PUBLIC HEARINGS
As required under the new Planning Act (Section 34(12)), COuncil is holding
public meetings prior to either adopting or rejecting the following:
a) Official plan Amendment, Rezoning & Subdivision Applications - Part Lot 25,
Concession 6, Former Tbwnship of Darlington - Westlake;
b) Rezoning Application - Part Lots 15/16, Concession 1, Former Township of
Darlington - Markborough properties and West Bowmanville Developments Limited;
c) Rezoning Application - Part Lot 21, COncession 10, Former Township of Clarke -
Taylor Sand and Gravel;
d) Rezoning Application - Part Lot 12, COncession 2, Former Town of Bowmanville -
Templeton - Lepek; and
e) Rezoning Application - Part Lot 30, Concession 2, Former Tbwnship of Clarke
828741 Ontario Limited.
The Chairman asked if there were any persons present wishing to speak to these
matters. Several people indicated a desire to speak.
Before proceeding with these matters, the Chairman asked the Deputy Clerk to
advise on the manner of notice.
The Deputy Clerk advised that:
a) Public Notices were mailed to all property owners within 120 metres by
August 4, 1989.
b) Notices of the public meetings were posted on the properties by August 4, 1989.
c) The notices comply with the regulations under the Planning Act.
The Chairman announced that any persons wishing further notice of the passage
of the by-laws, if passed, to please leave their name, address and telephone
number with the Deputy Clerk before they leave.
The Chairman called on the Director of Planning and Development to briefly describe
the purpose and effect of the by-laws and how the by-laws accomplish the stated
purposes.

PUBLIC HEARINGS
The purpose and effect of the applications are as follows:
a) Westlake (821010 Ontario Limited) - to permit the development of a forty-five
(45) lot residential subdivision;
b) Bowmanville Developments Limited - to permit the development of approximately
4230 sq.m. of retail commercial floorspace and 900 sq.m. for motor vehicle
repair garage and fuel bar uses;
c) Taylor Sand & Gravel - to permit the development of a Gravel pit operation;
d) Templeton - Lepek - to permit the developnent of a Plan of subdivision,
approving fifty-two (52) lots and one (1) block for future use; and
e) 828741 Ontario Limited - to permit the development of a commercial complex
with a total floor area of approximately 500 square metres.
The Chairman announced that questions may be asked concerning the manner of
notice or the purpose and effect of the by-laws and that all questions must
be asked through the Chair.
The Chairman announced that Committee would hear from the objectors, then anyone
in support, with the applicant speaking last.
a) Official Plan Amendment, Rezoning & Subdivision Applications, Part Lot 25
Concession 6, Former 'Ibwnship of Darlington - Westlake (821010 Ontario
Limited) - PD-199-89.
Councillor Wbtten made a declaration of interest with respect to Report PD-199-89;
vacated his chair and refrained from discussion and voting on the subject matter;
COuncillor Wotten indicated that he owns property in close proximity to the
subject land.
Dr. Bill Grant, R.R. JIl, Hampton, Ontario LOB lJO appeared on behalf of his
family and neighbours and expressed concerns that this application will set
a negative precedent, create water problems and hazardous traffic conditions.
He feels that industrial development in this area would generate more revenue
to the 'Ibwn than residential development. He further advised that approval
of this application would have an adverse affect on the community of Solina.
David T. Gray, R.R. #1, Hampton, Ontario LOB lJO appeared before the COmmittee
and concurred with Dr. Grant's remarks.
The Chairman announced that COmmittee would now hear from all persons in support
of the application.
Jean Bihan, 198 Switzer Drive, Oshawa, Ontario LlG 3J8 appeared on behalf of five
residents who live directly across the street from the proposed site. These
residents have never encountered problems with water. The erection of additional
homes would create a greater tax revenue base for the municipality. Surrounding
agricultural lands have not been used for farming and therefore should be used for
residential purposes.

