SUBJECT: Report on Application for Official Plan Amendment
No. 147 and Application for Rezoning No. Z--A-1-4-2
Part Lot 22, Concession 2, Darlington -

1. PURPOSE OF APPLICATION
On September 28, 1977, an application was submitted to the Region of
Durham Planning Department for a change in the designation of a 5.53 acre
parcel located in part of Lot 22, Concession 2, Darlington from Open Space
to Commercial. This was to permit a take-out restaurant on the site.
This application was referred to the Planning Advisory Committee October
24, 1977.
2. OFFICIAL PLAN PROVISIONS

The site is presently designated "Major Open Space" in the Region of

Durham Official Flan. The creation of new commercial uses in areas with this
designation is not permitted. A special provision to the "Major Open Space"
designation would be required to permit the establishment of a take--out
restaurant on the site.
3. ZONE PROVISIONS
The site is zoned "Agriculture" in the Dariington Zoning By-law. The
applicant has requested a rezoning to Highway Commercial.
PV4. CIRCULATION OF COMMENTS
The applications were circulated to the following agencies for their
comments:
1) Regional Health Unit
2) Bell. Canada
3) Ministry of Transportation and Communications
4) Ontario Hydro
5) Newcastle Works Department
6) Newcastle Building Department
7) Newcastle Fire Department
8) Consumers Gas
9) Ministry of Agriculture and food
Bell Canada, the Newcastle lire Department and the Consumers Gas
Company did not reply and were assumed to have no comments.
5. RESUME OF COMMENTS
1) REGIONAL HEALTH UNLT, ONTARIO HYDRO, NEWCASTLE_WORKS DEPARTMENT,_
NEWCASTLE BUILDING DEPARTMENT and MINISTRY OF AGRICULTURE AND
FOOD - advised that they had no objections to the subject
applications.
2) MINISTRY OF TRANSPORTATION AND COMMUNICATION - advised that they have
no objection to the proposed rezoning, but stated that access to tlae
subject site should be restricted to the side road abutting the site
instead of Highway 112.
6. COMMENTS
There are two basic issues which must be considered in the evaluation
of this appLication. The first Is the suEtabili.ty of the particular lot for
the use proposed. Tile second is the advisability of permitting non-
agricultural commercial areas to be established on any site outside of
established or proposed urban areas.
1 . Site Characteristics
The land proposed for the take--out. restaurant is a 5.53 acre parcel
bounded on the north by Highway 112 and on the west by the eleventh line. We
have been advised by the MinLst:ry of Agriculture rand food that, since the

land falls within the "Class 4" category and "has no agricultural value" ,
t;hey.-_would1bave no objections to this development .
However, the Ministry of Transportation and Communi.caLlon has
stated that vehicular access to the site must be restricted to Road 11 .
The west side of Road 11 abets a strip of approximately 30 houses. On
the day the site inspection was done, the road did not appear to be of
a standard requirement to handle increased vehiculat traffic. We also
feel that the establishment of a commercial. use aL this location could be-
detrimental to the residential uses In the area .
2. Should Non- Agricultural. Commercial. Uses be Permitted in
Rural Areas?
_ At present, Highway #2 between Bowmanvillc and Oshawa is flanked
by numerous scattered commercial uses. 'These uses have, Ln many cases,
been established before the enactment of the Dar l ingLou %onLng By-law
and Official Plan. In some cases, these commercial uses conflict, with
abutting residential uses. We feel that if new commercial development
is to be permitted at all outside of Lhe exLstLnn or proposed urban areas,
it would be logical to expand existing nodes of commercial development
which do not conflict with abutting rises rather than to perpetuate a
helter-skelter type of development.
For the reasons mentioned above, we would recommend :
1) that the Region of Durham be advised that the Town of

Newcastle does not recommend Official Plan Amendment
application number 147 for approval .
2) that Application for Rezoning number Z-A-1-4-2 not be
approved.
