Minutes of a meeting of the Legislation and By -Laws Committee
held in the Bowmanville Committee Room at 9 a.m. on Tuesday,
October 11th, 1977.
Roll Present were: Councillor Jasper W. Holliday, Chairman
Call Councillor Donald W. Allin, Member - at 9:25 a.m.
Councillor Edward R. Woodyard, Member
Town Clerk J.M. McIlroy, Secretary
Attending: Councillor R. Bruce Taylor
Resolution #LB -224-77
Moved by Con. Holliday, seconded by Con. Woodyard.
Adoption of THAT the minutes of meeting held on September 26th, 1977 be
Minutes adopted as read.

John McMillan Mr. John F. McMillan appeared before the Committee with regard
re By -Laws to By -Law No. 77-51 and 77-60 (Clarke Zoning By -Law).
77-51 and
77-60 Mr. McMillan's concern was that he would at some future date
like to build a cottage on the property for his children, but
it appeared by the By-law would not allow this. It was pointed
out that the existing Clarke Zoning By-law would not allow this
either. Mr. McMillan wondered if in the Consultants revision
of the Town's Zoning By-law something could be done to help the
situation.

Moved by Con. Allin, seconded by Con. Woodyard.
THAT the Planning Administration Committee be advised of
Mr. McMillan's concerns with the suggestion that this could be
accommodated in the general revision of the Zoning By-law.

Mr. McMillan said that he would send a letter to withdraw his
objection to By -Law No. 77-51 and 77-60.

THAT Mr. Woodstra be invited to the next meeting to discuss his
objections to the By-laws.

Zoning Amendment
By-law THAT Resolution #LB -221-77 be again referred to the Planning
(Vanhaverbeke) Department with the request that they report thereon to the
next meeting.

Resolution #LB -228-77
Moved by Con. Woodyard, seconded by Con. Holliday.
Proxy THAT it be recommended to Council that the Town Solicitor be
Voting requested to submit a legal opinion, as to under what
circumstances proxy voting is allowable with regard to Municipal
Governments or Municipally appointed Boards, with particular
reference to the Town Clerk's report on this matter, which was
considered by Council on October 3rd, 1977 and referred to this
Committee.

Oshawa THAT Oshawa By-law 69-77 be referred to the Planner to confer
By -Law with the Chairman of the Planning Administration Committee and
69-77 take what ever action is necessary.

Petty
Trespassing THAT the matter of Petty Trespassing Act be placed on the
Act next Agenda.
