Public Meetings Proposed Zoning By-law Amendment, Part of Lot 35, Concession 2, former Township of Darlington (linchris Homes) Report PD-143-85 LINCHRIS HOMES 60.35.257 The Chairman announced the purpose of the public meeting: As required under the new Planning Act (Section 34(12)) Council is holding a public meeting on the proposed rezoning for part of lot 35, Concession 2, former Township of Darlington before either adopting or rejecting the proposed zoning by-law amendment. The Chairman asked if there were any persons present wishing to speak to this matter. No person indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on the manner of notice: The Deputy Clerk advised that: a) Public Notice was mailed to property owners within 120 m. on September 20, 1985 b) Notice of the Public Meeting was posted on the property on September 20, 1985 c) The notice complies with the regulations under the new Planning Act . The proposed zoning by-law amendment would change the zone category of a 0.25ha (0.62 acre) parcel of land located in Part of Lot 35, Concession 2, former Township of Darlington from "Neighbourhood Commercial (C2)" to "General Commercial (C1)". The proposed zoning change would permit the development of a 1,115 square metre (23,000 square feet) Commercial Plaza. Concession, former Township of Darlington (George Haemmerle) Report PD-146-85 The Chairman announced the purpose of the public meeting: As required under the new Planning Act (Section 34(12)) Council is holding a public meeting on the proposed rezoning for part of Lot 28, B.F.C., former Township of Darlington before either adopting or rejecting the proposed zoning by-law amendment. The Chairman asked if there were any persons present wishing to speak to this matter. No person indicated a desire to speak to this amendment. The Chairman then called upon the Planner to briefly describe the purpose and effect of the By-law , and how the by-1 aw accomplishes the stated purpose. The proposed zoning by-law amendment would change the zone category of a 1.39ha (3.44 acre) parcel of land located in Part of Lot 28, Broken Front Concession, former Township of Darlington from "Service Station Commercial (C6- 4)" to "Servi ce Station Commerci a 1 Excepti on" zone. The proposed zoning change would permit the subject lands to be used additionally, for the sale/service of motorhomes and trailers. Report PD-141-85 The Chairman announced the purpose of the public meeting: As required under the new Planning Act (Section 34(12)) Council is holding a public meeting on the proposed rezoning for part of lot 15, Concession 3, former Township of Darlington before either adopting or rejecting the proposed zoning by-law amendment. The Chairman asked if there were any persons present wishing to speak to this matter. No person indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on the manner of notice: The Deputy Clerk advised that: a) Public Notice was mailed to property owners within 120 m. on September 20, 1985 b) Notice of the Public Meeting was posted on the property on September 20, 1985 c) The notice complies with the regulations under the new Planning Act. The Chairman then called on the Planner to briefly describe the purpose and effect of the By-law, and how the by-law accomplishes the stated purpose. The proposed zoning by-law amendment would change the zone category of a 3.46ha (8.55 acre) parcel of land located in Part of lot 15, Concession 3, former Township of Darlington from "Agricultural (A)" to a "Residential Estate (RE)" zone. The proposed zoning change would permit the development of an eleven (11) lot residential estate subdivision. A written submission was received from J. W. Sayles outlining his concerns that this development wou1~ have an adverse impact on his water supply. The Chairman concluded the public meeting. ************************************* Proposed Zoning By-law Amendment, Part of lot 31, Concession 5, former Township of Darlington (Walter Rebot) Report PD-149-85 The Chairman announced the purpose of the public meeting: As required under the new Planning Act (Section 34(12)) Council is holding a public meeting on the proposed rezoning for part of lot 31, Concession 5, former Township of Darlington before either adopting or rejecting the proposed zoning by-law amendment. G.P.A. Minutes - 4 - October 21, 1985 . (Wa lter Rebot) The Chairman asked if there were any persons present wishing to speak to this matter. Two persons indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on the manner of notice: The Deputy Clerk advised that: a) Public Notice was mailed to property owners within 120 m. on September 20, 1985 b) Notice of the Public Meeting was posted on the property on September 20, 1985 c) The notice complies with the regulations under the new P1 anni ng Act. The Chairman asked that if any person wished further notice of the passage of the By-law, if it is passed, to please leave their name, address and telephone number with the Deputy Clerk before they left. The Chairman then called on the Planner to briefly describe the purpose and effect of the By-law, and how the by-law accomplishes the stated purpose. The proposed zoning by-law amendment would change the zone category of a 4.02ha (9.94 acre) parcel of land located in Part of lot 31, Concession 5, former Township of Darlington from "Agricultural (A-1)" to a "Agricultural (A-6)" zone. The proposed zoning change would permit the use of the subject lands for a farm implement dealership. The Chairman advised that questions may be asked concerning the manner of notice or the purpose and effect of the By-law and that all questions must be asked through the chair. The Chairman advised that Council would hear from the objectors, first explaining that Council wished input prior to a final decision. On behalf of herself and he, husband, Lynne Ewtushik read their written submission to Council. Briefly, the Ewtushik's are concerned about removal of waste from the Rebot property, the hours of operation and the size and lighting of signs. They would like to have an esthetic barrier erected between their property and all buildings, outdoor storage areas and parking lots associated with the proposed business and they would like assurance that establishment of the business would not detract from the rural nature of this location. Roy Connelly stated that his concerns were identical to the Ewtushiks. He questioned the possibility of the property being rezoned back to the former business at a future date should this venture not succeed. The Chairman advised that Council would now hear from those in support. The applicant, Walter Rebot, announced his presence in support of his application. Minutes - 5 - October 21, 1985 Delegations WALTER REBOT re: Planning Report PD-149-85 stated his intentions during the Public Hearing. FRANK WINTERS re: Planning Report PD-150-85 presented a petition signed by several property owners in Plan 10M755 opposing the rezoning of Part of lot 15, Concession 3 and proposed severance of Jean Marc Beaulieu. Mr. Winters also presented a letter of concern from Michael and Deborah Patrick regarding this rezoning. The VanAnde1/Gust subdivision have imposed certain architectural controls. The concerned objecters request rejection of this proposal unless the same architectural controls can be imposed on the Beaulieu proposal. Mr. Winters stated he is still concerned about the impact this development may have on his well. JOHN BEAULIEU re: Planning Report PD-150-85 appeared in support of his proposal and to answer questions. He has a 1 acre lot which he wishes to rezone and sever. In his opinion if a person wanted to build a large house they would buy an estate lot in the subdivision. He is willing to relocate the proposed well. MR. H. E. MILLSON, Box #512, Orono gave a brief synopsis of the street and service construction that had taken place in Orono prior to and since Regional Government. His main reason for attending was to request dialogue with staff and Council with the intent of petitioning the continuation of these local improvements. "CARRIED" AL STRIKE acting on behalf of Lyle Estate reo Report WD-71-85 informed the Committee that he has submitted a request to the Town to close and convey portions of the allowances for Rehder and Edsall Avenues. There are two manners of closing streets. Mr. Strike requests the Committee to recommend to Council closing the sUbject allowances pursuant to Section 82 of the Registry Act.
