TOWN OF NEWCASTLE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE Minutes of a Meeting of the General Purpose and Administration Committee held on January 7th 1985, at 9:30 a.m. in Court Room #2. Present Were: Councillor D. Hamre, Chairman Councillor A. Cowman, Member Councillor I. M. Hobbs, Member Councillor M. Hubbard, Member Councillor R. B. Taylor, Member Councillor E. R. Woodyard, Member Mayor G. B. Rickard, Member Also Present: Chief Administrative Officer, D. Johnston Town Clerk, D. W. Oakes Director of Planning, T. T. Edwards, 9:30 to 11:15 a.m. Treasurer, K. Campbell, 9:30 to 11:45 a.m. Director of Public Works, R. Dupuis, 9:50 to 1:00 p.m. Director of Community Services, T.A. Fanning 10:30 to 1 :00 p.m. Proposed Amendments to the Court ice Urban Area Plan, Courtice North Neighbourhood 3B Development Plan, and the Town of Newcastle's Comprehensive Zoning By-law 84-63. The Chairman announced the purpose of the Public Meeting. She advised, that the meeting was called pursuant to the requirements of Section 17(2) of The Planning Act 1983, for the purpose of receiving input from the publiC prior to Council giving final consideration to the proposals. The Chairman then asked if there was anyone present that wished to speak to the applications. Before permitting anyone to address the Committee, the Director of Planning was requested to advise on the manner of notice. The Director of Planning reported, that notice was given by three separate methods on December 5th 1984: 1. Publication in the Canadian Statesman, Newcastle Independent and Oshawa Times; 2. Circulation to all owners of lands within 120 metres of the subject lands; 3. Posting of notices on the subject lands. He advised further, that notice complied with the requirements of The Planning Act. ~ G.P.A. Minutes . PUBLIC MEETINGS CONT'D (Courtice Urban Area Plan) . . - 2 - January 7th 1985 Mr. Edwards then described briefly the purpose and effect of the subject amendments and how the amendments accomplished the stated purpose: The purpose of the proposed amendment to the Official Plan of the former Township of Darlington is to provide greater flexibility in the locational requirements of high, medium and low density residential development. The effect of the proposed amendment is to permit the location of low density residential development adjacent to high density residential development when separated by an open space buffer. The purpose of the proposed amendment to the Courtice North Neighbourhood 3B Development Plan is to establish land use designations for those lands currently indicated in the Neighbourhood Development Plan as being deferred. , The effect of the proposed amendment is to provide appropriate land use designations to permit the subject lands, in accordance with the development of policies of the Official Plan of the former Township of Darlington. The Chairman advised, that should any person wish to address the Committee respecting the manner of notice or the purpose and effect of the proposals, they direct their comments through the Chair. Further, the Chairman directed that persons wishing notice of the passage of the by-law, leave their name and address with the Clerk. The Chairman invited all persons present to come forward and make comments on the proposals. Opposed 1. Mr. Ray Shepherd, Vane Street, indicated, that the first public meeting, those present were advised that the proposal was to permit three apartment buildings. At the second meeting, the number was changed to six buildings; now there is another block of apartments and 70 townhouse units being proposed. He wondered why the land couldn't be restricted to single family homes only. In Support 1. Mr. Don McKinnon, Fourth Street, advised the Committee that he was in favour of the proposal that would lower the density. 2. Mr. Elmer Pollard, property owner, addressed the Committee. He suggested that people were not clear on what was proposed in the area. The lands being developed for apartment buildings was unchanged, trees were being protected (some old and dying removed) and an engineering company was working on the surface projects. There being no other persons present wishing to speak, the Chairman declared the Public Meeting closed. ************************************************ Zoning By-law Amendment, Part of Lot 30, Concession 3, former Township of Darlington. (Courtice Heights) The Chairman announced the purpose of the Public Meeting. She advised, that the meeting was called pursuant to the requirements of Section 34(12) of The Planning ACt 1983, for the purpose of receiving input from the public prior to Council giving final considerations to the application. The Chairman then asked if there was anyone present that wished to speak to the application. Before permitting anyone to address the Committee, the Director of planning was asked to advise on the manner of notice. Mr. Edwards advised, that notice was given by three separate methods on December 5th 1984. 1. Publication in the Canadian Statesman, Newcastle Independent and Oshawa Times; 2. He indicated, that the purpose of the proposed zoning by-law amendment was to change the zoning of a 5.3 hectare parcel of land located in Part of Lot 30, Concession 3, former Township of Darl ington, from "A-Agricultural", "EP-Envi ronmental Protection" and "(H)R1-Urban Residential (Holding)" to a Special Exception By-law. The effect of the proposed zoning by-law amendment would be to permit the development of a medium density townhouse development, a high density residential apartment buildings, and a Neighbourhood Convenience Block, all subject to a Holding Provision. Mr. Don McKinnon, Fourth Street, stated he was opposed to apartments and townhousing and asked whether the apartments could be located farther away from the single family homes. Mr. Edwards suggested it was possible to locate the buildings further north on the property. 