April 21, 1986 Minutes of a meeting of the General Purpose & Administration Committee, held on Monday, April 21, 1986, at 9:30 a.m., in Court Room #2. Present Were: Mayor John Winters Councillor A. Proposed Zoning By-law Amendment, Part of Lot 11, Concession 10, former Township of Darlington (Paul Langley The Chairman announced the purpose of the Public Meeting: As required under the new Planning Act (Section 34(12), Council is holding a public meeting prior to either adopting or rejecting the proposed zoning by-law amendment for Part of Lot 11, Concession 10, former Township of Darlington. The Chairman asked if there were any persons present wishing to speak to this matter. No person indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Clerk to advise on the manner of notice: The Clerk advised that: a) Public Notice was mailed to property owners within 120m of the subject property on March 18, 1986; b) Notice of the Public Meeting was posted on the property by March 21, 1986; c) The Notice complies with the regulations under the Planning Act. The proposed zoning by-law amendment would change the zone category of a 5.91 hectare (14.6 acre) parcel of land located in Part of Lot 11, Concession 10, former Township of Darlington, from "Extractive Industrial (M3)" to "Agricultural (A)." The proposed zoning change would permit a single family dwelling. The proposed zoning by-law amendment would change the zone category of a portion of a 55.28 hectare (139.59 acre) parcel of land located in Part of Lot 34, Concession 4, former Township of Darlington, from "Environmental Protection (EP)" to a "Special Exception Provision." . The proposed zoning change would permit the development of a sales outlet for nursery stock grown on the farm. The Chairman announced the purpose of the Public Meeting: As required under the new Planning Act (Section 34(12), Council is holding a public meeting prior to either adopting or rejecting the proposed zoning by-law amendment for Part of Lot 11, Concession 4, former Township of Darlington. The Chairman asked if there were any persons present wishing to speak to this matter. One person indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Clerk to advise on the manner of notice: The Clerk advised that: a) Public Notice was mailed to property owners within 120m of the subject property on March 18, 1986; b) Notice of the Public Meeting was posted on the property by March 21, 1986; c) The Notice complies with the regulations under the Planning Act. The Chairman announced that any person wishing further notice of the passage of the by-law, if passed, to please leave their name, address and telephone number with the Deputy Clerk before they leave. The Chairman called on the Director of Planning to briefly describe the purpose and effect of the by-law, and how the by-law accomplishes the stated purpose. The proposed zoning by-law amendment would change the zone category of a 1.26 hectare (11.9 acre) parcel of land located in Part of Lot 11, Concession 4, former Township of Darlington, from "Agricultural (A)" to "Residential Cluster (RC)." The proposed zoning change would permit the development of additional residential lots. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-law, and that all questions must be asked through the chair. The Chairman announced that Committee would now hear from objectors, first explaining that Council wishes input prior to a final decision. Robert Carruthers, R.R. #1, Bowmanville, L1C 3K2, voiced his personal concerns relative to the precedent this proposal may set. The owner of the subject land is related to other owners of property, similar in size, in the area. Would they be allowed to sever their lands? Mr. Carruthers has a tremendous investment in his apple orchard. He owns 80 acres in Concession 4 and 50 acres in Concession 3, abutting the subject lands. G.P.A. Cont'd . . . - 4 - Apri I 21, 1986 Often the workers do their spraying at 3:00 or 4:00 a.m. The noise and spray drift may be objectionable to an urban dweller. Mr. Carruthers realizes the subject land is not valuable farm land, but he is concerned that the proposed zoning by-law amendment may have an adverse affect on his operation. The Chairman announced that Committee would now hear from those in support of this proposal. Mr. Bob Craig, R.R. #5, Bowmanville, L1C 3K6, spoke in support of his application. He has lived in agriculture all his life. He wishes to provide housing for his sons who are involved in a landscaping business. He purchased 12 acres on the corner with the idea of having a small horse farm, but cannot sever the horse barn from the lands. Mr. Craig wishes to create 3 or 4 residential lots. He asked the Committee's indulgence while he discusses the access with the Region. The Chairman concluded the public meeting. ********************************************* Proposed Zoning By-law Amendment, Part of lot 25, Concession 1, former Township of Darlington (Lenora Nicholls) The Chairman announced the purpose of the Public Meeting. As required under the new Planning Act (Section 34(12), Council is holding a public meeting prior to either adopting or rejecting the proposed zoning by-law amendment for Part Lot 25, Concession 1, former Township of Darlington. The Chairman asked if there were any persons present wishing to speak to this matter. Four persons indicated a desire to speak to this amendment. Before proceeding with this matter, the Chairman asked the Clerk to advise on the manner of notice. The Clerk advised that: a) Public Notice was mailed to property owners within 120m of the subject property on March 18, 1986; b) Notice of the Public Meeting was posted on the property by Ma rch 21, 1986; c) The Notice complies with the regulations under the Planning Act. The Chairman announced that any person