"Carried" Council Meeting Minutes - 4 - December 15, 2014 Presentations Mayor Foster presented Congratulatory Certificates to the following members of the Darlington Fusion U16 Girls Soccer Team in recognition of their Provincial and National Championship wins: Sierra Adey, Mackaylen'Bickle, Alexandra Caputo, Hannah Chau- Stacey, Erin Dicaire, Madison Foote, Lindsey Hoffman, Rhiannon Kissel, Allison Lantagine, Emma Meadows, Sarah Norman - Minnis, Alicia Pallister and Kristen Thompson. Also recognized, but not in attendance, were Emily Armstrong, Sydney Carr, Sabryna Persaud and Breanna Whitney. Mayor Foster presented a Congratulatory Certificate to Marilyn Morawetz in . recognition of her receipt of the A.K. Sculthrope Award for Advocacy from the Architectural Conservancy of Ontario. Steve Usher, SLR Consulting, addressed Council to present an interim report regarding the peer review SLR Consulting has been undertaking on the Hydro One Clarington Transformer Station project on behalf of the Municipality. Through use of a PowerPoint presentation, Mr. Usher listed the documents reviewed including the 2007 ESR for the Enfield Transformer Station; the 2013- ESR for the Clarington Transformer Station including the hydrogeologic and hydrologic appendix; submissions by G360, the Region of Durham, the Municipality of Clarington, and the 2014 Ministry of the Environment (MOE) approval and conditions; and, the 2014 Water Monitoring Program and 2014 Baseline Monitoring Report. Mr. Usher indicated that to date, he has met with residents, reviewed the reports listed, participated in the scoping of the deep hole mandated by Clarington, attended the site on several occasions to observe the drilling and logging of the core and met with Hydro One's technical staff, at their request. He advised that recently an application for a permit to take water was submitted by Hydro One and he is expecting to review those documents on behalf of the Municipality when they become available. Mr. Usher highlighted a site conceptual geologic model on display describing soil types, the concept of groundwater flow and aquifers, wells and aquitards. Mr. Usher reviewed preliminary conclusions indicating that most shallow wells are unlikely to be affected; however, downhill shallow wells must be protected. He also stated that deep Thorncliffe wells are unlikely to be affected; site creeks fed by weathered Halton till must also be protected and the likely presence of the Halton till infers the presence of the Mackinaw horizon. He stated that the Mackinaw horizon is locally absent; however, it may be a groundwater pathway but noted continuity and connectivity is not yet understood. Mr. Usher stated nine of the 22 local wells are in this horizon but most are not downhill. Mr. Usher outlined next steps to be undertaken. He stated he will be reviewing the Permit to Take Water application, he will re -visit the site once there is a snowfall to focus on springs and wetlands, he will meet with Hydro One to review the Stantec borehole logs and he will review the proposed engineering measure in case of a spill. Mr. Usher acknowledged that following the review a further report will be presented to Council. Mr. Usher responded to questions from Members of Council. Council Meeting Minutes - 5 - December 15, 2014 Delegations Laura Vaillancourt, Ontario Philharmonic, addressed Council expressing appreciation on behalf of the Ontario Philharmonic to Mayor Foster for his enthusiastic endorsement of the Durham Region's Mayor Gala, an event when the Mayors from all the municipalities in the Region come together to support culture. Ms. Vaillancourt stated the 2014 Gala netted $85,000 for the Ontario Philharmonic noting the 2015 Gala is scheduled to be held on October 2, 2015, Ms. Vaillancourt presented Mayor Foster with a token of appreciation. Clint Cole addressed Council concerning Correspondence Item D — 9 - Clarington Hydro One Transformer Station requesting Council to endorse a resolution to officially invite the City of Toronto Council to assist Clarington in the crucial protection of the ground source water supply on the Oak Ridges Moraine (ORM), which exists both in Clarington and across the Greater Toronto Area (GTA), and has been identified by the Province to be environmentally protected. Mr. Cole acknowledged and thanked Council for their support to date and for the collaborative effort of the Members of the Enniskillen Environmental Association (EEA), municipal staff, Dr. Cherry and Group 360 and Dr. Gerber. Mr. Cole stated there is a lot going on geologically and ecologically on the site, but that there are