THAT Report COD-031-03 be received; 2, THAT a Lease Agreement with the Regional Municipality of Durham for approximately 1500 square feet of space at the proposed Courtice Fire Station to be located at 2611 Trulls Road for the Courtice Community Policing Centre at an all inclusive rate of $19.45 per square foot (to be adjusted annually in accordance with the inflation index) be approved; 3. THAT the term of the lease be ten years from the date of completion or upon fifteen (15) days from the date of notice that the space is ready for occupancy; 4, THAT the lease provide for an extension upon expiry of the initial term, subject to successful negotiation of an agreement; 5, THAT the terms and conditions of the lease be subject to the approval of the Solicitor for the Municipality of Clarington; and 6, THAT the attached by-law marked Schedule "A" authorizing the Mayor and the Clerk to execute the lease agreement with the Regional Municipality of Durham be approved. REPORT NO.: COD-031-03 PAGE 2 BACKGROUND AND COMMENT In January of this year, the Durham Regional Police Services Board approved a motion authorizing the Police Chief and Staff to commence design I space discussions with the Municipality of Clarington for the purpose of locating the proposed Courtice Community Policing Centre at the planned Courtice Fire Station. Subsequently meetings were held with staff from the Region of Durham, the Durham Regional Police, Municipality of Clarington Community Services Department and Purchasing. The lease agreement is proposed to lease the Durham Regional Police approximately 1500 Square feet of space at the proposed Courtice Fire Station to be located at 2611 Trulls Road at an all inclusive rate of $19.45 per square foot. This rate includes the cost of water, hydro, heat, garbage removal, snow clearing, and janitorial services and will be adjusted annually in accordance with the inflation index. The term of the lease will be ten (10 years) from the dated of completion or upon fifteen (15) days from the date of notice that the space is ready for occupancy. The lease will provide for an extension, upon expiry of the initial term, subject to successful negotiation of an agreement. A concept drawing from the, Facilities Manager for Durham Regional Police Service has been received and will be provided to the successful architect for the project. It is understood that in addition to the required space there will also be shared use of the facilities main washrooms, lunchroom and general areas within the building, and designated parking areas. The solicitor for the Municipality of Clarington has reviewed the standard lease agreement received from the Region of Durham and will be forwarding his comments to the solicitor for the Region of Durham, With the exception of some minor changes the agreement appears to be acceptable, 2 . REPORT NO.: COD-031-03 PAGE 3 Therefore, in an effort to ensure that this project is able to proceed prior to the pending summer Council recess for both the Municipality of Clarington and the Region of Durham, approval of the necessary by-law to execute an agreement is requested subject to all terms and conditions of the agreement being acceptable to the Municipality's solicitor, A similar report will be presented to the Council for the Region of Durham prior to their summer recess. THAT the contract attached hereto as Schedule "A" form part of this By-law. By-law read a first and second time this day of ,2003.