wishing further notice of the passage of the by-law, if passed, to please leave their name, address and telephone number with the Deputy Clerk before they leave. PUBLIC MEETINGS Lenora Nicholls Cont'd The Chairman called on the Director of Planning to briefly describe the purpose and effect of the by-law, and how the by-law accomplishes the stated purpose. The proposed zoning by-law amendment would change the zone category of a 4.13 hectare (10.2 acre) parcel of land located in Part of Lot 25, Concession 1, former Township of Darlington, from "Agricultural (A)" to a "Special Exception Provision." The proposed zoning change would permit a group home as defined within Zoning By-law 84-63. . The Planner noted that 3 letters of objection were received from the following persons: Mr. Bill Patterson, R.R. 2, Bowmanville; Mr. W. Andrews, R. R. 2, Bowmanville; Mr. G. Osumek, R. R. 2, Bowmanville. The Chairman announced that questions may be asked concerning the manner of notice or the purpose and effect of the by-law, and that all questions must be asked through the Chair. The Chairman announced that Committee would now hear from objectors, first explaining that Council wishes input prior to a final decision. Mr. Bill Patters()n,--R.R.#2-, Bowmall\lille, Lot 25, Concession 1, requested that the following concerns be add-ressed: 1. The number of residents to reside there; 2. The extent of mental retardation or illness. Will there be a stipulation read into the amendment as to degree of mental illness? . 3. Winter access - the driveway is very long. Others have experienced some difficulty in getting through in the winter. Also, the road is not the safest. Mr. W. Andrew, R. R. 2, BowmanvilIe, stated that most of his concerns were voiced by Mr. Patterson. However, he asked if the property would be fenced? He had one bad experience in Whitby where he previously resided. Mrs. Osumek, R. R. 2, Bowmanville,voiced her concerns. She also questioned the fencing requirements and if they would be adequate for safety. Will the residents be supervised and what age group will they be? The Chairman announced that Committee would now hear from those in support of the proposal. Lenora Nicholls spoke in support of her application. The proposed group home will be under the direction of the Ministry of Community and Social Services. There w!ll be a total of 6 high function mentally retarded reSIdents In the 19-34 age group none of them are physically handicapped. . . . G.P.A. The residents will not be sitting idle because the plan involves establishing a green house and garden plots, as well as goats and chickens for ~he~re~idents to be trained~to look after. The staff ratio will more than one to one:-Mrs. Nicholls plans to employ 3 trained and certified councillors, 2 night staff and 2 day staff as well as a director. Mrs. Nicholls is a registered nurse. The residents will be supervised at all times and are not allowed to leave the grounds or walk on the streets alone. The property will be adequately fenced. Two wells exist on the property and the septic system has been checked by the Public Health. Renovations to the house will have to be performed once the proposal is submitted to the government. These residents each receive a pension and further subsidy if required. The Chairman concluded the public meeting. ********************************************* DELEGATIONS The Chairman announced that the delegations of Mrs. George Elliott, Mr. Tine Toushan and Mr. Frank Shane would not be making a presentation. Mr. Roy Forrester, Orono, voiced his concern about how the municipality is taking care of the Environment. He cited locations where regard for the environment was not addressed. The locations are generally where road construction is taking place. Topsoil is going into the ditch and running into the streams and watercourses. Responsible industries when searching for a municipality to locate in, are examining how that muni- cipality takes care of its environment. In conclusion, Mr. Forrester asked for a commitment from the Town to protect the environment. Having a concern for the environment is not anti- development. That the following resolution be adopted by Council and forwarded to the Ontario Municipal Board together with a copy of By-law 86-29: WHEREAS the Council of the Town of Newcastle has approved By-law 86-29, to amend By-law 84-63, as amended, being the Town's Comprehensive Zoning By-law as a result of their consideration of an application for such an amendment submitted by the property owner; AND WHEREAS the effective By-law 86-29 was to change the zone designation of the land subject to By-law 86-29 from "Env i ronmental Protection (EP)" to "Urban Residential Type One Density (R1)" zone to permit the development of ten (10) residential lots for single family dwellings; AND WHEREAS By-law 86-29, has been approved in conformity with the applicable policies of the Durham Regional Official Plan and the Courtice Urban Area Official Plan; AND BE IT NOW THEREFORE RESOLVED THAT the Town of Newcastle hereby requests the Ontario Municipal Board to convene any required hearings in r~spect of By-law 86-29 at the earliest possible opportunIty; and G.P.A. That the Newcastle Community Services Planning Board be requested to host a seminar on Insurance and Risk Management for all hall boards and community groups and that our insurance carriers be requested to provide technical back-up for such a seminar. Minutes TREASURER - 14 - April 21, 1986 Councillor Hubbard chaired this portion of the meeting for Councillor Wotten. Councillor Wotten made a declaration of Interest relative to Report TR-23-86; vacated his chair and refrained from voting on the subject matter. Councillor Wotten is a Stock Evaluator and the subject report contains claims that relate to him.
