TOWN OF NEWCASTLE General purpose & Administration Committee Minutes of a Meeting of the General Purpose & Administration Committee, held on Monday, November 4, 1985, at 9:30 a.m., in Court Room 1/2. November 4, 1985 . Public Meetings Present Were: Councillor A. Cowman, Chairman Mayor G. B. Rickard, Member Councillor D. Hamre, Member Councillor I.M. Hobbs, Member Councillor M. Hubbard, Member Councillor R. B. Taylor, Member Absent Were: Councillor E.R. Woodyard (Due to illness) Also Present: Chief Administrative Officer, D. Johnston Treasurer, K. Rutledge Proposed Zoning By-law Amendment, Part of Lot 14, Concession 8, former Township of Darlington (Janet Mayer) Roll Call The Chairman announced the purpose of the public meeting: As required under the new Planning Act (Section 34(12)), Council is holding a public meeting on the proposed rezoning for part of Lot 14, Concession 8, former Township of Darlington, before either adopting or rejecting the proposed zoning by-law amendment. The Chairman asked if there were any persons present wishing to speak to this matter. No person indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Deputy Clerk to advise on the manner of notice: . The Deputy Clerk advised that: a) Public Notice was mailed to property owners within 120m on October 4, 1985; b) Notice of the Public Meeting was posted on the property on October 4, 1985; c) The Notice complies with the regulations under the new Planning Act. Minutes - 2 - November 4, 1985 Public Meetings: The Chairman called on the Planner to briefly describe the purpose and Effect of the By-law, and how the by-law accomplishes the stated purpose. . The proposed zoning by-law amendment would change the zone category of a 0.3 hectare (0.74 acre) parcel of land located in Part of Lot 14, Concession 8, former Township of Darlington (as shown below) from "Residential Hamlet (RH)" to a Hamlet Residential Special Exception Zone. The proposed zoning change would permit the development of a residential lot with a minimum lot area of 0.3 hectares. The applicant, Janet Mayer, announced her presence in support of her application. The Chairman concluded the public meeting. *********************** Delegations David Shevchuk, R.R. #6, Bowmanville, l1C 3K7, informed the Committee that he is speaking on behalf of himself and the residents on Hancock Road. Mr. Shevchuk read various excerpts from Report PD-161-85 and commented on them. To the south of his property is a vacant 10 acre parcel. If this parcel had a house situated thereon, he would qualify for infilling. In concluding, he asked the Committee to give consideration to reviewing the Nodes/Clusters Policy and to recognize Hancock Road south as a cluster of homes. . larry Kotseff, Regional Planning Department, was present at the request of the Committee to discuss a proposed modification relative to the land use schedule. The modification proposed by Regional Staff would make the land use schedule an information map only, and would not form part of the Official Plan. Town Staff are opposed to this modification. Mr. Kotseff briefly outlined the Region's position on this matter. "CARRIED" Memorial Hospital Funding Harry Locke, Chairman, Board of Directors, Memorial Hospital, Bowmanville, 47 Liberty St. S., Bowmanville, L1C 2N4, was present to ask the Committee's favourable consideration to funding the necessary storm sewer improvements on Prince Street from the Hospital easterly to Simpson Avenue. . . . . That Council consider the request of Memorial Hospital - Bowmanvi lIe, and designate $85,000 from the Working Capital Reserve Account No. 2900-X-00001-8 for the upgrading of storm sewers on Prince Street from the Hospital easterly to Simpson Avenue. THAT the Region of Durham be advised that the Town of Newcastle objects to the proposed amendment to the Durham Regional Official Plan in respect of Site Plan Control, as contained in Commissioner's Report 85-146; and . . . WHEREAS the Town of Newcastle has executed a development & Marilyn Carswellagreement with Darlington Industrials limited and Marilyn Carswell (Industrial File) in respect of Part Lots 27 & 28, Broken Front Concession, Darlington, now described as Parts 1 to 47, Plan 10R-708; . AND WHEREAS said agreement imposes architectural controls on all buildings located within 150 metres (500 feet) of the centreline of Highway 401; AND WHEREAS this is the only industrial subdivision agreement which imposes such controls; AND WHEREAS such controls represent an onerus burden upon lot owners within said subdivision and abutting Highway 401; AND WHEREAS all other industrial lots enjoy less restrictive requirements and are subject only to site plan control and zoning restrictions; NOW THEREFORE BE IT RESOLVED that staff are hereby authorized to approve building elevations which do not comply with the provisions of Schedule "M", Section 1.2 of the aforesaid development agreement provided that the proposed site plan incorporates appropriate screening or landscaping to soften the appearance of buildings on such lots when viewed from Highway 401; IT IS FURTHERMORE RESOLVED that current Municipal Policies or zoning regulations shall prevail where any provisions of said agreement are found to be in conflict therewith.
