Roll Call PUBLIC MEETING: TOWN OF NEWCASTLE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE Minutes of a Meeting of the General Purpose and Administration Committee held on January 21, 1985, at 9:30 a.m. in Court Room #2. Present Were: Councillor D. Hamre, Chairman Councillor A. Cowman, Member Councillor I. M. Hobbs, Member (left 10:03 a.m. Returned 10:05 a.m.) Councillor M. Rickard, Member at 9:38 a.m. Also Present: Chief Administrative Officer, D. Johnston Director of Planning, T.T. Edwards until 2:30 p.m. Treasurer, K. Campbell until 12:10 p.m. Director of Public Works, R. Dupuis, until 12:10 p.m. Director of Community Services until 2:30 p.m. Proposed Zoning By-law Amendment to the Town of Newcastle Comprehensive Zoning By-law 84-63, Part of lot 25, Concession 1, former Township of Clarke (Waggoner) The Chairman announced the purpose of the Public Meeting. She advised that the meeting was called pursuant to the requirements of Section 34(12) of The Planning Act 1983, for the purpose of receiving input from the public prior to Council giving final consideration to the application. The Chairman then asked if there was anyone present that wished to speak to the application. Before permitting anyone to address the Committee, the Clerk (Acting) was requested to advise on the manner of Notice. The Clerk (Acting) reported, that notice was given by prepaid first class mail to all property owners within 120 metres. The Notice was mailed on December 17th 1984, in compliance with the requirements of the Planning Act. The Chairman then called upon the Director of Planning to describe the purpose and effect of the Amendment. G.P.A. Minutes - 2 - January 21, 1985 . Public Meeting (Waggoner) Mr. Edwards indicated that the proposed zoning by-law amendment would change the zone category of a 0.626 hectare parcel of land located in Part of Lot 25, Concession 1, former Township of Clarke, from "C5-1 Special Purpose Commercial Exception 1" to a Special Exception By-law. The proposed zoning change would permit the severance of the existing single family dwelling from the existing motel/restaurant. The Chairman advised, that should any person wish to address the Committee respecting the manner of notice or the purpose and effect of the proposals, they direct their comments through the Chair. Further, the Chairman directed that persons wishing notice of the passage of the by-law, leave their name and address with the Clerk. The Chairman invited all persons present to come forward and make comments on the proposals. Opposed No person spoke in opposition to the Amendment. . In Support DELEGATIONS Mr. Mostert as an adjoining property owner, indicated his support for the proposal provided his concerns with respect to his prescriptive rights of access across the property were safeguarded. Mr. Irwin Hamilton, on behalf of the applicant spoke in support of the application. He indicated that the matter of Mr. Mostert's prescriptive rights was currently under investigation and could be dealt with at the time that the severance application is dealt with at the Regional level. There being no other persons present wishing to speak, the Chairman declared the Public Meeting closed. Mr. W. H. Parnell, Regional Assessment Commissioner, addressed Committee with respect to re-assessment appeals. Mr. Parnell indicated that he was appearing in response to Council's request. . Mr. Parnell read a letter addressed to Mr. Sam Cureatz from Mr. W. J. Lettner, Assistant MPP, Deputy Minister, Ministry of Revenue, which attempted to clarify the position of the Ministry of Revenue on appeals to the Ontario Municipal Board. . . . G.P.A. Residential Nodes and Clusters Policy Statement 60.2.1. - 3 - January 21, 1985 Mr. Parnell indicated, that appeals had been initiated by the Ministry of Revenue on seven properties within the Town, onebeing in the former Village of Newcastle, 2 in the former Township of Clarke, and 4 in the former Township of Darlington. Mr. Parnell indicated that all of the 960 appeals, 14 ratepayers were appealing their assessment to the Ontario Municipal Board. It was further indicated, that the municipality could take a position with respect to the appeals to the Board. Mr. Parnell indicated that the Ministry was attempting to protect the municipality's tax base. Resolution #GPA-32-85 Moved by Councillor Taylor, seconded by Mayor Rickard THAT the report be referred back to staff and re-written to note the concerns of Council Members and presented to Council thereafter. "CARRIED" Resolution #GPA-33-85 Official Plan Amendment Moved by Councillor Hubbard, seconded by Mayor Rickard Application Farm-Related Severances and Farm- THAT the recommendations in Report PD-11-85 be endorsed; and Related Service Industries 1. That Report PD-11-85 be received; and 60.30.2. 2. That the Regional Municipality of Durham be advised that the Town of Newcastle wishes to withdraw Official Plan Amendment applications Files: 83-38/D and 83-40/D in respect of farm- related severances and farm-related service industries, respectively, on the understanding that Regional Planning Staff will continue to study the general issues raised through these G.P.A. Minutes - 8 - January 21, 1985 . Administration of Development Agreements Moved by Councillor Taylor, seconded by Councillor Hubbard 60.46.1. Resolution #GPA-52-85 . THAT the recommendations in Report WD-3-85 be endorsed; and 1. That this report be received; and 2. That Council reaffirm its concurrence with the Town's Standard Subdivision Agreement as the instrument setting out the agreed upon conditions between the Town and Deveiopers of land within the Town; and 3. That staff be directed to take whatever actions are necessary to ensure that the conditions set out in said subdivision agreements are complied with so as to protect the interests of theTown; and 4. That staff meet with major land developers in the Town and their consultants and/or agents to discuss problems currently being experienced with the administration of Development Agreements; and 5. That the Town's Standard Subdivision Agreement be modified to authorize the Treasurer to cash any letter of credit which has not been renewed at least ten (10) working days prior to the expiry date thereof; and 6. That the Treasurer be authorized to cash any currently held letters of credit which have not been renewed at least ten (10) working days prior to the date of expiry thereof and, that the involved parties be so advised.