many questions to be answered. Mr. Cole raised several points discussed by Mr. Usher in the previous presentation and questioned the presence of coliform in private wells. He noted that none of the 22- wells were in close proximity to agricultural activities. Mr. Cole expressed concern that no baseline testing -of wells had been performed to test for bacteria. He also expressed concern with the assumption that proper baseline testing of all four seasons has been collected. Mr. Cole stated he feels it is incumbent to request a moratorium on this project and to lobby the Ministry of the Environment to require Hydro One Networks Inc. to do a bump -up assessment. Resolution #C -374- Moved by Councillor Neal, seconded by Councillor Traill That the delegation of Clint Cole be extended for two minutes. "Carried" Mr. Cole indicated that he had just been made aware that the application for the Permit to Take Water from the site has a review period that is almost up and expressed concern that residents are not receiving information in a timely manner. He urged Council to help the EEA to lobby the Ministry of the Environment to slow the project down until the proper data is received. Mr. Cole also requested Council to pursue a water protection by -law with the Region of Durham in an effort to augment existing policy and address gaps in Provincial legislation that leave residents unprotected. Mr. Cole responded to questions from Members of Council. Council Meeting Minutes - 6 - December 15, 2014 Preet Khurana, Southeast Clarington Ratepayers Association (SECRA) addressed Council concerning Correspondence Item D —11 - Clarington Wind Farm /Port Granby Dust Management. Through use of a PowerPoint presentation, Mr. Khurana expressed concern regarding the compatibility between the proposed Clarington Wind Farm Project and the existing Port Granby project. Mr. Khurana referred to the study entitled "Assessment of the Impact of Wind Turbine Operations at the Clarington Wind Farm on Dust Management at the AECL Port Granby Site" prepared by Echologics Engineering Limited, for Atomic Energy of Canada. Ltd., September 6, 2012, raising questions and expressing concern with the findings of the study. Mr. Khurana noted the effect of the wake has been studied at only one wind speed at the anemometer height of 10m, the numbers for the wake velocity don't fit back in and properly balance the equation from which they came, the mainflow equation is incorrect by a multiplier of four, the value used for the air density might not represent a worst case scenario, the previous four concerns may also have distorted the results obtained through Computational Fluid Dynamics (CFD) carried out on a computer and the three Lancaster Road Wind Turbines east of the Port Granby Project were excluded from the Impact Assessment without actually performing detailed modelling on them. Mr. Khurana indicated that he had hoped to submit his concerns to the Ministry of the Environment (MOE) for consideration in their technical review of the Clarington Wind Farm, prior to a decision; however, by the time he was in a position to raise concerns, the application had already been approved. -Mr. Khurana believes his concerns and questions should prompt further review of the Impact Assessment study by Wind Energy Experts. Mr. Khurana submitted a document he authored entitled "Concerns for Consideration ", December 15, 2014. Mr. Khurana responded to questions from Members of Council. Gerry Mahoney, Southeast Clarington Ratepayers Association (SECRA) addressed Council concerning Correspondence Item D — 11 - Clarington Wind Farm /Port Granby Dust Management. Mr. Mahoney indicated that he is aware of Mr. Khurana's work and supports his findings. He stated the issue is critical as the safety of area residents depends on whether the turbines will have an effect. Mr. Mahoney suggested the matter be brought to the attention of the Ministry of the Environment, the AECL and the CNSC and requested that Council assist in having the information reviewed. Mr. Mahoney indicated that he would also be bringing the matter to the attention of Granville Anderson, MPP, Durham.. Prior to the meeting, Mario Veltri advised he would not be addressing Council this evening. The Health and Social Services Committee requested that the EFW -WMAC provide comments on the REGIONAL MOBILE AIR QUALITY MONITORING PROGRAM 2014 - MOH -02 report. These comments were prepared by the EFW - WMAC and submitted on Monday, December 15, 2014. We have had several summary reports from Regional staff regarding the following: • Gioseph Anello, Manager, Waste Planning and