COUNCIL MINUTES
The regular meeting of Bowmanville Town Council convened at 8:00
p.m. on Tuesday, December 7th, 1965 at the Council Chambers, Town
Hall with His Worship l~yor Ivan M. Hobbs in the Chair. All
members pre sent.

THAT the minutes of the meetings held Monday, November 15th, and
Monday, November 29th, 1965 be received and adopted.

. III PETITIONS & DEPUTATIONS:
1. ~~. George Cawker:
"
Mr. George Cawker appeared before Council protesting the decision
of the Bowmanville Arena Management Committee regarding the
tender to operate a Summer Hockey School at the Arena for the
summer of 1966. A lengthy discussion took place regarding this
matter, following which it was:

THAT this Council go on record requesting the Arena Board to re-
consider the applications regarding the Summer Hockey School at
the Arena.

2. Mrs. T. Westover:
Mrs. T. Westover, High Street, Bowmanville, appeared before
Council requesting permission for the use of the old Library
Building to have a rummage sale for the Girl Guides.
Moved by Deputy Reeve Stevens, seconded by Con. Hughes.
THAT permission be granted providing the Town still owns the
property at the time the rummage sale is to be held.

COMMUNI CAT IONS:
1. World Heritage Organization:
"To mark Canada's Centennial by sharing with newly emerging
nations, standing at the same threshold on which we stood 100
years ago, we ask your municipality to join others in helping
to provide school text books for children in Africa and Asia.
Five out of every ten of the millions of children in these
countries cannot read or write, and will never be able to
support themselves. l~ny teachers, voluntarily enduring hard-
ships to help these children are handicapped by having as few
as 2 books for every 100 children who are eager to learn.
Canadian Institute of Cultural Research sponsor World Heritage
in supplying free books, where they are most needed. Joint
Canadian effort made possible the shipment of 80 tons of new
text books to Nigerian schools last month. However, it will
take great effort to continue shipments, and in particular to
fulfill a committment to supply school books in French to Gabon,
made to the late Dr. Albert Schweitzer at his Lambarene hospital.
Names of municipalities are included with shipments. As it
takes time to assemble and effect deliveries in remote areas,
financial support is urgently required now, so that school
children may receive the books before our centennial year begins.
It takes $1000 to equip a complete school library - $500 for a
moderate one - $250 for a smaller one. Books for an individual
child cost $25 for junior grades - ~?50 for senior.
I hope that you will join with other municipalities in Canada's
Centenn~al Gift to school children who so desperately need your
help. Your cheque to cover the cost of a school library or a
child's books would, indeed, be most gratefully received at this
time, as another large shipment of books is now being assembled. It

2. Department of Municipal Affairs:
"On September 20, 1965 a statement was issued announcing that the
policy of the Government of Ontario with regard to the effect of
the Canada Pension Plan on pension plans for the employees of the
Province, provincial agencies and other plans for which the Govern-
ment is res pons ible, would be that these plans be "integrated"
with the Canada Pension Plan as of January 1, 1966.
As the result of the adoption of this policy by the Government
the regulations under The OMERS Act were amended on September
22, 1965 to provide for "integration" with the Canada Pension
Plan.
I attach a copy of a Memorandum which I sent, under date of Sept-
ember 24, 1965 to all municipalities and local boards participat-
ing in the Ontario Municipal Employees Retirement System, outlining
the statement on Government policy and the principles upon which
the pension benefits available from O~ffiRS would be integrated
with the Canada Pension Plan.

As may be seen from an examination of the statement of September
20 1965, it was the intention of the Government, in the interests
of' equality, that the above mentioned policy apply! r:ot <?n~y to
the pension benefits available to employees of munlclpalltles
and local boards who are members of OriliRS, but also to those
employees whose pension benefits are provided by an "approved
pension plan".
An "approved pension plan" may be defined as a pension plan
established under any general or special Act that has not been
discontinued by a municipality or local board by reason of an
election to participate in OiffiRS for present employees.
In accordance with the policy of the Government the following
are the principles upon which the terms and conditions of an
"approved pension plan" should be amended to give effect to
"integration" with the Canada Pension Plan:
(1) pension benefits earned for service rendered before January
1st, 1966 are not to be reduced and
(2) Pension benefits under an "approved pension plan" for service
rendered after January 1, 1966 shall not exceed the pension
benefits provided under The O~ffiRS Act and the regulations for
service rendered after January 1, 1966 except to the extent
that the pension benefits under an "approved pension plan"
before January 1, 1966 exceeded the pension benefits under
The OMERS Act and the Regulations.
Amendments submitted to the Department for approval under Section
248c of The Municipal Act will be approved only in conformance
with the above mentioned principles.
The officers of the Department will be pleased to disCUSS the
significance of these principles with any municipal official."

ing the Canada Pension Plan, dated December 1st, 1965, be re-
ceived and referred to the Finance Committee.

