General Purpose and Administration Committee July 3rd 1984 Minutes of a meeting of the General Purpose and Administration Committee, held on Tuesday, July 3rd 1984, at 9:30 a.m., in the Auditorium of the Bowmanville Publ ic Library. Blanchard at 10 - 11:00 a.m. Zoning By-law Amendment, Part Lot 24, Concession 2, former Township of Darlington (Tomina) Pub Ii c Meet i ng The Chairman announced the purpose of the Public Meeting: As required under the Planning Act, Section 34, Council is holding a Public Meeting on the proposed zoning for a parcel of land located in Part of Lot 24, Concession 2, former Township of Darlington, before either adopting or rejecting the proposed zoning by-law amendment. The Chairman then asked if there was anyone present wishing to speak to the application. Two persons indicated that they wished to speak to the application. Before hearing from anyone, the Deputy Clerk was requested to advise on the manner of Notice. . The Deputy Clerk advised that Notice was sent by prepaid mail on May 30, 1984, to all owners of lands affected and to all owners of lands within 120 metres of the subject lands and that all the necessary procedures had been followed, and a sign had been posted on the property. Public Meeting . - 2 - July 3, 1984 The Chairman advised, that any person wishing further notice of the passing of the by-law, if it is passed, should leave his name, address and telephone number with the Clerk. The Director of Planning described briefly the purpose and effect of the by-law, which was to change the zoning category of a 2.67 hectare parcel of land located in Part of Lot 24, Concession 2, former Township of Darlington from "A-Agriculture" to a Special Provision, which would recognize the subject lands as being within a residential cluster or node, in order to permit the creation of three (3) residential lots. The Chairman advised further, that questions may be asked concerning the manner of notice and of the purpose and effect of the by-law, and that all questions must be addressed through the Chair. Mr. & Mrs. Keggenhoff objected to the rezoning which would permit a residential development in an agricultural zone. They operate a broiler (chicken) operation. They said that they have already received complaints from neighbours of odours and noise, which are associated with their operation. They felt that the proposed development would be a source of more complaints. They also said that the land covered by the rezoning application was higher than their property and would cause drainage problems. They were in support of Report PD-130-84, which recommends denial of the application. Mr. S. Zubkavich, Solicitor for Mr. Tomina, spoke in support of the application. He stated that the lands are not suitable for agricultural purposes. The proponent would be complying with the Agricultural Code of Practice. The Chairman declared this portion of the Public Meeting closed. Zoning By-law Amendment, Part Lot 34, Concession 3, former Township of Darlington (Schleiss & Holland) The Chairman announced the purpose of the Public Meeting: As required under the Planning Act, Section 34, Council is holding a Public Meeting on the proposed zoning for a parcel of land located in Part Lot 34, Concession 3, former Township of Darlington, before either adopting or rejecting the proposed zoning by-law amendment. . . . G.P.A. Minutes - 3 - July 3, 1984 Public Meeting The Chairman then asked if there was anyone present (Schleiss & Holland)wishing to speak to the application. The Chairman advised further, that questions may be asked concerning the manner of notice and of the purpose and effect of the by-law, and that all questions must be addressed through the Chair. No one spoke in objection to the proposed rezoning. Mr. Glen Easton of Proctor Redfern, representing Schleiss & Holland (Kilimanjaro Inv.), spoke in support of Staff Report PD-119-84. The Chairman declared this portion of the Public Meeting closed. Mr. Hannu Halminen said that he concurred with the recommendations in Report WD-69-84. (Black Creek Developments contribution to Reconstruction of Nash Road). Mr. Al Goheen told Committee that he concurred with the recommendations in Report PD-129-84 (Application for Rezoning - Zurba). . . . G.P.A. That the Town of Newcastle in consultation and co-operation with the Newcastle Environment WAtchers, embark on a recycling program as set out in the following: a) Durham Recycling Centre Inc., be selected as the private firm through which the Town will undertake a recyc!i.ng program in Bowmanvi lie; b) The Town will assist Durham Recycling Inc., in a program of advertising recycling in Bowmanville with any costs to the Town paid from the garbage collection advertising, information and promotion account 7303-0209-X-0; c) Durham Recycling Inc., will provide daily curbside collection of newspapers in conjunction with regular garbage collection; . d) Durham Recycling Inc., will service drop-off depots for glass and tin to be located at the Bowmanville Works Yard; G.P.A. Black Creek Developments Reconstruction of Nash Road . - 12 - July 3, 1984 e) Ourham REcycling Inc., will collect office waste paper from Town Offices and the offices of any other interested groups such as schools, medical centres, the library, etc.; f) The Newcastle Environment Watchers will continue to run their Saturday morning operation at the Goodyear Plant until such time as it is no longer felt worthwhile; 3. That an agreement of the form attached hereto be entered with Durham Recycling Inc., for the recycling services to be provided in Bowmanville; 4. That the Town assist the Newcastle Environment Watchers by providing about $200.00 in 1984 from the garbage collection advertising, information and promotion account (7303-0209-X-0) for insurance and protective gloves and glasses, with any similar funding to be considered during budget discussions; 5. That the arrangements proposed in the above be finalized and be formalized through Council at its