HomeMy WebLinkAbout1977-07-28 Ground water InterferenceMICR RICKARD IND HEMBERS OP COUNCIL The following recommendation was made at a meeting of the Task Force held on Thursday, July 28, 1977. 1. Rgional Policy, re: Groundwater Interference That the following policy be recommended by Council to the Regional Commissioner of Works (copy to Regional Clerk) in cases where ground- water interference has resulted from dewatering and excavation operation =Regional Works Projects or other projects approved by Regional Council. (a) For the purpose of this policy, the following definitions shall. apply - 1) water serviced area means an area where the major portion of existing dwellings are served by a municipal water supply. 2) non -water serviced area means an area where the existing dwellings are served by private water supply. (b) Where the interference to a well or private water supply is of short term duration (i.e. during the course of dewatering, exoevation and/or contamination and within one month of the completion of the interference), the Region will make available to the affected party, a temporary supply of water at no cost to the affected party. (o) That where the interference to a well and/or private water supply is of long term or permanent duration and where the interference takes place in a water serviced area, the affected party will be xequired to connect to the water supply system, unless otherwise determined by the Works Committee. (d) That where the interference to a well or private water supply is of long term or permanent duration and where the interference takes place in a non -water serviced area, the water supply shall be restored at no cost to the property owner. (e) That where development causes an area to become a water serviced area the dwellings existing at the time of the appropriate by-laws or agreements within the said water serviced area, shell be subject to the provisions of item "d" (f) That where dewatering or contamination is caused by Regional Works or other projects approved by Regional Council, the Region shall act as the agent to restore water to the affected residents and the Region shall recover the costs of same from the party or parties responsible for the dewatering and/or contamination. (g) In the event the Region install a lateral pipe to correct a dewatering situation, no dwelling units as described in item "d" will be required to y frontage and connection charges.
