General Purpose and Administration Committee Minutes of a meeting of the General Purpose and Administration Committee, held on Monday, May 7th 1984, at 9:30 a.m., in Court Room #2. , May 7th 1984 Roll Call Present Were: Councillor Hobbs, Chairman Councillor Cowman, Member, at 10:00 a.m. Councillor Hamre, Member Councillor Hubbard, Member Councillor Taylor, Member Councillor Woodyard, Member, until 1:15 p.m. Mayor Rickard, Member Also Present: Chief Administrative Officer, D. Blanchard, at 2:15 p.m. Zoning By-law Amendment, Part Lot 34, Conc. 2, former Darlington (Moase) The Chairman announced the purpose of the Public Meeting: As required under the Planning Act, Section 34, Council is holding a Public Meeting on the proposed zoning for a parcel of land located in Part of Lot 34, Cone. 2, former Township of Darlington, before either adopting or rejecting the proposed zoning by-law amendment. The Chairman then asked if there was anyone present wishing to speak to the application. Three persons indicated that they wished to speak to the application. Before hearing from anyone, the Clerk was requested to advise on the manner of Notice. Public Meeting . . The Clerk advised that Notice was sent by prepaid mail on April 2nd 1984, to all owners of lands affected and to all owners and tenants of lands within 120 metres of the subject lands and that all the necessary procedures had been followed. The Chairman advised, that any person wishing further notice of the passing of the by-law, if it is passed, should leave his name, address and telephone number with the Clerk. G.P.A. Minutes - 2 - May 7th 19840 . Public Meeting Cont'd (Moase) The Director of Planning described briefly the purpose and effect of the by-law which was to change the zoning category of a 1030.0 square metre parcel of land located in Part Lot 34, Concession 2, former Township of Darlington, from "R2-Second Density Residential" to "Special Purpose Commercial", which would permit the inclusion of the subject property within Special Purpose Commercial By-law 81-123, to permit a Motor Vehicle Sales and Service Establishment. . The Chairman advised further, that questions may be asked concerning the manner of notice and of the purpose and effect of the by-law, and that all questions must be addressed through the Chair. Objectors Mr. M. Asadoorian, 9 Darlington Blvd. S., spoke to Committee. He said that he and Mr. Dawson had been opposing this matter for 10 years, at Council, at the O.M.B., and through assessment appeals. They had succeeded in having their assessments reduced and had the appeal overturned. They had attempted to have the property cleaned up through the Property Standards By-law. He cited loss of value to his property, loss of the full and com- fortable use of his land. He said that his home and Mr. Dawson's were oriented to the east, in full view of the Moase holdings. He was concerned that adequate buffering be provided between residential and commercial areas. He also asked what effect this rezoning would have on the re-alignment of streets in a proposed redevelopment. He said that he and Mr. Dawson will continue to object to the rezoning. Mr. Ken Dawson, 7 Darlington Blvd. S., also spoke in opposition to the rezoning. He said the present use of the property is an illegal non-conforming use and this rezoning would provide more space to park derelict vehicles. He also asked what will happen to the property to the south, will it have access on a proposed street - will the location of the proposed road have to be moved. In Support . T. H. Greer, Solicitor for Mr. Moase, spoke in support. He said Mr. Moase had lived there for 27 years. The property is an illegal non-conforming use. This application will assist the objectors. The rezoning conforms to the Darlington Official Plan, also the Courtice Urban Area Plan and Darlington Official Plan Amendment. When the matter was before the O.M.B., it was dismissed as premature. The commercial portion of the property has been sold. It will be used for a new car dealership with some used cars. Mr. Moase owns the land to the south, where a 47 lot subdivision is proposed. His client is not opposed to landscaping, the new subdivision will require it. This is a commercial development with residential uses to the south and behind. G.P.A. Minutes Public Meeting Cont'd (~loase ) . Delegations . . - 3 - May 7th 1984' The