2. Mrs. Dawn Little, Trull's Road asked why was it that the apartment buildings and townhouses were being built so far out in the country. She liked the area as it was and didn't want apartments in her back yard. In Support 1. Mr. Elmer Pollard, owner of lands abutting the subject lands, indicated that the surface water from his property will cross the subject lands and the people in the area will all benefit from the large projects, in that the flooding they have experienced in the past will be eliminated. There should no longer be flooding each spring of the lands in the area. 2. Mr. William Manson, Consultant for owners of the Courtice Heights Development, indicated that all drainage plans had to be approved by C.L.O.C.A. and the Town of Newcastle. Their plan would improve the overall drainage within the area and area residents will be the net beneficiary of the proposal. The effect of the proposed zoning by-law amendment would be to permit the development of uses permitted in the "R2-Urban Residential Zone" subject to lot area and frontage restrictions, and subject to a Holding Provision. The Chairman advised, that should any person wish to address the Committee respecting the manner of notice or the purpose and effect of the proposed by-law, they direct their comments through the Chair. Further, the Chairman directed that persons wishing notice of the passage of the by-law, leave their name and address with the Clerk. The Chairman invited all persons to come forward and make comments on the proposal. Opposed . 1. Mr. Wunderlich, Jane Street, indicated that he was concerned with the impact the development might have upon the privatewells and septic systems in the area. The area had experienced problems as the result of construction. The Director of Planning advised, that the developer was required to establish a water monitoring program and if wells dried up as a result of construction, the developer would be required to correct the problem. DELEGATIONS . - 6 - January 7th 1985 In the event water and sewer systems were to be installed in the area, all owners would be required to pay frontage and connection charges. In Support 1. Mr. Don McKinnon, Fourth Street, advised, that he wanted the development to proceed as soon as possible because it looked like a good development proposal. 2. Mr. Carlo Aloian also spoke in favour of the development and asked whether the developer would construct fences along the property line to protect the private lands. 3. Mr. Elmer Pollard, owner and developer of the subject lands briefly commented on the concerns raised by Mr. Wunderlich and Mr. Aloian: (a) Re Water Problem - all neighbours were about 100' apart, some wells were only 35' apart; there were 11 inground pools and no one was experiencing problems. (b) The closest construction would be more than 1000' from the nearest dwellings; sewers would be 9' deep; water line 9' deep. This should not affect area wells. (c) A fire hydrant to be installed at the intersection would be able to serve the entire area and would result in lower fire insurance rates: a definite benefit to area residents. (d) As to fencing, he suggested a tree planting program would be carried out in such a way as to keep the public out and the lands clean and tidy. There being no other persons present wishing to speak, the Chairman declared the Public Meeting closed. ************************************************* Mr. Walter Hengstberger, P.O. Box 545, Oshawa, Ontario, L1H 7L9, addressed the Committee on the issue of road access to the 90 acres of lands he owns, via the unopened road allowance, between Lots 8 & 9, Concession 9, Darlington. He indicated, that in October 1984 he had applied for a building permit to construct a summer residence on the property and for permission to construct a trail to allow for the installation of a hydro line. The application was denied. He was now appearing before Committee and requesting that they grant him permission to build the trail to his lands. G.P.A. Minutes . "CARRIED" Resolution #GPA-3-85 Moved by Councillor Hubbard, seconded by Mayor Rickard THAT the recommendations in Report PD-2-85 be endorsed; and 1. That Report PD-2-85 be received; and 2. That proposed Amendment No. 20 to the Official Plan of the former Planning Area of the Township of Darlington, as attached to this report, be approved; and 3. That the Region of Durham be requested to undertake the necessary actions for the approval of proposed Amendment No. 20 to the Official Plan of the former Planning Area of the Township of Darlington. That Amendment No. 2 to the Neighbourhood Development Plan for Courtice North Neighbourhoods 3A and 3B attached to this report be approved contingent upon Council approval of the recommendations contained in Staff Report PD-2-85; and . That the draft By-laws attached to this report rezoning a 5.26 hectare parcel of land located in Part of Lot 30, Concession 3, former Township of Darlington, to permit the development of a Neighbourhood Commercial site and a townhouse and an apartment development, subject to a (H) Holding provision, be approved contingent upon Council approval of the recommendations contained in Staff Reports PD-2-85 and PD-3-85; and 3. That "Open House" be held at all Municipal Offices and Buildings from 10:00 a.m. to 4:30 p.m., on Thursday, January 17th 1985; and 2. That a letter be forwarded to various organizations and the schools throughout the Municipality advising that the period January 14th to 19th 1985 will be recognized as "Local Government Week", but that the program for municipal awareness and participation will carryon as appropriate to May 31st 1985; and G.P.A. Resolution #GPA-25-85 Moved by Councillor Woodyard, seconded by Councillor Cowman THAT the Administrator's Confidential Report ADMIN 1-85 be referred back to the Chief Administrative Officer for further detail and the Administrator enter into discussions with the Department Heads concerned, and bring back a report that contains greater definition of the roles people in each department will have.
