CD-28-84 File: 60. 17. 107. SUBJECT: HERITAGE DESIGNATION "WALTHAM COTTAGE" 49 DIVISION STREET BOWMANVILLE - OWNERS: ARTHUR AND EVA JACKSON. RECOMMENDATIONS: It is respectfully recommended, that the General Purpose and Administration Committee recommend to Council the following: 1 . That this report be received; and 2. That the by-law attached to Report CD-28-84 be forwarded to Council for passage; and 3. That the Clerk be authorized to carry out all of the actions necessary to complete the process of property designation pursuant to The Ontario Heritage Act, 1974, and detailed within Report CD-28-84. BACKGROUND AND COMMENT: On January 23rd 1984, Council adopted the Report of the General Purpose and Administration Committee which directed, "that the Clerk prepare, send and publish the required notices of intent, pursuant to Section 29 of The Ontario Heritage Act, 1974, and to report back to Council following the prescribed notification period with respect to the designating of "Waltham Cottage", 49 Division Street, Bowmanville. In accordance with Council 's direction the following actions were carried out: r Continued . . . . ./2 /err CD-28-84 - 2 - MAY 7th 1984 1 . Notice of Intention to Designate was forwarded to the owners of the property, and to the Ontario Heritage Foundation by Registered Mail , dated February 29th 1984; 2. Notice of Intention to Designate was published in the Canadian Statesman once each week, for three successive weeks, February 29th March 7th and March 14th 1984; 3. A legal description of the subject property was requisitioned from Mr. Merrill Brown, O.L.S. ; 4. A by-law to designate the property pursuant to The Ontario Heritage Act, 1974, was prepared (copy attached). REPORT: The period for filing of objections to the proposed designation ended on March 30th 1984, and I would advise that no objections were filed during the objection period, nor have any objections been filed subsequent thereto. Having regard for the fact, that no objections to the designating of the property have been filed, and that the owners have consented in writing to the designation, it is appropriate that the following actions be taken: 1 . That the by-law to designate the property be recommended to Council for passage; and 2. That the Clerk be authorized to publish a Notice of Designation in the newspaper, and forward a certified copy of the by-law to the property owner and to the Ontario Heritage Foundation; and 3. That a copy of the by-law designating the property be forwarded to the Town' s Solicitor for registration on title, so that future owners will be aware of the fact that the property has been designated; and 4. That the Local Architectural Conservation Advisory Committee (LACAC) be advised that the property has been designated. Respectfully submitted, David W. Oakes, B.A. , A.M.C.T. , Town Clerk. nwn/m-, THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 84- being a by-law to designate the property known municipally as 49 Division Street, Bowmanville, as being of architectural and historical value or interest WHEREAS The Ontario Heritage Act, 1974, authorizes the Council of a Municipality to enact by-laws to designate real property, including all the buildings and structures thereon, to be of architectural or historical interest; and WHEREAS the Council of the Corporation of the Town of Newcastle has caused to be served upon the owners of the lands and premises known as "Waltham Cottage" at 49 Division Street, in the former Town of Bowmanville, and upon the Ontario Heritage Foundation, Notice of Intention to Designate the aforesaid real property, and has caused such notice of intention to be published in the Canadian Statesman, a newspaper having a general circulation in the municipality, once each week for three consecutive weeks, namely; February 29th, March 7th, March 14th 1984; and WHEREAS the property at 49 Division Street, in the former Town of Bowmanville has a very significant architectural and historical value, of interest to the Town of Newcastle and its people, in that the property forms part of an important grouping of mid-nineteenth century houses located at the intersection of Division and Wellington Streets, and in particular, the following parts of the real property are specifically designated as being of architectural and historical value: (a) The Front Veranda; (b) The original sash windows; (c) The four pairs of French Doors; (d) The inner and outer front doorways, together with their transoms and side lights; (e) The concrete block garage. WHEREAS the Local Architectural Conservation Advisory Committee of the Town of Newcastle has recommended that the property at 49 Division Street, in the former Town of Bowmanville be designated under the terms and conditions of the Ontario Heritage Act, 1984; and WHEREAS no notice of objection to the proposed designation has been served upon the Clerk of the Municipality; NOW THEREFORE the Council of the Corporation of the Town of Newcastle hereby enacts as follows: 1. There is designated as being of architectural and historical value of interest, the real property known as "Waltham Cottage" at 49 Division Street, in the former Town of Bowmanville, now in the Town of Newcastle, more particularly described in Schedule "A" hereto. 2. The Municipal Solicitor is hereby authorized to cause a copy of this by-law to be registered against the property described in Schedule "A" hereto, in the proper land registry office. BY-LAW 84- - 2 - 3. The Town Clerk is hereby authorized to cause a copy of this by-law to be served upon the owners of the aforesaid property and on the Ontario Heritage Foundation and to cause notice of the passing of this by-law to be published in the Canadian Statesman, a newspaper having general circulation in the Municipality, once for each of three consecutive weeks. By-law read a first and second time this day of 1984. By-law read a third time and finally passed this day of 1984. Mayor Clerk 7 SCHEDULE "A" ALL AND SINGULAR that certain parcel or tract of land and premises known as 49 Division Street, Bowmanville, situate, lying and being in the Town of Newcastle, Regional Municipality of Durham, Province of Ontario, and being composed of Part of the original Township Lot Number Eleven (11) in the First Concession of the Geographic Township of Darlington, forming part of the former Town of Bowmanville, and better known and described as all of Town Lots One (1) and Two (2) in Block "X" except the South 50 feet thereof, according to a plan of the former Town of Bowmanville, made by John Grant, P.L.S., which plan was registered on the 20th day of April, 1852, in the Land Registry Office for the Registry Division of Newcastle (#10).