Chairman declared this portion of the Public Meeting closed. Councillor Cowman attended at the table at this time (10:00 a.m.). Mr. Pollard spoke to Report PD-106-84, Rezoning Part Lot 29 and 30, Cone. 3, Darlington. He detailed the history of his proposal. The application on August 27, 1983, and the Public Meeting December 5, 1983. He said that he had revised the original proposal and moved the high density further north on the property. He had also revised the proposal to put an access to the arterial road by purchasing a 66' road allowance. He also fulfilled all of the require- ments. The proposal is now phased. He is asking Council and Planning to defer approval of Phase "C" and approve Phases A, Band D. This will leave a distance of 500 feet from the nearest present home. Phase "A" will have 510 units with Town Levies of $443,750. At the present tax rate, this will generate property taxes of $365,000. per annum. The park areas will be privately controlled. Storm water retention ponds will be privately controlled. Phases A and B will require 5 years' to complete. Janet Hayman also spoke to Report PD-106-84. She appreciates the use of the land but feels that more revisions are necessary. The land is environmentally sensitive. She questioned the advisability of so many buildings on the property. The golf course would be of no benefit to existing residents. What buffer would there be between the development and the low density. The proposed mews are not in character with single family dwellings on large lots. She urged Council to accept Planning's Recommendations, and table the report until after a public meeting on neighbourhood planning. Bill Bickle presented a brief with 4 concerns: 1. Golf course not of benefit to present residents; 2. Discrimination against potential ten~nts who are not senior citizens; 3. Need and demand for additional apartments; 4. Emergency exit to 4th Street. He asked Council to consider proper and well-planned controls on development. Mr. Ray Shepherd said that he has no objection to Mr. Pollard developing the property only to the way in which it is being developed. Phase "C" should be single family dwellings. Townhouses would block sunset. The holding pond would have to be enormous, and would be a danger to children. He said there were too many houses. The statement that the apartment buildings cannot be seen is because of townhouses. . . . G.P.A. Minutes Delegations Cont'd Recess Petition Re: Nash Road - 4 - May 7th 1984 Prase 'C' - being deferred, will give more chance to have single family dwellings in Phase 'C'. He feels the development is an invasion of his privacy. Bruno Wunderlich indicated he did not wish to speak. Andrew Orr representing Ridge Pine Park said that he supports the recommendations in Report PD-104-84. His company would like to publicly thank Council for allowing development to proceed, and staff for full assistance and co-operation. Resolution #GPA-526-84 Moved by Councillor Hamre, seconded by Councillor Cowman THAT there be a 10 minute recess. (11 :00 a.m.) "CARRIED" Resolution #GPA-527-84 Moved by Councillor Cowman, seconded by Mayor Rickard THAT Mr. Wilton be heard, relative to Report WD-45-84, petition re Nash Road. "CARRIED" Mr. D. Wilton of 1425 Nash Road, said that the petition outlined 6 problems. He now realizes that garbage collection is a private matter. 1. Street Lighting - The petition had 23 signatures and meets the requirements of 8y-Iaw 84-20. The residents feel that the Town should install 3 street lights. He mentioned the possibility of accidents. He suggested a traffic count in this area. 2. Improvements on roads and increased maintenance is requIred because of Increased traffic. 3. He suggested a reduction in speed limit from 60 km. There is a school east of Darlington Blvd. N. on Nash Road. A speed limit of 40 km - 150m each side of the school could be posted. The municipality regulates speed limits. He asked that the speed limit be reduced to 50 km and in the school zone to 40 km. 4. Improved Driveway Entrances - Residents at 1423, 1419 and 1417 have the same problem. His driveway problem will be corrected. 