first meeting in September. That where there is no direct access from lots in a residential subdivision to an abutting Town road, the developer's contribution toward reconstructing said road along his frontage be reduced to twenty-five percent (25%) from fifty percent (50%). Minutes Nash Road Industrial Promotion Delegations Recess - 13 - July 3, 1984 Resolution #GPA-773-84 Moved by Councillor Cowman, seconded by Councillor Hamre THAT staff, in reviewing in 1985 the Five Year Forecast for roads, review the concerns raised relative to Nash Road. Public Meeting Comprehensive Zoning By-law 84-63 . . - 14 - July 3, 1984 The meeting reconvened at 7:00 p.m., in Court Room H1, with all Members of Council present except Councillor Woodyard. Councillor Cowman attended at 7:20 p.m. Also Present: Chief Administrative Officer, D. Johnston Director of Planning T. T. Edwards Deputy Clerk, G. Gray The Chairman announced that Council is holding a Public Meeting under Section 34(12) of The Planning Act, for By-law 84-63, Comprehensive Zoning By-law for the Town of Newcastle, before either adopting or rejecting the proposed by-law. The Chairman asked if there was anyone present wishing to speak to the applications. Several persons indicated they wished to speak to the proposed by-law. Before hearing from anyone, the Planning Director was requested to advise on the manner of Notice. The Planning Director advised that public notice was given on May 23, 1984, and May 30, 1984 in the Oshawa Times, The Canadian Statesman, the Newcastle Independent, The Orono Times and the Newcastle Reporter, and the By-law was published in its entirety on May 30th 1984, in the Newcastle Independent, and The Canadian Statesman. The Chairman advised, that any person wishing further notice of the passing of the by-law, if it is passed, should leave his name, address and telephone number with the Deputy Clerk before leaving. The Director of Planning described briefly the purpose and effect of the by-law, that pursuant to the Planning Act 1983, By-law 84-63 is a comprehensive zoning by-law regulating the use of land, the height, location, floor area and spacing of buildings or structures on land subject to flooding or other physical hazard and covers the entire Town of Newcastle. This By-law is intended to implement the Durham Regional Official Plan and the approved portions of the District Plan for the Town of Newcastle. The Chairman advised further that Questions may be asked concerning the manner of notice and the purpose and effect of the by-law, and that all Questions must be addressed through the chair. No person Questioned the manner of notice. G.P.A. Minutes . Public Meeting Comprehensive Zoning By-law 84-63 . . - 15 - July 3, 1984 Objectors Mr. R. B. Spencer objected to the E,P.Zone along the Bowmanville Lakeshore and the restrictions imposed on the residents by such a zoning category. He Questioned the use of the 1-100 year flood level and asked "how does anyone know what improvements will be made in the next 100 years to stop erosion." He said that the E.P. restrictions would devalue the property of the present residents. He asked that the E.P. Zoning area be defined. Mrs. Eva Kraft spoke for the residents of Cedar Crest Beach, Bowmanville. She objected to the E.P. Zoning and asked for an amendment to the by-law to another category. She asked if the E.P. Zone had been delineated. She also asked: 1) what the taxes would be if the property was zoned RS-1? 2) what were the requirements for year- round residence? 3) what would happen if one of the houses burned down - could it be rebuilt? She asked for another meeting of the Cedar Crest Beach residents with the Director of Planning. Mr. Al Strike complimented staff for the preparation of the by-law, which consolidates the by-laws of the previous municipalities. He felt it would save staff time and lessen the need for Committee of Adjustment applications. He especially mentioned Section 3.5, - Existing legally non-conforming uses. He noticed that a number of strip developments had been left in an 'Agricultural' zone. He felt that they were 'rural clusters' and said that he had found no definition of a 'node or cluster' in the by-law. He spoke specifically on behalf of Mr. B. C. Wesseling, 104 Simpson Avenue, Bowmanville. The zoning on Mr. Wesseling's property is "M-1" in the present Bowmanville By-law, and "E.P." in By-law 84-63. He felt that this particular property was not in a flood zone and the E.P. zoning would be a hardship to Mr. Wesseling's business and cause problems with refinancing. Mr. Les Piper has the property which borders Mr. Wesseling's property and is also included inan E.P. Zone in By-law 84-63. He stated that his property is on the top of a rise and is higher than the Darlington Marina Condominiums, which are built on fill. He also mentioned that expropriation is possible in an E.P. Zone. He asked that his zoning remain IIM_1. II . . . G.P.A. Minutes Public Meeting Comprehensive Zoning By-law 84-63 Recess Adjournment - 16 - July 3, 1984 Mr. Piper was advised that expropriation is a possibility in any zoning category. Mr. Bill Manson, W.D.M. Consultants said that he had presented a letter to the Director of Planning, outlining his objections to by-law 84-63. He said that there were some difficulties with By~laws 77-12 and 77-13, Courtice Heights Subdivisions. He also said that Section 3.9 Set Back Requirements c) might present difficulties for buildings. He felt the E.P. Zoning in the Courtice Area was very restrictive. He suggested that exact delineation of the E.P. Zone at this time, was premature. Mr. John Rice Questioned the zoning on Queen Street, between Liberty and St. George Street. He suggested the zoning be (C-1). He asked if there is a Bowmanville Central Core and was advised that it is from Bowmanville Mall, west to Bowmanville Creek and north and south sides of King Street. No person spoke in support of the By-law. The Chairman declared the Public Meeting closed.
