WHEREAS the Corporation of the Town of Bowmanville is desirous of acquiring land for the purpose of sites for the establishment and carrying on of industries; BE IT RESOLVED that the Town of Bowmanville offer to purchase from Mary Ann Short, LeRoy Burke Short and Russell Blake Mann Short, the following described property: ALL AND SINGULAR those certain parcels or tracts of land situate in the Town of Bow- manville, in the County of Durham, being composed of parts of original Township lots 9 and 10 in the Broken Front Concession, comprising One parcel on the east side of Simpson Avenue and two parcels on the west side of Simpson Avenue containing in all 70 acres more or less of vacant farm land (not included in the sale are the house and farm buildings and five acres of land from the total holding of 75 acres). at a total price of $150,000.00 subject to the following terms and conditions: 1. The deposit shall be $5,000.00 which shall be credited on account of the purchase price on closing. 2. The closing date shall be on or before the l5th day of January, 1969 at which time the balance of the purchase price is to be paid in cash or certified cheque, subject to adjust- ment S of t axe s. 3. The Vendor shall provide a survey of the 5 acre parcel being retained out of the Vendor's farm, which shall comply with the Zoning regulations of the Town of Bowmanville. 4. The total purchase price shall be adjusted in the event that there is an increase or decrease of more than one acre of land being purchased by reducing or increasing the purchase price at the price per acre of the 70 acres at $150,000.00. e Resurfacing of Lovers Lane By-Law No. 68-42 By-Law No. 68-42 Adjournment // ,,(/ _ /~C). ,. The Vendor agrees to join in any application required to close the street shown on the Smart Estate Plan registered on the lands being purchased and provided that the Town is to make any necessary application to close the said street follOWing the completion of the purchase and sale. And provided that the Offer to 6. Purchase shall be subject to the Council of the Town of Bowmanville passing a by-law pursuant to Section 379 (I) Paragraph 47 of The MuniCipal Act, authorizing the purchase within 30 days from the date of acceptance of the said Offer 7. to Purchase. And provided that this Offer shall be further conditional on the Town of Bowmanville obtaining the approval of the Ontario Municipal Board for the raising of the funds required to complete this purchase within 60 days from the date of acceptance of the Offer to Purchase. 8. That the Offer be open for acceptance until the 4th day of November next. "CARRIED UNANIMOUSLY" Re.solution DC-568 THAT the resurfacing of Lovers Lane with asphalt material be held in abeyance until completion of laying sanitary sewer under local improvement. THAT the first reading of By-Law No. 68-42 being a by-law to authorize the construction of certain works as local improvements be approved. "CARRIED" Resolution ffC-570 Moved by Con. Dykstra, seconded by Deputy Reeve Rundle. THAT the second reading of By-Law No. 68-42 be approved. "CARRIED" Re~olution #C-57l Moved by Con. Dykstra, seconded by Deputy Reeve Rundle.
