Special meeting of Council was called by Reeve Foster to
consider the following business:
Solicitor E. R. Lovekin met with Council to discuss the
expropriation of part of the Ruegger property in Lot 9, Range
B., Broken Front Concession. This business was referred to
By-Law.
The following correspondence was read out by Reeve Foster:
Mr. Walter S. Dempsey re complaint of dry well believed
to be caused by excavation in the Municipal Gravel Pit
located adjacent to his property as business brought

The following By-Law was given ~irst, second and
third reading and finally passed:

Being a By-Law ~or the purpose o~ acquiring by
expropriation certain land which i8 required ~or the
widening and ~proving and grade separation over The
Canadian Paci~ic Railway between Lots 8 and 9 in the
Broken Front Concession (Range B) Township o~ Clarke
WHEREAS ~or the purposes o~ widening and improving
and providing for adequate grade separation over The
Canadian Paci~ic Railway between Lots 8 and 9, Range B,
Concession Broken Front, Township of Clarke, County o~
Durham, The Corporation of The Township o~ Clarke finds
it necessary to acquire by expropriation the land shown
on the Plan o~ Survey annexed hereto as Schedule ftAn
and Schedule "Bu;
AND WHEREAS in accordance with the provisions o~
The Municipal Act R.S.O. 1960 and The Expropriations
Procedures Act, 1962-63, The Expropriation Procedures
Amendment Act 1965 and The Expropriation Procedures
Amendment Act 1966, the Corporation may expropriate land
~or the said purposes:
NOW THEREFORE BE IT ENACTED by The Council o~ The
Corporation o~ The Township o~ Clarke as follows:
1. That the land in heavy outline on the Plan of Survey
annexed hereto as Schedule "An and Schedule RBft shall
be and is hereby acquired for the purposes of widening
and ~proving and grade separation over The Canadian
Pacific Railway of the Newtonville Road between Lots
8 and 9, Range B, Concession Broken Front, Township
of Clarke, County of Durham.
2. That for purposes o~ said expropriation:

to the Registrar o~ the West R.iding o~ the County
of Durham shall be duly completed by M. D. Brown,
Ontario Land Surveyor.
(b) The Reeve and Clerk ~or the Cor pOl" at ion of The
Township of Clarke are hereby authorized and
directed to sign the said Plan and to affix the
seal of the Corporation thereon; and
(c) Said Plan shall be duly tendered ~or registration
in the Registry O~fice for The Registry Division
of the West R.iding o~ the County of Durham.