Joe Dalymple, P.O. Box 2247, Oshawa, Ontario LlH 7V5, solicitor for the applicant,
was present to answer questions from the COmmittee.
b) Rezoning Application, Part Lots 15/16, COncession 1, Former 'Ibwnship of
Darlington - Markborough properties and West Bowmanville Developments
Limited - PD-200-89.
No one spoke in objection to or in support of the application.
Kevin Tunney, Tunney planning, 340 Byron Street South, Whitby, Ontario, LlN 4PS was
present on behalf of the applicant to answer questions from the COmmittee.
c) Rezoning Application, Part Lot 21, Concession 10, Former 'Ibwnship of Clarke -
Taylor Sand & Gravel - PD-202-89.
Allan Schwartz, 15 Whitney Avenue, 'Ibronto, Ontario M4W 2A7 has been a weekend
resident of this area for 11 years and articulated objection to this proposal
for the following reasons:
1) He does not want to have the gravel pit as a neighbour with its associated
sights and sounds of gravel trucks; and
2) Environmental concerns include the Ganaraska Region and water supply.
Tim McKeen, R.R. '2, Orono, Ontario, LOB lMO, owns 70 acres adjacent to the site
and has concerns for the safety of his two small children if this application is
approved. He feels that the operation of the gravel pit will cause land value
depreciation and gravel trucks will create a hazardous traffic situation.
Catherine Braid, 135 Roxborough Avenue, 'Ibronto, Ontario, M4W lX5 informed the
COmmittee that her family owns a 100 acre farm on the north side of the proposed
site and concurred with Mr. McKeen's remarks.
Dennis Hartwig, R.R. 12, Orono, Ontario, LOB lMO, has lived directly across the
road from the proposed development for 12 years and concurred with Mr. McKeen's
remarks.
Phillip Schiuk, 259 Simcoe Street South, Oshawa, Ontario, LlG 4H3 appeared on
behalf of his parents and his family who reside adjacent to the proposed gravel
pit. Mr. Schiuk concurred with Mr. McKeen's remarks.
No one spoke in support of the application.
Blair Culham, Ontario Land Surveyor, 68 King St. E., Bowmanville, Ontario, LIe lN3
appeared on behalf of the applicant and noted the following points:
- access to the gravel pit will be located to the east rather than the north
- no geotechnical study will be submitted as the Health Department has stated
that the operation of the gravel pit will not impact the water table
- the gravel pit will be 15 metres deep, not 1,000 feet deep
- it is not intended that the operation of the gravel pit will turn into a
major operation
- the applicant is more than willing to accommodate concerns of the Planning
Department
- the gravel pit will be conducting its operation in the Orono area.

Ternpleton-Lepek - PD-203-89.
NO one spoke in opposition to or in support of this application.
e) Rezoning Application - Part Lot 30, Concession 2, Former Tbwnship of Clarke -
828741 Ontario Limited - PD-204-89.
Bob Stephenson, Box 134, Newcastle, Ontario circulated a letter dated August 25,
1989 in opposition to this application stating that a commercial facility and
associated traffic, surplus garbage, etc. cannot be tolerated in a residential
neighbourhood.
Kevin Tunney, Tunney Planning, 340 Byron Street S., Whitby, Ontario, LlN 4P8
advised the COmmittee that he is not opposed to this application but wished to
inform the Committee that his firm will be submitting applications to the 'Ibwn of
Newcastle on behalf of owners located to the east and west of this proposal.
No one spoke in support of the application.
Lawrence Gold, 2040 Yonge Street, Suite 300, Toronto, Ontario, M4S lZ9, agent for the
applicant, categorized this application as a convenience/commercial type
operation having 5,400 square feet in floor area.
DELEXiATIONS
Councillor Hooper made a declaration of interest with respect to the delegation
of Mr. Neil Laird, Charterways; vacated his chair and refrained from discussion
and voting on the subject matter. A member of Mr. Hooper's family is employed
by this organization.
Mr. Neil Laird., Charterways re: Public Transit - Town of Newcastle - re: Report
WD-69-89, advised that the 'Ibwn of Newcastle is in need of a transit system
and Charterways could proficiently meet this need. He extended an invitation
to members of the COmmittee to inspect the facility. Charterways is in operation
in Whitby, Ajax and CObourg and would be willing to work in cooperation with
GO Transit and Oshawa Transit.
Ms. Sophie Pridie, 19 Orchard Park Drive, Bowmanville, Ontario, LIe 4Bl
re: Report PD-187-89, expressed opposition to the Nor-Arm Developments application
and informed the COmmittee that large signs have already been erected to advertise
properties for sale.
Mr. E. VandeWalker, 623 King St. E., Newcastle, Ontario, LOA lHO re: Report
PD-208-89, owner of Newcastle Trailer Park, circulated a letter and requested that
the COmmittee table Report PD-208-89 for a period of two to three months.
Mike COnnelly, 623 King St. E., Newcastle, Ontario, LOA lHO re: Report PD-208-89
resident of the trailer park, circulated a letter dated September 5, 1989 wherein
he states that there have been no health risks since the park opened and the
residents are not destructive to property of others. The trailer park residents
cannot afford to buy new homes and he fears that the residents will suffer personal
losses in the amounts of $35,000. to $60,000. if they are evicted.

was called but was not present.
Eliza Mostert, R.R. 12, Newcastle, Ontario, LOA lHO re: Report PD-208-89, circulated
a letter in opposition to the rezoning application stating that it would set
an undesirable precedent to legalize what is an illegal operation, the trailer
park is located in a flood plain and does not have municipal sewage and water
services.
Guy Carriere, 623 King St. E., Newcastle, Ontario, LOA lHO re: Report PD-208-89,
concurred with Mr. Cbnnelly's comments.
Leonard Secord, 623 King St. E., Newcastle, Ontario, LOA lHO re: Report PD-208-89,
was called but did not wish to speak.
Maureen Vowles, 4985 Ashburn Rd. S., R.R. n, Brooklin, Ontario re: Report
PD-208-89, appeared on behalf of her son Mark and his wife who have recently
moved into the trailer park on her advice because she was told that the Newcastle
Trailer Park was a year-round operation. She concurred with Mr. Cbnnelly's comments.
Rick Dallaire, 623 King St. E., Newcastle, Ontario, LOA lHO was present but
did not wish to speak.

