Roll Call Present Were: Councillor I.M. Hobbs, Chairman Councillor D. Hamre, Member Councillor M. Hubbard, Member Councillor R. B. Taylor, Member Councillor E. R. Woodyard, Member Mayor G. B. Delegations Mr. Murray Wolkowicz, Solicitor for Mr. Jack Zurba, addressed Committee respecting the clearing of conditions related to a Development Agreement between the Town and Darlington Industrial Estates. Mr. Wolkowicz is requesting that a letter of clearance be provided so that the sale of the lands that are covered by the Agreement can be sold. He asked that the default be identified so that the problem can be resolved and the development permitted to proceed. In response to a question about the Agreement, Mr. Dupuis, Director of Public Works, advised that the Subdivision Agreement lists the works required to be completed and, certain of the works are incomplete. As well, the Town has during the past few years, not been paid for services performed on the property. Finally, the securities provided are no longer sufficient to meet the cost of the works to be completed. Mr. Joseph Mitchell, 6 Watson Street, Highland Creek, Scarborough, Ontario, addressed the Committee regarding the opening of an unmaintained road allowance between Lots 2 and 3, Concession 10, former Township of Darlington (Murphy Road). . He asked that he be permitted of the road allowance so that the property he owns which is municipality, the Township of to construct 1200 feet he could have access to located in the adjoining Scugog. He suggested, that while there would be no direct benefit to the Town initially, the opening of the road might encourage the owners of abutting lands in Newcastle to develop their lands for residential purposes. Mr. A. A. Strike, Q.C., Solicitor for the residents of the property abutting the lands of Mr. Kraayvanger, located on the north side of Highway #2, Newcastle Village, addressed the Committee and requested, that they reconsider the rezoning of the Kraayvanger lands and limit their use to R-1 residential for single family homes only. Planning Reports Resolution #GPA-104-85 Luverme Investments Moved by Councillor Hubbard, seconded by Councillor Taylor Plan of Subdivision 60.46.132. THAT the recommendations in Report PD-25-85 be endorsed; and 1. That Report PD-25-85 be received; and 2. That Council adopt the following resolution: . "Subject to the approval of Official Plan Amendment No. 120 by the Ministry of Municipal Affairs and Housing, the Council of the Town of Newcastle hereby advises the Minister of Municipal Affairs and Housing that the Town has no objections to the approval of revised Plan of Subdivision 18T-76071, dated July 13, 1984, comprising nineteen (19) lots and one block; subject to the inclusion within the Town's draft conditions of approval that the Owner agrees to satisfy the Town's rural fire protection requirements; and Furthermore, would have no objections to the extension of draft approval for Plan of Subdivision 18T-76071, as revised for a further one year period to March 22, 1986." 3. That Report PD-26-85 be received; and 2. That the attached by-laws authorizing execution of an Agreement between the Town, the Province of Ontario, and the Business Improvement Areas be approved; and 3. That a copy of this report be forwarded to the Bowmanville and Newcastle Village Business Improvement Area Boards of Management for their information; and 4. That the attached amending agreements be forwarded to the Bowmanville Business Improvement Area Board of Management for execution, and that upon execution, the Clerk forward the Agreement to the Ministry of Municipal Affairs and Housing. THAT the recommendations in Report PD-29-85 be endorsed; and 60.46.192. . 1. That Report PD-29-85 be received; and 2. That the Regional Municipality of Durham be advised that the Town of Newcastle has no objections to draft approval of Subdivision 18T-84035 as revised in red and attached hereto, and furthermore subject to the conditions outlined on Attachment No.1 to this report; and 3. That Report PD-30-85 be received; and 2. That Planning Staff and the Town Solicitor be authorized to request the Ontario Municipal Board to amend By-law 84-63 in accordance with the attached draft By-law Amendments failing written confirmation from the Regional Municipality of Durham by March 8, 1985, that the necessary development agreements have been executed and registered against title; and 3. That the Regional Municipality of Durham and the applicants be so advised. That the General Purpose and Administration Committee recommend to Council the following: (a) That Pierreville Fire Trucks Limited of St. Francois-DuLac, Quebec, with a total bid of $140,000, being the lowest responsible bidder, meeting all terms, conditions and specifications of Tender T84-24 be awarded the contract to supply and deliver one only 1985 Triple Combination 1050 G.P.M. Fire Department Pumper Truck to the Town of Newcastle; and (b) That the funds be drawn from the Ontario Hydro "B" Account, in the amount of $125,000.00, and the Fire Department Reserve Account #2900-14-3 in the amount of $15,000.00. . That this report be received; and 2. That Council support the Public Works Association in organizing the second annual Snow Plow Competition for May 24th and 25th 1985; and 3. That all costs associated with the Town's participation in the Snow Plow Competition be in accordance with the 1985 Public Works Budget allocation for Memberships and Association Dues. "CARRIED" ~ Resolution #GPA-128-85 Road Allowance Moved by Councillor Taylor, seconded by Councillor Hubbard Between lots 2 & 3, Cone. 10, Darlington THAT the recommendations in Report WD-9-85 be endorsed; and (Murphy Road) 77.2.99. 1. That this report be received; and 2. That the status of the unimproved road between Lots 2 and 3, Concession 10, Darlington (Murphy Road), remain unchanged; and 3. That a copy of this report be forwarded to Scugog Township for information; and 4. That Mrs. Lynda Mitchell be so advised. Resolution #GPA-129-85 Moved by Councillor Hamre, seconded by Councillor Taylor THAT Report WD-9-85 be referred back to staff; AND THAT staff discuss the maintenance of such a road with the Township of Scugog; . Release of Part 2, Plan 10R-708 with respect to the requi rements of a subdivision agreement 1. between the Town and Darlington Industrial 2. Estates 60.46.2. Moved by Councillor Hubbard, seconded by Councillor Hamre THAT the recommendations in Report WD-6-85 be endorsed; and That this report be received; and That the law firm of Levstein, Bradshaw and WOlkowicz, 1543 Victoria Park Avenue, Suite 201, Scarborough, Ontario, M1L 2T3, be advised that the Town of Newcastle does not consider it desirable to provide a release of Part 2, Plan 10R-708, with respect to the requirements of a subdivision agreement between the Town and Darlington Industrial Estates; and 3. That a copy of this report be forwarded to that law firm.
