HomeMy WebLinkAbout2016-081 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 2016 - 081 being a by-law to amend Clarington Museum and Archives Board By-law 2012-093 WHEREAS on December 17, 2012 Council passed Clarington Museum and Archives Board By-law 2012-093; and WHEREAS Council deems it advisable to amend such by-law. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Clause 2 a) of By-law 2012-093 is deleted and the following substituted therefor: a) Composition The Board shall be established to manage the Clarington Museum and Archives. The Board shall consist of 7 voting members comprised of, i) 5 public representatives at large; and ii) 2 appointed members of Council. 2. By-law 2012-093 is amended by adding the following wording to clause 5 b): If the Board chooses to establish a finance committee or an executive committee, at least 1 appointed member of Council shall be on such committee. 3. Clause 6 a) of By-law 2012-093 is deleted and the following substituted therefor: a) Public The meetings of the Board shall be open to the public and no person shall be excluded from a Board meeting except for improper conduct or for reasons set out in subsection 239(2) of the Municipal Act, 2001. 4. The following sections shall be added to By-law 2012-093: 3. The following sections shall be added to By-law 2012-093: 12.1 The Board shall be responsible for such maintenance and operation of the properties referred to in section 1 of this By-law (the "Properties") as it deems proper or necessary to keep the Properties clean and in good condition including custodial care, care of the gardens and arbors, elevator maintenance, alarm monitoring and snow clearing. The Municipality shall be responsible for grass cutting. 12.2 In consultation with the Municipality's Director of Operations, the Board shall plan and provide for any proposed internal improvements to the Properties. 12.3 The Municipality shall be responsible for the building envelopes and physical plant through its annual budget process. Neither the Board nor its employees shall physically alter or contract to alter any physical aspect of the Properties or the grounds without prior written Council approval. 5.