Technical Services, • Regular EFW Updates, • Reporting and Budget Development, • Waste Management Update, • Battery program, • Clear Bag discussion. • Presentation by Ministry of the Environment and Climate Change Sandra Thomas and Dave Fumerton on: o Role of the District Office o Project Issues o Compliance of Durham York Energy Centre. • Correspondence from C. Bandel, Deputy Clerk, The Region of Durham o Regional Mobile Air Quality Monitoring Program (2014 - MOH -02). • EFW -WMAC response to this report with clear. message that additional Air Monitoring at source would be a welcome outcome. • David Crome, Director, Planning Services, Municipality of Clarington; Sheila Hall .Executive Director, Economic Development Officer Clarington Board of Trade, o Clarington Energy Business Park: Progress to 2015. • Burnaby WTE Facility Fly Ash Review: Review of Existing Fly Ash Treatment • Delegation request From Linda Gasser to speak to this issue, • Stantec Report review, policy details and recommendations. OTHER BUSINESS: • 2014 -WR -4 Information Report on Various Strategies Used or Tested by Other Municipalities for the Mitigation of Litter from Blue Box Set Outs • 2014 -WR -5 Update on Compact Fluorescent Lamps and Fluorescent Tube Recycling Program, as part of the Regional Municipality of Durham's Municipal Hazardous or Special Waste Program • 2014 -WR -6 Update on Expanded Polystyrene Recycling Program • 2014 -WR -7 2013 Waste Management Annual Report • 2014 -WR -8 Report on Staff Investigation of Reduced Garbage Bag Limits, Fees Associated with the,Regional Municipality of Durham's Waste Management Facilities, and Residents' Reaction to Eco- station Concept • 2014 -WR -9 Dissolution of Brock Township Landfill Public Liaison Committee • 2014 -WR -10 Update Report on Clear Plastic Bags for the Curbside Collection of Garbage • 2014 -WR -11 Update on the Recycling of Disposal Hot Beverage Cups -2- SUMMARY: We have covered a significant amount of material as a committee and had several debates over the air monitoring opportunity facing Durham Region with the opening of the EFW. The committee discussed that adequate sampling be undertaken to properly capture what is happening on the ground. Data is important to protect public health, additional monitoring is welcomed. Highlights of our recommendations include the following: • Seven (7) comments dealt specifically with the document contents. • Fourteen (14) comments dealt with the development of an air monitoring program. • Specifically the committee provided the following comments: o Similar methodology and increased coverage as used in other areas such as Halton Region, • More focus on long term data collection, not just short term /event oriented data collection, • A more comprehensive approach to air shed monitoring in Durham Region, and • The utilization of best practices and international /national /provincial standards to ensure protection of the air we breathe. Our committee struggled to deliver much activity at public events during 2014 season. No regional recycling events were attended by committee members due to committee re- appoint timeframes and volunteer policies during the Region work stoppage. Our committee activities were presented by Ted Baker to Pickering Council at the July 7th meeting and Ted Baker and Suzanne Barnes attended the OPG Darlington Energy Complex Open House events November 2014. The committee is looking forward to touring the EFW facility and for returning members, comparing to our Onondaga site visit. We have plans as committee members to attend over 25 Durham Region Works Recycling Events, 4 scheduled EFW -WMAC meetings and several community outreach events throughout 2015. Waste diversion is an evolving environment where results are being rewritten as rules change. I - As the committee Chair and Vice Chair we would like to thank and congratulate Mirka and Gio from Works Department. Their effort, support and awards have been first class. We look forward to a full and exciting year ahead and appreciate the opportunity that's been given us to make a difference in our communities this way. Highway 401 Exits at Waverley Road and-Liberty Street Whereas drivers exiting the 401 off ramps for Waverley Road and Liberty Street are experiencing significant delays; Now therefore be it resolved that Council forward a letter to the Minister of Transportation requesting that they, forthwith, provide the necessary infrastructure changes to alleviate the situation such that drivers are not placed in danger; and That this resolution by forwarded to the Region of Durham, and Durham MPP, Granville Anderson.
