The Chairman announced the purpose of the Public Meeting:
As required under the new Planning Act, Section 34, Council
is holding a Public Meeting on the proposed rezoning for
Pt. Lots 11 and 12, Concession 5, former Township of
Darlington, before either adopting or rejecting the
proposed zoning by-law amendment.
He asked if there was any person present who wished to
speak to this by-law.
Before hearing from anyone wishing to speak to this matter,
he asked the Clerk to advise on the manner of Notice.
The Clerk advised that the notice was sent by prepaid mail on
August 15th 1984, to all owners according to the last assessment
roll, within 120 metres of the property, a sign had been posted
on the property, and the necessary procedures had been followed.
The Chairman advised that Questions may be asked concerning
the manner of notice or the purpose and effect of the by-law.
All Questions must be addressed through the Chair.
The Chairman advised any person wishing further notice of
the passage of the by-law, if it is passed, to please leave
his name, address and telephone number with the Clerk.

Public Meeting
Rezoning - Ullrich
The Director of Planning described briefly the purpose and
effect of the By-law whioh was to change the zone
category of a 29.76 hectare parcel of land located in
Part Lots 11 and 12, Concession 5, former Township of
Darlington, from "A-Agricultural" to a "Special Provision
By-law", to permit the construction of an Abattoir on a portion
of the site comprising approximately 2.6acres.
In response to the Chairman's inquiry, a number of persons
present indicated that they wished to make comments on the
proposed application.
OBJECTORS
Mr. G. R. MacKay, R. R. #1, Bowmanville, L1C 3K2, made the
following comments on behalf of opponents of the proposed
zoning amendment:
- All but two of the property owners circulated had signed
a petition opposing the application;
The present Agricultural zoning should remain unchanged;
_ Serious concerns about the ability of the applicant to dispose
of wastes safely;
- Wastes infiltrating the water table could pollute wells;
~ _ An Abattoir would result in a lowering of land/property values;
Question: "What is the distance a slaughter house has to be located from
a residential property?"
Answer: There is no regulation - no minimum distance, however, it can
be written in the by-law.
Question: "Can the size of the operation be controlled?"
Answer:
Size of building proposed is 30' x 50'. Size can be controlled
by establishing size in the by-law.
Councillor Hobbs: "How far do you live from the subject lands?"
Mr. McKay: Mine is not the closest residence, I own 10 acres, and would be
at least 1000 ft. from the proposed location.
Councillor Cowman: "Did you live there in 1975-76?"
Mr. MacKay Yes; However, have no recollection of the circulating of the
previous by-law (75-80).
Councillor Hubbard: "How long have iylou lived there?"

"You want the lands to remain as permanent Agricultural Reserve,
without any change?"
Yes; leave it as it is. We don't want any more development.
"Where are there any locations that would permit such an operation?"
In an industrial zone with direct connections to water and sewers.
"How far away from the site do some of the people who signed the
petition reside?"
Some people live 1 to 2 miles away.
"What is your opinion of how Ullrich looks after his property?"
Exce 11 ent.
You suggested the Fire Department's comments are mere
"window dressing."
No I don't believe that to be the case.
"Are you aware that posting notices and obtaining comments from
various departments are all part of the Town's procedures?"
Yes, it is necessary to permit anyone to provide input into
the proposal.
Councillor Woodyard: "Does the appl icant' s property front on three roads?"
Yes, Liberty Street, Middle Road, and the 6th Concession.
All frontages were posted with the notice.
Councillor Woodyard:Would any of the residences have a direct view of the
Abattoi r site?"
Mr. MacKay:
Mr. MacKay:
Yes; I can see tops of buildings from my home.
Councillor Hobbs: "17 people are possibly affected by the construction of the
Abattoir. Why would you suggest a location on industrial lands
that would affect hundreds of people?"
Mr. MacKay:
They could connect to the services. Essentially, we don't
want an Abattoir in our backyards.
Councillor Taylor: "Do we need another Abattoir?"
Mr. MacKay: No, there are enough now.

Mr. Stender: "How much property does Mr. U 11 ri ch own?"
Mayor Rickard: I don't know.
Councillor Cowman: "You live close to a sawmill, has this affected your
property values?"
Mr. Stender:
Yes, latest appeal resulted in a 20% reduction. A slaughterhouse
will reduce its value by another 30%.
Mayor Rickard: Do you think Ullrich maintains his lands?"
Mr. Stender: Ullrich works about 30 acres and has weeds growing on
another 40 acres.
Mr. Mel Sucee
Mr. Mel Sucee: "I lIve opposite the Ullrich property. I own 96 acres and also
work at General Motors. 'I signed the petition opposing the
application.' Would anyone like to live opposite an Abbatoir?"
Councillor Cowman: No, I would not.

Councillor Hubbard: "You are a beef farmer. Wouldn't the addition of an Abattoir
in the area simply be the expansion of an Agriculture use? And,
wouldn't you use the service?"
Mr. Sucee:
No, I would not use the service. I use the Pontypool Abattoir.
We don't need another Abattoir. Ullrich's present operation is
not good, he should be closed down for health reasons.
Councillor Cowman:
"You lived in the area in 1975-76?"
Yes.
"Were you aware of the earl ier rezoning?"
Yes, verbally told "no slaughtering to take place on site."
"You were not notified of the earlier zoning change in writing?"

No, otherwise I would have objected in 1975-76 if slaughtering
was to be permitted.

Slaughterhouses have special problems:
- they smell, require careful waste disposal;
_ unfair to landowners to approve the Ullrich application;
_ there are several abbatoirs in the area;
_ seepage into the watertable would pollute area wells;
- also devalue property if built.

"What are the major difficulties? Is it the idea of a
slaughterhouse?"
Some concern with that but lowering of values is a concern.
Property couldn't be given away if an Abattoir is located
nearby.

