Present Were: Councillor R. B. Taylor, Chairman Councillor A. Cowman, Member Councillor D. Hamre, Member Councillor I.M. Hobbs, Member Councillor E. R. Woodyard, Member, until 11:15 a.m. Mayor G. B. Rickard, Member Absent: Councillor M. Hubbard, Member, at Regional Planning Also Present: Chief Administrative Officer, D. Johnston Town Clerk, D. W. Oakes Deputy Clerk, G. Blanchard, until 11:30 a.m. Re: Zoning By-law Amendment, Part Lot 19, Concession 5, former Township of Darlington (Melor Farms) Public Meeting . The Chairman announced the purpose of the Public Meeting: As required under the new Planning Act, Section 34, Council is holding a Public Meeting on the proposed rezoning for Part of Lot 19, Concession 5, in the former Township of Darlington, before either adopting or rejecting the proposed zoning by-law amendment. He asked if there was any person present who wished to speak to this by-law. Before hearing from anyone wishing to speak to this matter, he asked the Clerk to advise on the manner of Notice. The Clerk advised that the Notice was sent by prepaid mail on July 27, 1984, to all owners according to the last assessment roll, within 120 metres of the property, a sign had been posted on the property, and the necessary procedures had been followed. . The Chairman advised that Questions may be asked concerning the manner of notice or the purpose and effect of the by-law. All Questions must be addressed through the Chair. The Chairman advised any person wishing further notice of the passage of the by-law, if it is passed, to please leave his name, address and telephone number with the Clerk before leaving. G.P.A. Minutes Public Meeting . (Melor Farms) Public Meeting . . - 2 - September 4, 1984 The Director of Planning described briefly the purpose and effect of the by-law which was to change the zone category of a portion of a 5.66 hectare (14.0 acres) parcel of land located in Part of Lot 19, Concession 5, former Township of Darlington from "A-Agriculture" to a "Special Provision By-law" which would permit the creation of three (3) residential building lots. He also explained that the application had been incorporated into By-law 84-63, the Comprehensive Zoning By-law. No person spoke in objection to or in support of the application. The Chairman declared this portion of the Public Meeting closed. Comprehensive Zoning By-law 84-63 The Chairman announ ced that Council is holding a Public Meeting under Section 34(12) of The Planning Act, for By-law 84-63, Comprehensive Zoning By-law for the Town of Newcastle, before either adopting or rejecting the proposed by-law. The Chairman asked if there was anyone present wishing to speak to the applications. Several persons indicated they wished to speak to the proposed by-law. Before hearing from anyone, the Planning Director was requested to advise on the manner of Notice. The Planning Director advised that public notice was given on July 25, 1984, in the Oshawa Times, The Canadian Statesman, The Newcastle Independent, The Orono Times and the Newcastle Reporter. The Chairman advised, that any person wishing further notice of the passing of the by-law, if it is passed, should leave his name, address and telephone number with the Clerk before leaving. The Director of Planning described briefly the purpose and effect of the By-law, that pursuant to the Planning Act 1983, By-law 84-63 is a comprehensive zoning by-law, regulating the use of land, the height, location, floor area and spacing o~ buildings or structures on land subject to flooding or other\ physical hazard and covers the entire Town of Newcastle. This by~law is intended to implement the Durham Regional Official Plan and the approved portions of the District Plan for the Town of Newcastle. G.P.A. Minutes - 3 - September 4, 1984 Public Meeting The Chairman advised further that Questions may be asked . Comprehensive Zoningconcerning the manner of notice and the purpose and effect By-law 84-63 of the by-law, and that all Questions must be addressed through the Chair. No person Questioned the manner of notice. Objectors Mr. Neil Allin of Orono, representing the Durham Region Federation of Agriculture, objected to the following sections: 6.1 (b) subsection (9) and asked that "seasonal farms" be deleted so that operations can continue throughout the year. 3.19 section (c) set backs, he said that a set back of 300 metres IS not practIcal, especially when expanding an existing operation. Mr. Laslo Pandy, representing Melor Farms, spoke in support of incorporating the zoning application into the comprehensive zoning by-law. . Mr. Bill Manson, WDM Consultants, advised that he did not have a complete copy of the report. No other person spoke to the by-law. The Chairman declared the Public Meeting closed. Resolution #GPA-835-84 Moved by Councillor Hamre, seconded by Councillor Hobbs THAT those in attendance be thanked and their comments be referred back to staff. "CARRIED" Delegations Mr. Merrill Brown, O.L.S., spoke to Committee relative to Report WD-73-84 on the Closure and Conveyance of Lord Elgin Street Road Allowance, immediately north and adjacent to Lord Elgin School. He stated that the initial survey made no reference to an unopened street b ut was shown on the original Hanning Plan. His client is prepared to pay all legal costs etc. Services were installed into the property from High Street in 1969. The Municipality has an easement on the property which could be a trade-off against the unopened road allowance. He asked Committee to consider the value of the land as suggested in his client's letter. Mrs. Diane McCurdy, King Street, Newcastle, spoke to Report PD-152-84, rezoning by-law 84-87. She said the objectors had not been notified that they could appear at this meeting and she was the only person available to speak for them. Her property is immediately adjacent to the proposed rezoning. She felt that the building of townhouses was not in keeping with the surroundings. That Mr. James Major be requested to convey to the Town of Newcastle the travelled portion of Station Street indicated in Key Map #2 attached to staff report PD-122-83; and . 4. That in consideration of the aforementioned conveyance, the Town shall provide comments to the Region of Durham Land Division Committee to support the severence of one lot from Mr. Major's property, said conveyance being conditional upon the approval of the Durham Region Health Unit. Further, that the Town of Newcastle will pay to Mr. Major $1800 as well as forgiving the lot levy of $625. In addition, the Town will pay all reasonable legal and survey costs associated with the proposed conveyance and that these costs be paid for out of Account #2900-X-3 (Municipal Acquisition of Real Property).
