Roll Present: Councillor Jasper W. Holliday, Chairman Call Councillor Donald W. Allin, Member. Councillor Edward R. Woodyard, Member . Mayor Garnet B. Rickard, Member Mr. David J.D. Sims, Town Solicitor Mr. H.R. Best, By -Law Enforcement Officer Mr. J. Dunham, Director of Public Works Mr. J.M. Mcllroy, Town Clerk, Secretary Resolution #LB -1-77 Moved by Con. Woodyard, seconded by Con. Allin. Camera THAT the meeting be closed to consider a legal matter. "CARRIED" Resolution #LB -2-77 Moved by Con. Woodyard, seconded by Con. Allin. Oshawa By -Law THAT the Town Solicitor be instructed to act on behalf of the No. 124-76 Town of Newcastle in the matter of Oshawa By -Law No. 124-76 at the Ontario Municipal Board Hearing on February 4th, 1977 on the terms as discussed at this meeting and in keeping with Mr. G.F. Howden's report dated January 21st, 1977. "CARRIED" Resolution #LB -3-77 Moved by Con. Allin, seconded by Con. Woodyard. Open Meeting THAT the meeting now be open. "CARRIED" Mr. Evans Mr. Evans, R.R. #1, Orono, appeared before the Committee relative. re Station to the proposed Senior Citizens Homes to be built by the Durham Street, County Senior Citizens Lodge. He said that he represented a group Orono which wished the first project to be at Station Street, Orono. Legislation & By -Laws Committee - 2 - January 24th, 1977 Resolution #LB -4-77 Moved by Con. Woodyard, seconded by Mayor Rickard. THAT the Chairman of the Committee call a meeting for 3 p.m. on Friday, January 28th in the Committee Room Bowmanville Town Hall and the following be invited; Planning Director, Director of Public Works, Town Solicitor, Mr. Lovekin, Representative of Durham County Senior Citizens Lodge, Mr. Moffatt, Regional Works Department and Regional Planning Department. The main purpose of the meeting is for all parties to be brought up-to-date on the progress of the project, conditional on Mr. Sims providing information on the Road acquisition. "CARRIED" Mr. White Mr. White appeared before the Committee relative to a parking 3 Durham problem on Durham Street. Street Resolution #LB -5-77 Moved by Con. Woodyard, seconded by Con. Allin. THAT the matter be referred to Mr. Best and Mr. Dunham to study and report back to the Committee. "CARRIED" Use of Trailer Mr. Best submitted a Confidential Report relative to at Cedar Crest Mrs. Haight's application to use a trailer at Cedar Crest Beach Road Beach Road pending finding suitable permanent accommodations. Resolution #LB -6-77 Moved by Con. Allin, seconded by Con. Woodyard. THAT due to extenuating circumstances of a confidential nature and contingent on finding alternative permanent accommodation Mr. $ Mrs. Haight be permitted to use their trailer at 41 Cedar Crest Beach Road for four months, subject to signing suitable agreement. "CARRIED" Drainage Mr. Best advised Council of a drainage problem on Sunset Road. Problem Sunset Road Resolution #LB -7-77 Moved by Mayor Rickard, seconded by Con. Allin. THAT Mr. Best be given the authority to consult the Town Solicitor and appropriate staff and report back relative to a. satisfactory agreement to resolve the problem. Best was instructed to consult with Town Solicitor M.T.C. regarding the legality of a trailer parking an M.T.C. Property property and report back. Snowmobiles THAT Mr. Best's information relative to putting posts at the on Town entrance to Town owned walkways be submitted to the Public Walkways Works Committee. "CARRIED" Resolution #LB -10-77 Moved by Con. Allin, seconded by Con. Woodyard. O.M,B. Hearing THAT the Ontario Municipal Board Notice of Hearing regarding re Township of Township of Manvers Zoning By-law be reviewed by the Planner Manvers Zoning and Director of Public Works and that they be given authority By -Law to attend the Hearing if necessary and that the Regional Works Commissioner also be advised. "CARRIED" Ontario Home THAT the letter dated December 13th, 1976 from the Regional Renewal Clerk relative to the Ontario Home Renewal Program Rental Program be received for information. City of THAT the Resolution submitted by the City of Woodstock Woodstock relative to the Fire Department Act be received for information. Resolution re Fire Dept. Act "CARRIED" Resolution #LB -12-77 Moved by Con. Allin, seconded by Mayor Rickard. Ontario Home THAT the letter dated December 13th, 1976 from the Regional Renewal Clerk relative to the Ontario Home Renewal Program Rental Program be received for information. Tile THAT the following applications for Tile Drainage Loans be Drainage approved: - Loans Total Cost Loan Mr. Newton Selby $12,000 $9,000 Mr. Joe Bouma 5,200 3,900 "CARRIED" Resolution #LB -14-77 Moved by Mayor Rickard, seconded by Con. Allin. THAT the Ministry of Agriculture and Food be requested to approve of addition-il funds as a total By-law of $200,000 has been approved for this municipality and that Mayor Rickard and Councillor Taylor be authorized to make a direct approach to the Ministry. Drainage THAT the letter dated January 7th, 1977 from the Ministry of Commissioners Agriculture and Food be referred to Mr. Dunham to report on Course whether Council should send someone to the four and half day course for Drainage Conmissioners. Committee THAT it be recom::+ended to Council that the responsibilities Responsibilities of the Legislation and By -Laws Committee should be as follows: - Legal Matters, Br -Laws, By -Law Enforcement, Parking Enforcement, Building and Plumbing Inspection.
