1. Call to Order
Chairperson Todd Taylor called the meeting to order at 7:00 pm
2. Disclosures of Pecuniary Interest
There were no pecuniary interests stated for this meeting
3. Applications
3.1 A2016-0071 Peter Thorne
210 King Avenue West, Newcastle Village
Part Lot 29, Concession 2
Former Town of Newcastle Village
This application was previously tabled at the Committee of Adjustment Meeting held on
November 24, 2016 in order to provide staff with the opportunity to clarify outstanding
issues related to the status of the building's non -conformity and other related issues.
The Committee was provided with revised Comments for this meeting which addressed
the concerns expressed by the Committee at the previous meeting.
The applicant Peter Thorne made a verbal presentation to the Committee regarding the
application. The explanation for the proposed variance was similar to what was outlined
in the report prepared for this application.
There were no questions from the Committee, and there were no members of the public
in objection or support.
Moved by Gord Wallace, seconded by John Bate.
"Based on staff's review of the application and agency comments received, the
application meets the intent of the Zoning By-law and the intent and purpose of the
Official Plan. The application is considered minor in nature and not detrimental to the
neighbourhood.
The application is APPROVED to satisfy a condition of an application to the Land
Division Committee by permitting an existing legal non -complying accessory building on
a newly severed lot where a principal building does not exist and recognizing that the
existing legal non -complying accessory building on the newly severed lot has a total
floor area of 178.37 square metres and a height of 5.79 metres subject to the following
condition:
1. That the existing woodshed be removed from the property within 6 months of
the Committee's decision on the minor variance."

Committee Member, Todd Taylor called upon the applicant to come forward and to
describe the application.
No applicant or agent was present at the meeting and there were no members of the
public in objection or support.
Planner, Amanda Watson explained to the Committee members that an applicant or
agent does not have to be present for the Committee to vote on an application.
The Committee discussed the proposed variance and concluded that they felt
comfortable supporting the subject application without hearing from the applicant.
Moved by John Bate, seconded by Gord Wallace.
"Based on staff's review of the application and agency comments received, the
application meets the intent of the Zoning By-law and the intent and purpose of the
Official Plan. The application is considered minor in nature and not detrimental to the
neighbourhood.
The application is APPROVED to permit the reduction of the required interior side yard
setback from 1.25 metres to 0.6 metres subject to the following condition:
1) That the applicant satisfies the concerns identified by the Regional Health
Department prior to obtaining a building permit for the proposed addition."

4. Adoption of Minutes of Previous Meeting
Moved by Jim Vinson, seconded by John Bate.
"That the minutes of the meeting of the Committee of Adjustment, held on November
24, 2016 be approved."
5. Other Business:
Appeal date for the foregoing applications is January 4, 2017
Next Meeting of the Committee of Adjustment is January 19, 2017
