Minutes of a meeting of the General Purpose & Administration Committee, held on Monday, October 17, 1983, in Court Room #2, at 9:30 a.m. Present Were: Councillor R. B. Taylor, Chairman Councillor A. Fanning Resolution #GPA-815-83 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT the minutes of the meeting held on October 3, 1983. be approved as read. "CARRIED" A Public Meeting had been advertised concerning the following proposed rezoning by-law amendments: Part Lot 34, Conc. 1, Clarke (Hartemink) Part Lot 33, Conc. 2, Darlington (Dr. King) Mr. Hartemink spoke in support of his rezoning. He stated that because of the reconstruction of Highway 35/115 he was unable to continue to operate a fruit stand and wished to rezone the property. Mr. Ronald Shoebridge also spoke in support of the rezoning. No one spoke relative to the rezoning of Part Lot 33, Conc. 2, Darlington. Recess - 2 - October 17, 19B3 Resolution #GPA-B17-B3 Moved by Councillor Cowman, seconded by Councillor Hamre THAT the Committee hear any delegations related to rezoni ngs. "CARRIED" Mr. Larry Beaupre addressed Committee asking if the commercial rezoning for Part Lot 24, Conc. 8, Clarke, Margaret Beaupre, had been approved. The Chairman declared the Public Meeting closed subject to hearing Dr. King when he arrives. Mr. Richard Hassard, Q.C., spoke to Committee on behalf of Regional Reclaimers Limited. He stated that Mr. Hatch would not be present but suggested that Mr. Beatty be allowed to answer technical questions. Mr. Hassard was not in agreement with the recommendation in Report PD-147-B3 that the Town recommend to the Region of Durham Official Plan Amendment B3-B/D be denied. He asked Committee to go back to its earlier position that if the site was made environmentally safe, the Town would support the Official Plan Amendment or table the matter for two months. He said that Regional Reclaimers had entered into an agreement with B.F.I. Industries who would take over the applications. Mr. Hatch was representing B.F.I. The REgion of Durham had tabled the application for three months. Mr. Beatty, stated that he had prepared a technical report for Regional Reclaimers. He commented on the review process for applications submitted to the Ministry of the Environment. The Ministry may send an application to the Hearing Board or the applicant has an opportunity to proceed with a Hearing. He stated that Ministry requirements are changing from month to month. In his opinion, natural systems for the treatment of leachate are more efficient than mechanical methods. He said that he will respond to the letter from the Ministry of the Environment with a new report, after more tests have been made. He answered technical questions from the Committee. That no further action be taken with respect to sending Town Staff to the educational courses offered by the Ministry of Transportation and Communications. That Council adopt the attached quality standard for the erection and removal of snow fence; and 3. That annual snow fence expenditures be in accordance with the approved Public Works Department Budget. That the road allowance located in Lots 31 & 32, between Concessions 8 & 9, former Township of Clarke, which was closed by By-law 81-4, be disposed of by sale and conveyance to the abutting owners thereto; and 3. That the value of $1,000 (One Thousand Dollars) per acre be established for the lands to be sold; and 4. That staff be authorized to pursue Town Policy and Procedure in this matter, and the interested owners be so advised. Farm Re 1 a.ted Severances - 4 - October 17, 1983 Resolution #GPA-823-83 Moved by Councillor Hamre, seconded by Councillor Cowman THAT the recommendations in Report PD-145-83 be endorsed; 1. That Report PD-135-83 be received; and 2. That Report PD-145-83 be received; and 3. That Rezoning Application DEV 83-9 submitted by Mr. D. Ibbotson be tabled pending an application for Official Plan Amendment. and "CARRIED AS AMENDED" Resolution #GPA-824-83 Moved by Councillor Hamre, seconded by Councillor Hubbard THAT the previous resolution be amended by adding: 4. That staff prepare an amendment to be submitted on behalf of the Town of Newcastle seeking to have rural and agricultural service industries included as permitted uses within the Major Open Space Designation of the Regional Plan. The amendment to be general in nature, specifying that the inclusion of such uses would be at the discretion of the local Municipality and the inclusion of appropriate provisions in the respective zoning by-law. "CARRIED" Resolution #GPA-825-83 Moved by Councillor Hobbs, seconded by Councillor Hamre THAT the recommendations in Report PD-146-83 be endorsed; and 1. That Report PD-146-83 be received; and 2. That the attached By-law to amend Zoning By-law 1592, as amended, be forwarded to Council for approval; and 3. That the attached by-law authorizing execution of an Agreement between Margaret Beaupre and The Corporation of the Town of NeWCastle be approved. That Report PD-120-83 be received; and 