5. Nash Rd. Sign is being installed and he thanked the Public Works Oepartment for this. G. P .A. Minutes Reports . Rezoning - Moase 60.35.169. - 5 - May 7th 1984 Resolution #528-84 Moved by Councillor Hubbard, seconded by Councillor Taylor THAT the recommendations in Report PD-87-84 be endorsed; and 1. That Report PD-87-84 be received; and 2. That the attached by-law to amend Zoning By-law 2111, as amended, in respect of Part Lot 34, Concession 2, former Township of Darlington be approved. "CARRIED" Councillor Cowman declared a Conflict of Interest in the previous matter as her property abuts Mr. Moase's property. That Council adopt the following resolution: "That the correspondence from the Ontario Municipal Board dated April 11, 1984, be received and the Ontario Municipal Board be advised that the Corporation of the Town of Newcastle has no objections to the extensions to the draft plan approval of Plans 18T-76048 and 18T-76027 to June 12, 1985"; and 3. That the request in 2 above, be forwarded to the Ontario Municipal Board, and that Courtice Heights Developments Ltd., be so advised. "CARRI ED" Mayor Rickard declared a Conflict of Interest in Report PD-1D4-84, as he owns property 2 miles away which will be serviced by the water pipe to this development. Resolution #GPA-538-84 Ridge Pine Park Moved by Councillor Hubbard, seconded by Councillor Cowman Sales Office Agreement 60.51.010. THAT the recommendations in Report PD-104-84 be endorsed; and . 1. That Report PD-1D4-84 be received; and 2. That pursuant to the provisions of the Agreement between the Town of Newcastle and Ridge Pine Park Inc. dated May 24, 1983, registered August 15, 1983, Instrument No. 1365, an extension to the time period of five (5) years, thereby expiring on May 24, 1990 be approved; and G.P.A. "CARRIED" Resolution #GPA-539-84 Comprehensive Zoning Moved by Councillor Hamre, seconded by Mayor Rickard By-law 60.35.1. THAT the recommendations in Report PD-105-84 be endorsed; and 1. That Report PD-105-84 be received; and 2. That the Comprehensive Zoning By-law for the Town of Newcastle, included as Attachment 1 to Report PD-105-84 be forwarded to Council for first reading; and 3. That planning staff proceed with: (i) publication of the Comprehensive Zoning By-law as a supplement to local newspapers; (i i) Notice of public information sessions; (i i i) Notice of public meeting. . 4. That Planning Staff prepare a further report in respect of the public input received during the public information sessions and public meetings for consideration by Council concurrent with consideration of the second and third readings of the Comprehensive Zoning By-law. The Chief Administrative Officer was asked to check with the Solicitor relative to Councillors' possible Conflict of Interest in the Comprehensive Zoning By-law. Resolution #GPA-540-84 Moved by Councillor Hamre, seconded by Councillor Taylor THAT a Section 3(iv) be added "a special meeting with Council, to discuss this draft be held prior to the end of May. G.P.A. Minutes Rezoning - Pollard 60.35.205. - 9 - May 7th 1984 Resolution #GPA-542-84 Moved by Councillor Hubbard, seconded by Mayor Rickard 1. That Report PD-106-84 be received; and that Council authorize staff to proceed with the preparation of a Neighbourhood Development Plan for Neighbourhood 3B of Courtice; and 2. Staff be authorized to schedule a public meeting in respect of said development plan, to be held in the Courtice Area in approximately two weeks; and 3. That the subject application for rezoning File DEV 83-21, be tabled until after the aforementioned public meeting has been held; and 4. Staff be authorized to immediately circulate notice of Council's intent to consider approval of the revised application for rezoning of Sections A, B and D of the Site Plan and a deferral of Section C at the Committee Meeting of June 18th 1984, and that the said notice be provided in accordance with the applicable Provincial regulations; and 5. That following the public meeting referred to in No. 2 above, that staff prepare a draft development agreement and draft zoning by-law for the Committee's consideration on June 18th 1984; and 6. That staff explore the options with the applicant with respect to Mr. Pollard's request for reduction or elimination of development charges. That staff be authorized to advertise a temporary position at the Cate~ory 6 level (Accounts Payable Clerk) with the terms of employment not to exceed five months; 3. That the Deputy TReasurer be granted an additional $100 per week for the time period which the Treasurer is away as compensation for his added responsibilities; 4.