Darren VandeWalker, 623 King St. E., Newcastle, Ontario, LOA lHO re: Report
PD-208-89, advised the COmmittee that he is the son of Mr. & Mrs. VandeWalker,
owners of the Newcastle Trailer Park, and circulated a letter dated September 5,
1989 wherein he states that the residents have actively worked towards correcting
deficiencies. Present use of the Newcastle Trailer Park by its inhabitants
is primarily for principle residency and therefore it is a quiet, responsible park.
HOwever, seasonal use could create a recreational park and as a result the park
could become party atmospheric.
Frank Williams, 623 King St. E., Newcastle, Ontario, LOA lHO re: Report PD-208-89
circulated a letter dated September 5, 1989 which concurred with Darren
VandeWalker's comments.
Edna Lackland, Chris Smith and Associates, 146 simcoe St.. N., 2nd Floor, Oshawa,
Ontario, LlG 4S7 re: PD-209-89, requested the Committee to table Report PD-209-89
until September 18, 1989.
Beatrice Wells, 6 Barbara Street, Bowmanville, Ontario Lle 2E4 re: PD-209-89
circulated a petition in opposition to this application.
Anthony Pugliese, 307 Scugog st. N., Bowmanville, Ontario, LlC 3K2 re: PD-210-89,
expressed opposition to this proposal on the basis that semi-detached dwellings
and townhouses will lower property values. He feels that widening of the road
will have an adverse affect on trees and landscaping. He questioned who will
absorb the cost of fire protection.

Dirk Brinkman, R.R. 41, Bowmanville, Ontario, LlC 3K2 re: Report PD-210-89, was
called but was not present.
Jim Griffin, R.R. 12, Bowmanville, Ontario, LIC 3K2 re: Report PD-210-89,
circulated a letter dated August 31, 1989 and requested further public meetings
so that citizens receive up-to-date information as to how such a massive development
will be serviced with roads, water, sewers and recreational facilities. He
concurred with Mr. Pugliese's comments.
Peter Feddema, 7 Luverme Crescent, Bowmanville, Ontario, LlC 3K4 re: Report
pD-2l0-89, was called but was not present.
Sharon Knapp, 288 Scugog Street, Bowmanville, Ontario re: PD-210-89, representative
of the North Bowmanville Rate Payers Association, is worried about the size
of the commercial portion of this development. She and local residents feel
that single family dwellings would be more suitable.
ROn Siebenga, Durham Christian High School Association, R.R. 11, Bowmanville,
Ontario, LlC 3K2 circulated a copy of a letter dated October 5, 1988 in opposition
to this proposal. He noted that resident groups have held numerous meetings with
the Planning Department and encourage continued liaison. He referred to his
letter dated October 5, 1988 which outlined all concerns of the residents and
requested a response which would satisfactorily address all these concerns.
Fred Kiy, R.R. 11, Bowmanville, Ontario, Lle 3K2 was called but was not present.
Mrs. Joseph Guest, R.R. 11, Bowmanville, Ontario, LlC 3K2 does not want to live
beside a wreck yard and if this application is approved, privacy fencing should be
installed, the number of vehicles should be restricted and the site should have
a neat appearance.
Joan Kingston, G.M. Sernas, 110 scotia COurt, Unit 41, Whitby, Ontario, LlN 8Y7
agent for the applicant, displayed a site plan of the proposed development and
requested the COmmittee to approve the application on its merit as the applicant
is willing to meet all the requirements of the 'Ibwn of Newcastle.

THAT, in accordance with the Auditor's reconrnendations, and in compliance
with the Municipal Act, Sections 81 & 82, the local Recreation and
Community Boards (with the exception of the Orono Arena, Newcastle
Arena and the Newcastle Community Hall) be dissolved as established
Boards of Council;
THAT these Community and Recreation Boards be allowed to operate
in similar fashion to the way they have historically, with the exception
that they would not be required to submit their records for
consolidation with those of the TOwn, and that there would be a
mutual agreement established whereby the TOwn would lease the currently
occupied premises for a nominal fee of $2.00 per year; and
THAT the local Recreation and Community Boards affected be notified
that this procedure will be effective for the year ending December 31,
1989 and that they will be contacted prior to that date regarding
an appropriate agreement.

THAT the Tbwn enter into an agreement with Mr. Arthur Trewin to
provide for dedication to the TOwn of a 2l. 65 m (66') wide roadway
more or less centered on the existing laneway including sufficient
land at the end of the laneway to construct a turn-around circle,
at no oost to the Tbwn other than survey and legal costs, and that
the Tbwn agree to dedicate this land as a public highway;
THAT an agreement be entered into with Mr. Harry Grace to provide
the Tbwn to perform year-round maintenance of his laneway until
such time as the property changes hands, after which time the Tbwn
will no longer carry-out any maintenance of the laneway and that
this agreement be registered on title;
THAT $14,000 be provided in the 1990 Budget to cover survey and
legal costs and the upgrading of the Trewin and Grace laneways to acceptable
standards for year-round maintenance; and
THAT a copy of this report be sent to Mr. Arthur Trewin, Mr. Harry Grace
and Mr. Meoola Uriadka.