_ I lived beside an Abattoir for 30 years, it lowered my
property values from $65,000 to $54,000;
- Abattoir smells terribly;
_ Cattle loading/unloading a 24 hour a day process;
- Not a farm related activity.

_ Ullrich needs slaughtering to augment his meat processing
business.

_ We need a local Abattoir so that cattle can be processed
loca lly;
Abattoir is an extended part of a farm operation;
- There is a stigma attached to an Abattoir;
_ A good clean operation emits little odour, less than those
normally associated with beef and pig farms;
_ It is my opinion the petition is not valid because the
proponents used scare tactics to obtain signatures.
Councillor Hubbard: "Have you visited the Ullrich site?"
Mr. Avery:
Yes, but not now because cattle can't be slaughtered.
Councillor Hubbard:"Have you any concerns about possible environmental problems?"
. Mr. Avery:
Yes, however, the activity is well regulated and there should
not be problems.

We are bUilding a new house next door to Pine Ridge Packers,
Port Perry, and it is about 400' from the Abattoir.
A good operation, does not have problems with smells, etc.

I agree with Mrs. Feddema. I have a hog operation.
People here can't compare the old Abattoir with the one
that the Ullrich's want to build.
There should be little odour.
I fully support the Ullrich application.

The meeting reconvened at 1:30 p.m.
Applicant
Mr. Bryan Davies, Solicitor for Mr. and Mrs. Ullrich
addressed the Committee on behalf of his clien~and made
the following comments:
There is a serious misconception of the scale of the project.
It is an ancilliary use, modest in size. The proposal would
augment the present operation and allow it to be more cost
effective. Slaughtering would be limited to 1 or 2 days per
week and about 20 animals would be on site for processing
at any time.
The building would be 32' x 64' and cost about $60,000 to $70,000.
Processing would be limited to beef, pork and lambs.
Liquid wastes would be held in a 3000 gallon tank and emptied
when necessary. There would be no direct drainage onto the
land and a backup tile bed is also to be installed. Manure
would be spread on the land as with any farm operation.
The area of property being rezoned is about 2.6 acres. The
entire farm is not being rezoned.

The structure would be located about 800 feet from Liberty
Street, 650 feet from the south boundary of the property,
1000 feet from the north boundary and about 500 feet from
the MacKay property line.
The proposal is consistent with an agricultural operation.
The water table will not be affected, as all liquid wastes
would be contained on site.
Land values would not be affected because it is to be a small
unobtrusive operation (2~ store~high).
The building is about 900 feet from the Sucee residence.
Councillor Hamre: "Will the operation remain small?"
Mr. Davies: I don't know. It is up to Council to control the
development by by-law.
Councillor Cowman: "Do you agree that zoning goes with the land and not
the owner?"
Mr. Davies:
Yes. However, Ullrich won't abuse the activity.
Councillor Hobbs: "Where would liquid wastes go?"
Mr. Davies:
Would be disposed of in the same way as other liquid
wastes from septic tanks.
Mayor Rickard:
"Where would animals be kept?"
Mr. Davies:
In the barn and holding pens.
"Could the building be located elsewhere on the property
site?"
Mayor Rickard:
Mr. Davies:
Yes within limits and depending upon the problems identified.
Councillor Hubbard: "When did Mr. Ullrich start the business?"
Mr. Davies:
30 - 35 years in business - 8 years at present site.
"If Council were to approve this application, would it be that
he will be back in 6 or 8 years?"
Councillor Hubard:
Mr. Davies:
Possibly, who knows.
Mr. Joe Ferren, Livestock Inspection Branch, Ontario Ministry
of Agriculture and Food, was introduced by Mr. Davies.
Mr. Davies indicated, that Mr. Ferren was not speaking in
support of the application but rather was at the meeting to
answer any Questions the Committee might have that related
to the areas regulated by the Province.

Mr. Ferren advised, that he was a Supervisor of the area that
included Durham REgion. That he was responsible for having
inspectors on site on days when animals were to be slaughtered.
As well, he indicated that he worked with people who wished
to update existing facilities or, who wanted to establish a new
faCility. His purpose was to see that the operator established
an orderly flow for products.
No other person spoke to Committee respecitng the application.
The Chairman declared this portion of the Public Meeting closed.

The Treasurer reports to Committee that the cash
position of the Town of Newcastle for the month
ended August is as shown on the attached schedule; and
2. That the expenditures for the month of August
1984 be approved.

THAT the recommendations in Report TR-81-84 be endorsed; and
1. That this report be received; and
2. That Petro-Canada Products Inc., Downsview, Ontario, with
a total bid in the amount of $81,750.00, being the lowest
responsible bidder, meeting all terms, conditions, and
specifications of Tender T84-18, be awarded the
contract to supply and deliver No.2 Domestic Fuel Oil to
the Town of Newcastle for the 1984-85 winter season; and
3. That the funds expended be drawn from the 1984 and 1985 budget
allocation for heating of facilities.

1. That this report be received;
2. That the General Purpose and Administration Committee
recommend to Council that October 8th to 13th 1984, be
proclaimed Fire Prevention Week in the Town of Newcastle; and

3. That the Fire Department be granted the use of half
of the parking lot to the east of the Police and Fire
Building, for displays of Fire Department Vehicles,
equipment and demonstrations, from October 9th to 13th,
8:00 a.m. to 4:30 p.m. daily.

category of one covered by Section 317 of the
Municipal Act, no value be placed on the said lands; and

for information on the history of the bridge presently
being constructed over Highway 35/115, between Highway
2 and Highway 401, (Lovekin), and any obligations for
maintenance of said bridge by the Town of Newcastle,
which the Ministry may foresee.
