Minutes of a meeting of the Committee of the Whole held
at 1:00 p.m. on September 27th, 1976 in the Committee
Room at Bowmanville Town lIall.

Adoption THAT the minutes of meeting held on September 13th, 1976 be
of Minutes adopted as amended.

Moved by Con. Cowman, seconded by Con. Hobbs.
THAT Resolution #CW -448-76 be amended by changing the word
"Subdivision" to "Secondary".

Mr. McTavish Mr. Stewart McTavish appeared before the Committee relative
Land Severance to certain conditions which he must meet in connection with
Agreement a land severance application on his property on Silver Street
Boomanville.

THAT the Planner report to the next Council Meeting with his
recommendation.

Mr. B. Homing Mr. B. Heming of Tyrone appeared before Council relative to
re Tyrone Resolution #CW -448-76 and #CW -451-76 and also presented a
Hamlet memorandum dated September 27th, 1976 from Mr. E.R. Lovekin
in this regard.

THAT the foregoing be received for information.

Mr. J. Webb Mr. J. Webb of Tyrone presented a petition to Council
objecting to Resolution #CW -448-76 and #CW -451-76 and
requested, among other things, that all the residents of
Tyrone be consulted before any action is taken for development.

THAT Resolution #CW -448-76 tabled by Council on September 20th,
1976 be now dealt with.

THAT no action with regard to Resolution #CW -468-76 be taken
at this time and Mr. Heming be asked to submit his brief
again when the study for Tyrone is initiated.

THAT no Plan of Subdivision of more than three houses be
considered without a District Study being carried out for
the Hamlet.

THAT the petition submitted by Mr. Webb be received and
Mr. Webb be requested to submit it again when the study
for Tyrone is initiated and that a copy of this Resolution
be sent to Mr. Webb and to anyone else who requests it.

Mr, Pedwell Mr, Lovekin and Mr. Pedwell appeared before the Committee
relative to Mr. Pedwellts application for amendment to the
Regional Official Plane
Resolution #CW -472-76
Moved by Con. Entwisle, seconded by Con. Lyall,
THAT the following Resolution be adopted by Council: -
WHEREAS the east side of the road allowance between Lots 30
and 31 south of the former third (3rd) line of the former
Township of Clarke now part of the Town of Newcastle, Regional
Municipality of Durham is a fully developed residential area
and;
WHEREAS the Planning Committee of the Regional Municipality of
Durham considered further development in the area, but their
recommendations and the suggestions and proposals made by the
applicant were never formally noted on by Regional Council even
though a formal presentation was made to the said Regional
Council and;
WHEREAS it appears that in view of engineering opinion now
received that wells and septic tanks are practical and workable
in the area and;
WHEREAS the existing road has been improved and is a cal de sac
suitable for estate residential or similar style lots;
NOW THEREFORE THIS COUNCIL RECOMMENDS to Regional Authorities
and to the appropriate Provincial Ministry that the lands on the
west side of the road described above be designated in the
Regional Official Plan so that the west side of the road may be
divided in a manner similar to the existing development on the
eastern side of the road to infill the existing improved road
and to use existing hydro and telephone installations and provide
rural building lots in an area proven satisfactory for such use,

Zoning South Mr, Lovekin appeared before the Committee relative to the
End of former Zoning of land at the south end of the former Village of
Village of Newcastle.

Resolution #CW -473-76
Moved by Con. Hobbs, seconded by Con. Entwisle.
THAT it be recommended to Council that the land area in the
former Village of Newcastle bounded on the west by Wilmot's
Creek, the south by Lake Ontario, the east by the Newcastle
Harbour and Marina and Grahamis Creek, and the North by the
C.N.R. tracks and Highway 401 is in the opinion of this Council
a suitable planning block and with sewers and water now readily
available and the Solandt hydro Corridor defined the area
should be redesignated in the Official Plan from Major Open
Space to a Special Study Area to enable this Council to give
further and special study and attention pertaining to its
proper zoning.

Mr. Lovekints Mr. Lovekin also spoke on his land west of the Village of
Land Adjacent Newcastle abutting Highways 35 - 115 and Highway 401.

Moved by Con. Entwisle, seconded by Con. Tink.
WHEREAS the construction of Highways Number 115 and 401 and
the proposed Solandt Hydro Corridor and the widening of the
C.N.R. main line and the construction of a service road have
all seriously segmented this property;
AND WHEREAS the applicant has a decision of the Supreme
Court of Ontario registered on Title giving him legal access
to the abutting highway;
AND WHEREAS the property concerned has been destroyed as a
viable agricultural entity and its highest and beat possible
use would appear to be of a Highway Commercial nature;
NOW THEREFORE this Council resolves that the Official Plan
of the Region of Durham should be amended to authorize these
lands to be developed for such uses as a tourist information
centre, restaurant, museum, motel or hotel, sports complex or
similar and associated uses and that this redesignation should
be made forthwith to enable Council to properly zone and
plan for a suitable land use.

Administration THAT no action be taken relative to the proposed Administration
Study Study at this time and that it be recommended that the
1977 Council give top priority to this matter and that the
submissions be turned over to the new Council.

Harvey Jackson THAT the Plannerts report dated September 24th, 1976 relative
Grading of to a Grading Plan for Mr. Harvey Jackson's severed lots at
Lots Taunton Road and Mitchellis Corners, be concurred with.

#539.302 is acceptable.

M.M. Dillon Ltd. THAT the letter dated September 22nd, 1976 from M.M. Dillon Ltd.
Secondary Plan regarding the Courtice Secondary Plan be referred to the Chairman
for Courtice of the Study Committee (Councillor Cowman) for recommendation.

Larry's Sports THAT Mr. Best's report dated September 23rd, 1976 be received
& Marina and that Councillor Cowman liaise with Dr. Michael and get
a suggested cost of a study which she could then present to
the interested owners, and advise the Committee further.

Parking at THAT the complaint relative to Parking at Newtonville on

Bell Canada THAT the letter dated September 20th, 1976 from Bell Canada
re Property in regarding their property for sale in Bowmanville and the
Bowmanville & site of the former Newcastle Fire Hall be received for information
Newcastle and that they be advised of the action being taken to demolish
the old fire building.

Committee of THAT it be recommended to Council that Mr. Murray McKnight
Adjustment be appointed to the Committee of Adjustment to fill out the

Extension to THAT Mr. Howden appear before Council at the next regular
Flying Dutchman meeting to advise if the proposal to build apartments at

By-laws.

E1Dorado THAT it be recommended to Council that the Atomic Energy
Nuclear Control Board of Canada be advised that the Council of the
Limited Town of Newcastle is opposed to any extension of the
operations of E1 Dorado Nuclear Limited within the Town of
Newcastle.

THAT a letter be sent to the Honourable Darcy McKeough under
the signature of the Mayor asking for his assurance that the
Province of Ontario will not permit any construction by
E1Dorado Nuclear in the Town of Newcastle without the
appropriate Official Plan and Zoning By-law proceduroo and
that a copy of the letter be sent to Mr. Doug Moffatt, M.P.P.,
to ensure that the request is given consideration.

Mileage "If a member of Council is directed by Council to go out
for of the confines of the Municipality on Council business,

Policing THAT Councillor Dewar of the Police Commission be invited
of to attend the next meeting of Committee of the Whole to
Boomanville discuss the Police Commission providing foot patrols on
King Street, Boinnanville.