2. That Report PD-149-83 be received; and 3. That the Regional Municipality of Durham be requested to amend the Durham REgional Official Plan in accordance with the proposed amendment included as Attachment 1 to this report; and 4. That Planning Staff be authorized to incorporate within the Draft Comprehensive Zoning By-law, the proposed zone provisions included as Attachment 2 to this report; and 5. That staff be authorized to provide comments to the Regional Land Division Committee in respect of any future applications for farm consolidation severances in accordance with the proposed official plan and zoning by-law amendments. "LOST" Resolution #GPA-829-83 Moved by Councillor Woodyard, seconded by Councillor Hubbard THAT Report PD-147-83 be received and this Committee approve in principle the application as submitted by Regional Reclaimers Ltd., providing that it meets all the requirements of the Ministry of the Environment and any of the other Ministries having jurisdiction over its operation and the Regional Council be so advised. Lot 34, Conc. 1, THAT the recommendations in Report PD-151-83 be endorsed; and Clarke Hamlet Designation for Maple Grove in Durham Regional Official Plan Monthly Building Re po rt 1. That Report PD-151-B3 be received; and 2. That application for rezoning DEV 83-1B be approved; and 3. That the By-law attached to this report to amend By-law 1592, as amended, of the former Township of Clarke, be forwarded to Council for approval. That a copy of staff report PD-152-83 and Council's decision be forwarded to the Region of Durham. Lots 11 & 12, Conc. 2 . . - 7 - October 17, 1983 Resolution #GPA-834-B3 Moved by Councillor Hubbard, seconded by Councillor Woodyard THAT the following recommendations, as amended, in Report PD-148-B3, be endorsed; and 1. That Report PD-148-83 be received; and 2. That Report PD-73-83 (attached) be received; and 3. That Attachment 1 to Report PD-73-83 be amended by deleting paragraph 8(c) thereto in its entirety and replacing same with the following new paragraph 8(c): "8(c) - to undertake at no cost to the Town the construction of a temporary pedestrian walkway from the southerly limit of Street G, south to the northerly limit of High Street; and further that the applicant acquire at no cost to the Town all necessary easements to gi ve effect to same."; and 4. That the Regional Municipality of Durham be advised that the Town of Newcastle has no objection to draft plan approval of subdivision application 1BT-82037 subject to the conditions outlined by Attachment 1 to Staff Report PD-73-83, . except that the portion of Condition 1, which addresses the re-alignment of the intersection of Street 'E' and Liberty Street, be moved southerly approximately 100 feet and the subdivision so designed. 5. That the development plan for Neighbourhood 2B of the Bowmanville Major Urban Area attached to staff Report PD-73-B3 be adopted as amended by staff; and 6. That the Region of Durham be advised of the Town's actions. "CARRIED" Resolution #GPA-839-83 Moved by Councillor Hobbs, seconded by Councillor Hubbard THAT the recommendations in Report CS-16-83 be endorsed; and 1. That this report be received; and 2. That By-law 79-104 (Cemetery By-law) remain unchanged; and 3. That the information sheet be incorporated onto the "Indenture. " "CARRIED" Resolution #GPA-840-83 Moved by Councillor Woodyard, seconded by Councillor Hobbs THAT the recommendations in Report CS-17-83 be endorsed; and 1. That this report be received; and 2. That the following implementation schedule for the Grants Policy as it applies to specific programs within the Community Services operating budget be approved with the following start dates: Girls Softball 1984 Budget Year Bowmanville Senior Citizens 1984 Budget Year Newcastle Youth Bowling 1984 Budget Year Newcastle Village Figure Skating 1984 Budget Year; and 3. That a four year period of implementation of the policy for the programs listed in recommendation #2 above be funded on the following schedule: Year 1 up to 100% Year 2 up to 75% Year 3 up to 50% Year 4 up to 25% Year 5 (and future years) grant policy applies at this point. "CARRIED" Resolution #GPA-844-83 Moved by Councillor Hamre, seconded by Councillor Hobbs THAT the recommendations in Report Admin 83-49 be endorsed; and 1. That Report Admin 83-49 be received; and 2. That Eldorado Resources, Limited be urged to approach the Federal Government, with the support of the Town of Newcastle, regarding the establishment of an independant body to conduct a minimum of a Province-wide site search for a permanent disposal facility for low-level radioactive wastes in a format similar to that being conducted by the Ontario Waste Management Corporation; and 3. That Council reaffirm the operative clauses of the Resolution adopted by the General Purpose and Administration Committee by Resolution #GPA-504-83, at its June 6, 1983 meeting and subsequently confirmed by Council by Resolution #C-415 -83 at its meeting of June 13, 1983; and . . .