3. Jaroslav Trejbal:
"Enclosed is a copy of my letter to Bowmanville Town Council from
September, 1965.
Despite the urgency of the matter, nothing has happened until now,
in fact, I did not even get any answer.
The north side of the approach to the crossing has not a proper
ditch on the east side, the culvert was nearly flattened on the
west side by the grader this spring and made it more or less
usless. This culvert is too small anyway and many times in the
winter the water runs hundreds of yards in the middle of the road,
then freezes and makes the approach to the tracks impossible and
dangerous. It was so bad a few times last year that you could
not even walk on it with ice underneath and inches of water run-
ning on top.

I would appreciate it very much if you could look into this
matter and ask your V{orks Department to repair the crossing so
it responds to the basic safety conditions. The absolute mini-
mum that should be done before winter is a new culvert further
north of the old one capable of taking the water away in the
spring, a few loads of gravel to level the north side of the
crossing and fill all holes. The ditch on the east side must
also be made longer."
Letter dated September, 1965:
"vVith reference to your letter, dated February 16th, 1965,
about the dangerous conditions of thc C.P.R. Crossing on Mearns
Avenue, I would like to bring to your attention that nothing
has been done to repair it until now.
Hundreds of cars and trucks were using this road on the way to
Mosport lately, causing big holes on both sides of the track
and between them. I asked the C.P.R. lf~nagement to look into
the matter with the result that the Inspector said he seldom
has seen a crossing in such a miserable condition as this one,
but the responsibility lays exclusively with you, he claims.
I ask you once more to consider the immediate remedy to bring
the crossing to minimum safety standards before winter time, as
follows:
(1) To make the crossing wider so the cars can pass.
(2) To fill the holes and pave the crossing.
(3) To make the oncoming cars visible by making the north side
approach longer and to prevent the collision in the middle
of the track and prevent damage to longer cars and trucks
which catch the track with the bottom.
(4) To bring the road on the north side to level and use the
right size of culverts to provent them washing away each
spring.
Plcase do not shelve this letter again, because it is only by
sheer luck that a serious accident has not happened until now on
this unprotected, badly damaged, faulty built crossing with poor
visibility of oncoming trains and no visibility at all of on-
coming cars."

THAT the letter from Jaroslav Trejbal, dated November 30th, 1965,
be received and referred to the 1966 Roads & Streets Committee
and that the Deputy Clerk be instructed to send a reply to this
letter.

4. Bowmanville Public Library:
"A meeting with the auditors, Duputy Reeve Stevens, Acting Clerk,
C. S. Oke, and myself was held in the Town offices on December
6th to discuss the matter of the rent on the new library building.
The auditors have suggested that a rent of $2700.00 per month
would be reasonable and advised us that they would forward a
letter to Council to this effect.

In order that the Library Board will be able to m~et this com-
mitment and also to cover the additional rent of $200.00 per
month which has been paid on the old building during 1965, an
additional grant of $7400.00 will be required. This amount
would be made up as follows: $2700.00 per month for November
and December, 1965 and (~200.00 per month from January to
October, 1965.
The Library Board would like to have the rent for November and
December paid in full before December 31st, 1965 in order that
the new figure may be included in our audit for 1965.
Your early attention to this matter will be appreciated."

THAT the letter from the Bowmanville Public Library, dated
December 6th, 1965, be received and that the rent be set at
~2700.00 per month and that we forward to the Library Board the
~7400.00 as requested.

"I note that your appointments for Trustees on this Board are
as follows:

(2) Alex McGregor for 1963 - 64 - 65
(3) Alan Strike for 1965 - 66 - 67.

Mayor Hobbs suggested that a number of these retrospects be
placed in the Library and the remainder be placed in the
Museum.
21. Mr. R. Heydens:
"Mr. R. Heydens, Music Teacher for the Bowmanville Public
Schools, would like permission during Christmas week for
School children to sing Christmas Carols at the four corners.
There will be about 300 children each evening singing. Time
will be about 7:00 p.m."
