout spoke to the severance of a lot in the Rills of Liberty North, which was granted by the Land Division Committee. He stated that he bought the lot from the Town. After discussions with C.L.O.C.A., he was able to build a single family house on the property and applied to the Land Division Committee for a severance which would create a separate lot. He also needed a home for the congregation, of which he is the pastor and might consider a church on the severed lot. Mr. Irwin Hamilton, acting as solicitor for private property owners in the development, asked the Town to lodge an appeal against the decision of the Land Division Committee. He stated that the owners had paid more for smaller lots in the subdivision. They were restricted by the Subdivision Agreement and felt that the Agreement would not allow the creation of an additional lot. The Developer had put in a pumping station at considerable cost, to serve 46 lots. He stated that if the Town did not appeal the decision they would be negating planning principles. That the Kawartha Region Conservation Authority be advised that the Town of Newcastle supports the Watershed Management Strategy prepared by the Kawartha Region Conservation Authority as forming the directional framework for future activities of the Conservation Authority; and 3. That the Kawartha Region Conservation Authority be provided with a copy of Staff Report PD-54-83. Watson Investments Ltd., and Wm. and Dorothy Masulka . - 8 - April 5, 1983 Councillor Barr declared a Conflict of Interest in the previous resolution because of insurance contacts and refrained from discussion and voting. Resolution #GPA-304-83 Moved by Councillor Hobbs, seconded by Mayor Rickard THAT the recommendations in Report PD-57-83 be approved; and 1. That Report PD-57-83 be received; and 2. That the attached by-law amending by-law 1587, as amended, be approved. "CARRIED" Resolution #GPA-305-83 Moved by Councillor Hobbs, seconded by Mayor Rickard THAT the recommendations in Report PD-53-83 be endorsed; and 1. That Report PD-53-83 be recieved; and 2. That the attached by-laws in respect of the one foot reserves imposed as conditions of the subject applications for Land Division (Graham S. Bagg and William Watson Investments Limited; William and Dorothy Masulka; and John D. Moffat and Hilda B. Moffat) be approved; and 3. That the Mayor and Clerk be authorized to execute, on behalf of the Town, the conveyances in respect of Part 2 & 3, Plan 10R-1411; Part 1, Plan 10R-1566; and Parts 1 & 3, Plan 10R-1592, at such time as all applicable lot development charges have been paid and subject to confirmation that all related legal expenses shall be borne by the applicant in each case. Bout Rills of Liberty North . - 9 - April 5, 1983 Area in Part of Lot 12, Concession 1, former Township of Cartwright, Township of Scugog, subject to the following considerations being addressed: a} for safety reasons, and to mitigate any possible negative effects of heavy vehicular traffic on the draft approved plan of subdivision (18T-75362) immediately to the south of this site, it is suggested that access from the Scugog/Newcastle boundary road be located at the east limits of the site, and that truck traffic be required to travel east from that point directly to Regional Road 57; and b) that the Boundary Road Agreement between the Town of Newcastle and the Township of Scugog be amended, as necessary, to ensure implementation of a} above, and to ensure that all necessary road improvements and related maintenance shall remain/become the responsibility of the Township of Scugog; and c} that the sequence of excavation be altered to permit immediate excavation of Phases I, VI and VII, in order to minimize the long term effects of operation upon the draft approved plan of subdivision (18T-75362) to the south; and THAT a copy of the Staff Report PD-58-83 and Council's Resolution be forwarded to the Ministry of Municipal Affairs and Housing. "CARR I ED" Resolution #GPA-313-83 Moved by Councillor Cowman, seconded by Mayor Rickard THAT the correspondence of March 30, 1983, from the Hampton Hall Board, is hereby received and the Town recognizes that the Hampton Hall Board will make their best effort to contribute $5,000 by December 31, 1985, towards the actual cost of the washrooms' project at the Hampton Hall Municipal Building, and thanks the Board for its contribution towards the project. It is further acknowledged that members of Council, staff, representatives of Totten, Sims. Hubicki, and the Hall Board have and will be meetingto discuss. the project design and that when construction drawings have been completed, the Town will undertake the calling of tenders and will finance the project to a maximum of $30,000, any unexpended funds to remain with the Town of Newcastle, and further the Town will make application for all appropriate grants and loans.
